The Council of the Township of Monroe met at the Monroe Township Municipal Building, 1 Municipal Plaza, for a Combined Agenda/Regular Meeting.

The Combined Agenda/Regular Meeting was Called to Order at 7:00 p.m. by Council President Stephen Dalina with a Salute to the Flag.

ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Alan M. Weinberg, Township Attorney Greg Pasquale, Engineer Mark Rasimowicz and Deputy Township Clerk Tanya Pannucci.

There were approximately twenty (20) members of the Public present in the audience.

Council President Dalina announced that the Special Meeting is being called to order for the purpose of

addressing the payment of year-end claims, conducting Public Hearings on various Second Reading

Ordinance for final adoption, consideration of various Resolutions and any other business that may come

before the Council.  The regularly scheduled Agenda Meeting will immediately follow

Mayor Tamburro called upon Patricia Ryan to come up to honor her for her 31 years of service working for

the Township. He commented that she made sure everyone in the Finance Department did the right thing and was a leader for many years, who not only is loved by her peers and union members but will be sorely missed. He presented her with a plaque and congratulated her in her retirement.Council President Dalina commented that her retiring is a tough loss for the Township but wished her well in all of her future endeavors.  

A brief recess was taken with the meeting reconvening at 7:15pm.

ORDINANCEas follows: (O-12-2018-044)

WHEREAS, Monroe Township Code Chapter 108, Section 13.8 entitled, "Stormwater management facility (ies) dedications", requires, interalia, that all stormwater management facilities located within or as part of a single-family residential use development be dedicated to the Township; and

WHEREAS, pursuant to said provision, Dynasty Associates, LLC, a/k/a Dynasty Estates, proposes to dedicate one (1) detention basin lot to the Township as part of the single-family residential subdivision known as Dynasty Estates; and

WHEREAS, Dynasty Associates received Final Subdivision approval for the Dynasty Estates development on or about May 22, 2003, memorialized on June 26, 1999 (PB-826-03), amended on April 28, 2005, memorialized on May 26, 2005 (PB-929-04), which approved plans included the dedication of Block 109.21, Lot 7.75 as a detention basin lot; and

WHEREAS, the Township of Monroe believes it to be in the public interest to accept the dedication of said lot in accordance with the resolution of amended subdivision approval adopted by the Monroe Township Planning Board; and

WHEREAS, the Township Engineer has reviewed the attached metes and bounds description for said lot and has found same to be in conformity with the Planning Board approval and recommends acceptance of the Deed of Dedication; and

WHEREAS, the Township Attorney has reviewed and approved the proposed Deed of Dedication.

NOW, THEREFORE, BE IT ORDAINEDby the Mayor and Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

Section 1.         The Mayor and Township Clerk are hereby authorized to accept the Deed of Dedication transferring Block 109.21, Lot 7.75, the one (1) lot proposed to be dedicated as part of the Dynasty Estates, conditioned upon the compliance of Dynasty Associates, LLC with Chapter 108, Section 13.8 of the Code of the Township of Monroe, provided said deed is in form satisfactory to the Township Attorney, and subject to the restrictions contained in Chapter 108 Section 12.16 of the Township Code;

Section 2.         The Grantor shall be Dynasty Associates, LLC, the owner of the property, who shall convey the premises free and clear of encumbrances and restrictions. 

Section 3.         All ordinances or parts of ordinances inconsistent herewith are hereby repealed. 

Section 4.         Any and all accumulated taxes due on the referenced Lot and Block shall be paid by Dynasty Associates, LLC through December 31, 2018. 

Section 5.         If any section, subdivision, sentence, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

            WHEREAS, Ronald Longo, Bruce P. Longo, David J. Longo and Chad A. Longo are the owners of real property in Monroe commonly known as 10 Old Church Road (“Owners”), identified on the official Tax Map of the Township of Monroe as Lot 3/3Q in Block 15 in the Township of Monroe, County of Middlesex, and State of New Jersey (the “Property”); and

            WHEREAS, the Property consists of 15.5 +acres, of which all but one (1) acre are currently assessed as farmland and actively being farmed; and

            WHEREAS, the Owners propose to subdivide the Property into two (2) lots, retaining 5.99 +acres and selling the remaining 9.51 +acres to the Township as open space; and

            WHEREAS, the Property is located in the R3A Residential Zone, which permits a minimum lot size of 3 acres and could potentially be developed with numerous single family residential dwellings; and

            WHEREAS, one of the express goals of the open space acquisition program approved by the citizens of Monroe Township in 2002 is farmland preservation; and

            WHEREAS, by Resolution Nos.: R-11-2017-286 and R-11-2017-288, the Township Council authorized an appraisal and an environmental assessment of the Property; and

            WHEREAS, the Owners have agreed to a deed restriction on the 5.99 +retained acres prohibiting subdivision thereof; and

            WHEREAS, by appraisal dated November 15, 2017, the value of the entire parcel was estimated to be Seven Hundred Thousand Dollars ($700,000.00); and

            WHEREAS, by appraisal dated January 29, 2018, the value of the portion of the Property to be acquired by the Township was Five Hundred Twenty-Five Thousand Dollars ($525,000.00); and

            WHEREAS, the Township engaged in arms-length negotiations with the owners for purchase of the Property, and the parties reached an agreed-upon sale price of Five Hundred Twenty-Five Thousand Dollars ($525,000.00); and

            WHEREAS, the Township’s purchase of the Property will preserve it as open space and farmland for the citizens of Monroe for generations to come; and

            WHEREAS, the Chief Financial Officer of the Township has verified that there are sufficient funds remaining from the issuance of bonds pursuant to the Open Space Acquisition Bond Ordinance O-2-2012-001, to pay for the aforesaid acquisition;

            NOW, THEREFORE, BE IT ORDAINEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

            Section 1The Mayor, Township Clerk and Township Attorney are hereby authorized and directed to execute any and all documents as are reasonably necessary to acquire fee simple title to the Property, including all improvements erected on, over and beneath aforesaid lands to be acquired, and all easements, rights-of-way or uses, privileges, licenses, hereditaments, appurtenances, interests and other rights belonging to or inuring to the benefit of the lands to be acquired and all right, title and interest of the owners in and to any land lying in the bed of any highway, street, road or avenue, opened or proposed, in front or abutting or adjoining aforesaid lands to be acquired.

            Section 2.  The purchase price for the Property to be acquired for open space shall be Five Hundred Twenty-Five Thousand Dollars ($525,000.00).

            Section 3.  The Mayor and Township Clerk are hereby authorized to accept the Deed transferring the Property to the Township as open space, provided the Deed is in a form satisfactory to the Township Attorney.

            BE IT ORDAINED by the Township Council of the Township of Monroe, in the County of Middlesex, New Jersey as follows:

            Section 1.  Chapter 78 - of the Code of the Township of Monroe, which chapter establishes personnel policies and procedures within the Township of Monroe shall be amended as follows: (new text in redandunderlined, text to be deleted is struck)

§ 78-32.1.  Extended sick leave. [Amended 7-2-12 by Ord. No. O-7-2012-018]

 

Paragraph 1 and 2 to be amended and 4 to be removed as follows:

In the event that any employee, with four (4) or more years of continuous service commencing with the date on which status as a permanent employee was obtained, suffers a debilitating sickness or injury during the course of employment, the township may provide his or her gross pay for a period of ninety (90) calendar days, limited to one (1) leavein a twelve (12) month period. At the start of an employee's ninth (9th) year of employment, there will be no limit on the number of leaves in a twelve (12) month period. Extendedsickleavemay not be utilized until an employee has used all previously accumulated paid time off (i.e sick, vacation and personal time) before he/she is eligible to use extended sick leave time, including any leaveawarded during the period of absence.Such requests shall be made in writing, with medical substantiation, to the Business Administrator. The decision whether to grant extendedsickleaveshall be at the discretion of the Business Administrator after consultation with the Clinical CoordinatorDirector of Health and Human Resources.

After ninety (90) consecutive days of administrative sick leave, an employee may make arequest thatthe Business Administratorobtain authorization from the Township Councilfor an additional extended sick leave of up to ninety (90) days which must be approved by the Business Administrator.

  

During any period of extendedsickleave, an employee will accumulate sickdays in accordance with any union contract formula or at the rate of one (1) day per month.Extendedsickleavemay not be utilized until an employee has used all previously accumulatedsick leave awarded during the period of absence.

§ 78-34.  Maternity leavefor employees hired prior to May 1, 2011.

Paragraph 1 to be amended as follows:

To be eligible for Maternity leave employees must have 2 years of continuous full-time service with the Township as of the date of birth of the child.   Maternityleaveshall be granted to full-time employees with two (2) years or more of full-time service.   Paid leaveshall consist of twelve (12) weeks in any twenty-four (24) month period regardless of whether those days are before or after delivery.  The 60-day leave must be consecutive calendar days and shall run concurrently with the FMLA/FLA.

  • 78-34.1.  Maternity leave for employees hired after May 1, 2011.

Paragraph 1 to be amended as follows:

To be eligible for Maternity leave employees must have 2 years of continuous full-time service with the Township as of the date of birth of the child.  Maternity leaveshall be granted to full-time employees with two (2) years or more of full-time service.   Paid leavefor full-time employees hired after May 1, 2011 shall consist of sixty (60) calendar days in any twenty-four (24) month period regardless of whether those days are before or after delivery. The 60-day leave must be consecutive calendar days and shall run concurrently with the FMLA/FLA.

  • 78-45.  Paydays.

Employees are paid weekly on Fridays. Each paycheck includes earnings for all work performed by the employee through the end of the previous payroll period, as certified by the employee's supervisor to the PayrollFinanceDepartment.

AnIt shall be mandatory allemployees may choose to have hischecksdistributed to him personally by his department head or have itwill be deposited directly into histheirbank account. The Treasurer's OfficeFinance Departmentcomputes all deductions and adjustments for all checks. Questions concerning deductions and net pay should be directed to the Treasurer's Office Finance Department. In the event that there are any verified discrepancies in an employee's pay, they will be corrected and adjusted in the next pay period after verification.

Effective January 1, 2020 all employees will be paid on a semi-monthly basis, which is 24 pay periods per year.  Paydays will be on the 15thand 30thof every month, if that happens to be a holiday or weekend the payday will be the previous workday.

Special items such as a clothing allowance, if applicable, may be included in an employee's regular paycheck, in the township's discretion or as set forth in a collective bargaining agreement.

§ 78-55.  Use of equipment and vehicles.

Paragraph to be added to end of section as follows:

The Township may install a global positioning system (GPS) in Township-owned vehicles.  In implementing these GPS systems, the Township will ensure compliance with federal, state and local laws governing such usage.  The intent of the GPS is to provide an effective deploying resource, improved operational efficiency and customer service. Department Heads will oversee the implementation and operation of the program in their department.

  • 78-58.  Smoking.

   In accordance with state law and the township's goal of providing a healthy work environment, smoking is not permitted inside any public building or any municipal owned vehicle.

 

Section 2.  All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.

R-12-2018-336             RESOLUTION CALLING FOR THE NEW JERSEY LEGISLATURE TO                          PASS LEGISLATION PERMITTING MUNICIPALITIES TO IMPOSE                              IMPACT FEES FOR INCREASED SCHOOL COSTS ON DEVELOPERS                                   OF NEW RESIDENTIAL UNITS.

            WHEREAS, New Jersey law prohibits municipalities from charging impact fees to offset the costs associated with increased demands on schools, leaving the financial burden to be borne by local taxpayers; and

WHEREAS, over the last several decades the Township of Monroe, like many municipalities has experienced residential development, due in large part to the excellent quality of life, geographic location, and superior public school system; and

WHEREAS, Monroe Township is required by the State to accommodate 850 new affordable units and several thousand market units as part of a Fair Share Settlement; and

            WHEREAS, this experience is occurring in municipalities across the state and demand for new school services increases; and

            WHEREAS, it is fair and reasonable to shift some of the financial effects of residential development on local public schools from the taxpayers to the developers whose projects clearly and directly create the need for additional funding;

            NOW, THEREFORE, BE IT RESOLVEDthat the Mayor and Council of the Township of Monroe urge the New Jersey Legislature to pass legislation permitting municipalities to enact ordinances imposing impact fees for necessary public school improvements and expansion on the developers who build the new housing in their communities.

BE IT FURTHER RESOLVEDthat copies of this Resolution be mailed to Senate President Stephen Sweeney, Senate Minority Leader Thomas Kean, Speaker Craig Coughlin, and Assembly Minority Leader John Bramnick.

R-12-2018-337             RESOLUTION AUTHORIZING CANCELLATION OF TAX REFUNDS

                                    AND/OR DELINQUENCIES OF LESS THAN THREE ($3.00) DOLLARS.

            WHEREAS, the Township Council of the Township of Monroe, finds and declares that N.J.S.A. 40:5-17-1 empowers authorized municipal employees to process the cancellation of tax refunds and/or delinquencies of less than Three ($3.00) Dollars; and

           WHEREAS, the Monroe Township Council further finds and declares that the Municipal Tax Collector is qualified to process the cancellation of tax refunds and/or delinquencies of less than Three ($3.00) Dollars; and

            WHEREAS, the Monroe Township Council further finds and declares that it is in the best interests of the citizens of the Township of Monroe for the Municipal Tax Collector to be authorized to process the cancellation of tax credits and/or delinquencies of less than Three ($3.00) Dollars in accordance with N.J.S.A. 40A:5-17-1.

            NOW, THEREFORE BE IT RESOLVEDby the Township Council of the Township of Monroe that the Municipal Tax Collector is hereby authorized to process the cancellation of tax refunds or delinquencies of less than Three ($3.00) Dollars during the Calendar Year 2018 in accordance with N.J.S.A. 40A:5-17-1.

R-12-2018-338             RESOLUTION AUTHORIZING REFUND OF THIRD PARTY TAX LIEN                         PREMIUMS.

          WHEREAS, Premiums have been paid for various properties for the purchase of Tax Lien Certificates for properties listed on the Tax Map of the Township of Monroe, in the amount of Seventy-nine thousand seven hundred dollars and no cents ($79,700.00),

             WHEREAS, pursuant to N.J.S.A. 54: 5-33 said premiums must be returned to the purchasers upon redemption:

             WHEREAS,The Tax Lien Certificates as outlined on Schedule A have been redeemed:

           

            NOW, THEREFORE, BE IT RESOLVEDby the Township of Monroe in the County of Middlesex in the State of New Jersey that the Township’s Certified Municipal Financial Officer is hereby authorized and directed to draw a check from the Township’s Trust Account in the amount listed on Schedule A and forward same to the Tax Collector for distribution to the purchasers.

R-12-2018-339             RESOLUTION AUTHORIZING REFUND OF TAX OVERPAYMENTS.

           

                          WHEREAS, the Tax Collector for the Township of Monroe has recommended this Council’s approval to make refunds for tax overpayments in the amount of Twenty-six thousand eight hundred ninety-seven dollars and seventy one cents ($26,647.71) for the amounts described on Schedule A and attached hereto;

            WHEREAS,good cause has been shown

                      NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe in the County of Middlesex and State of New Jersey that the Township’s Certified Municipal Finance Officer be and is hereby directed to draw a check from the General Account refunding the Tax overpayments described above to be distributed as set forth on the attached Schedule A:

R-12-2018-340             RESOLUTION AMENDING RESOLUTION NO. R-12-2018-326                                        “AUTHORIZING REFUND OF TAX OVERPAYMENTS”.

                          WHEREAS, Resolution No. R-12-2018-326 adopted by the Monroe Township Council at the December 3, 2018 regular meeting authorized the Tax Collector for the Township of Monroe to make refunds for tax overpayments in the amount of One hundred thirteen thousand four hundred eighty-three dollars and eight cents ($113,483.08) for the amounts described on Schedule A and attached hereto;

                          WHEREAS,the Tax Collector was previously authorized in Resolution No. R-11-2018-291 to refund El @ Monroe $70,308.00 for Block 54, Lot 4 QFarm; and

                          WHEREAS, due to this duplication, Resolution No. R-12-2018-326 must be amended to authorize the Tax Collector of the Township of Monroe to make refunds for tax overpayments in the amount of Forty three thousand one hundred seventy five dollars and eight cents ($43,175.08).

                            NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe in the County of Middlesex and State of New Jersey Resolution No. R-12-2018-326 is hereby amended to authorize refunds of tax overpayments in the amount of Forty three thousand one hundred seventy five dollars and eight cents ($43,175.08).

            WHEREAS, the Township of Monroe, in the County of Middlesex, wishes to purchase one (1) Vehicle from Beyer of Morristown under the Educational Services Commission of NJ Cooperative#65MCESCCPS-ECSNJ 17/18-21for the Monroe Township Construction Department as hereinbelow set forth:

R-12-2018-342             RESOLUTION CONCERNING HEALTH BENEFIT PLANS FOR                                      RETIRED NON-UNION EMPLOYEES.

WHEREAS,the Township of Monroe, after a comprehensive reexamination, has made certain changes in Medical and Prescription coverages for non- union employees, and,

WHEREAS,the Township Council desires to clarify the benefits available for non-union employees who are at or near their retirement date.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Monroe that any non-union employee who retires on or before July 1, 2019, and qualifies for retiree health benefits, shall receive Medical  and Prescription benefits in accordance with those plans in effect on December 31, 2018

            SO RESOLVED, as aforesaid.

R-12-2018-343             RESOLUTION CONCERNING THE CONTRIBUTIONS TO HEALTH                              BENEFITS FOR RETIRED EMPLOYEES.

WHEREAS,P.L. 2011, Chapter 78 provided for the contribution to health benefits by all public employees and certain retired employees; and,

WHEREAS, in order to provide parity amongst employees, the Township of Monroe desires to establish the effective date for Chapter 78 contribution by retired non-union employees.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Monroe that any non-union employee who does not have 20 years of Pension Service Credits in the Pubic Employee Retirement System (PERS) as of December 31. 2014 shall make, in retirement, contributions to retiree health benefits as set forth in P.L.2011, Chapter 78.

            SO RESOLVED, as aforesaid.

R-12-2018-345             RESOLUTION AUTHORIZING THE PAYMENT OF ADDITIONAL FEES                       TO SHAIN SCHAFFER P.C. TO REPRESENT THE TOWNSHIP IN                           ACQUIRING REAL PROPERTY DESIGNATED AS BLOCK 25, LOTS                             14.1 AND 16.   ($9,000.00)

WHEREAS, the Township Council of the Township of Monroe (“Township”) has determined that it is in the public interest to acquire real property designated as Block 25, Lots 14.1 and 16, on the official tax map of the Township of Monroe, also known as 254 Applegarth Road (the “Property”); and

            WHEREAS, Shain Schaffer PC possesses the expertise necessary to represent the Township in its efforts to acquire the Property by purchase or, if necessary, through condemnation proceedings; and

WHEREAS, the Township Council has determined that it would be appropriate to authorize Shain Schaffer PC to take any and all legal action reasonable and necessary to acquire the Property; and

            WHEREAS,the Township Council, by Resolution No. R-1-2018-041 acknowledged the status of “extraordinary litigation” and provided its advice and consent to the legal services of Shain Schaffer, P.C. pending further authorization from the Township Council; and

            WHEREAS, Shain Schaffer, P.C. has incurred legal fees in excess of the budgeted amount and has requested authorization for an additional $9,000.; and

WHEREAS,the council has reviewed the request and believes that an additional authorization in the amount of $9,000. to acquire Block 25, Lot 14.1 and 16, 254 Applegarth Road, is reasonable at this time.

            WHEREAS,the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available in the Township budget, as evidenced by Certificate No. C-1800011,

a copy of which is annexed hereto as Exhibit “A”; and

            NOW THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey, it has hereby rendered its advice and authorizes Shain Schaffer be paid additional fees for legal services rendered in connection with the acquisition of 254 Applegarth Road in the amount of $9,000.

R-12-2018-346             RESOLUTION AUTHORIZING THE PAYMENT OF ADDITIONAL FEES                       TO SHAIN SCHAFFER, P.C. TO HANDLE THE MATTER OF EL AT                                     MONROE, LLC. v. THE TOWNSHIP OF MONROE AS                                                      EXTRAORDINARY LITIGATION. (Additional $20,000)

WHEREAS,a lawsuit has been filed against the Township of Monroe in the Superior Court of New Jersey, Middlesex County, Docket No. MID-L-001406-18, entitled EL at Monroe, LLC v. The Township of Monroe,disputing certain Monroe Township Utility Department fees and costs associated with Plaintiff’s development;

            WHEREAS, Shain Schaffer PC, possesses the expertise necessary to handle this litigation for the Township; and

            WHEREAS, this case is extraordinary in complexity and scope; and

            WHEREAS, acknowledgment of the status of “extraordinary litigation” requires the advice and consent of the Township Council; and

WHEREAS,the Township Council, by Resolution No. R-5-2018-152 acknowledged the status of “extraordinary litigation” and provided its advice and consent to the legal services of Shain Schaffer, P.C. pending further authorization from the Township Council; and

WHEREAS, Shain Schaffer, P.C. has incurred legal fees in excess of the budgeted amount and has requested authorization for an additional $20,000.; and

WHEREAS,the council has reviewed the request and believes that an additional authorization in the amount of $20,000. to handle the matter El at Monroe LLC. v. The Township of Monroe, is reasonable at this time.

            WHEREAS, theTownship’sCertified Municipal Finance Officer has certified the availability of funds in Certificate NoM-180029, copyof which is annexed hereto as Exhibit “A”;

            NOW THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey, it has hereby rendered its advice and authorizes Shain Schaffer be paid additional fees for legal services rendered in connection with the matter El at Monroe LLC. v. The Township of Monroe in the amount of $20,000.

R-12-2018-347             RESOLUTION AUTHORIZING MODIFICATION TO A PROFESSIONAL                       SERVICES CONTRACT WITH CENTER STATE ENGINEERING                            ASSOCIATES, INC. FOR 2018 MUNICIPAL ENGINEERING SERVICES.                       (Additional $18,000)

            WHEREAS, pursuant to Resolution No. R-1-2018-037, adopted by the Monroe Township Council at its meeting held on January 8, 2018, authorizing a Professional Service Contract with Center State Engineering Associates, Inc. for Municipal Engineering Services within the Township of Monroe for calendar year 2018; and

            WHEREAS,the Professional Engineering Services contract was in the original amount of $226,000.00; and

WHEREAS, Center State Engineering Associates, Inc. has incurred engineering fees in excess of the budgeted amount and has requested authorization for an additional $18,000.; and

            WHEREAS, the Township Council has reviewed the request and has found same to be reasonable; and

            WHEREAS, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No. C-1800005, a copy of which is attached hereto; 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey authorization is hereby given to modify said contract in the amount of Eighteen Thousand Dollars ($18,000.00);

R-12-2018-349             RESOLUTION AUTHORIZING AWARD OF CONTRACT TO STALKER                        RADAR, APPLIED CONCEPTS, INC. FOR THE PURCHASE OF                                            STALKER RADIO UNITS FOR THE MONROE TOWNSHIP POLICE                              DEPARTMENT. ($37,793.)

WHEREAS, on October 17, 2018, the Monroe Township Police Department solicited proposals for (12) Stalker DSR 2X Radar Units with front and rear antennas; and

WHEREAS, the three (3) competitive quotes received are as herein below set forth:

TMDE Calibration Labs, Inc. –Richmond, ME  - $42,580.00

            WHEREAS,the Township QPA has reviewed the three (3) proposals received and, by copy of letter dated December 10, 2018, recommends the award of contract to Stalker Radar, Applied Concepts Inc., 855 E. Collins Boulevard, Richardson, TX 75081, in the amount of $37,793.00; and

WHEREAS, the award of contract is subject to the compliance with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C.17:27 et seq.; any contractor, subcontractor of business firm agree and guarantee to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the affirmative action plan approved under the terms established in the above-cited regulations;

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex that it has rendered its advice and hereby consents to the award of contract, to Stalker Radar, Applied Concepts Inc.for (12) twelve Stalker DSR 2X Radar Units with front and rear antennas for a total contract price of $37,793.00; and

WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available, as evidenced by Certificate No. C-1800077, a copy of which is attached hereto; and

            BE IT FURTHER RESOLVED that the Certified Municipal Finance Officer is hereby authorized and directed to pay Stalker Radar, Applied Concepts Inc.in accordance with the contract entered into between the parties; and

BE IT FURTHER RESOLVED that the contract is awarded with the stipulation that Stalker Radar, Applied Concepts Inc. shall comply with Affirmative Action Regulations, including revising their contracts as necessary to add mandatory affirmative action language, and submitting either a letter of federal approval or a certificate of employee information report, or a completed form AA302 at the time the signed contracts are returned to the Township of Monroe, or seven (7) days thereafter, or risk being declared non-responsive and forfeiting the award.

R-12-2018-350             RESOLUTION AUTHORIZING THE AWARD OF BID TO K & A                                                 EXCAVATING CO. INC., FOR MONROE TOWNSHIP OUTSIDE SNOW                                & ICE REMOVAL.  (as needed basis – per fee schedule)

            WHEREAS, on December 13, 2018 one (1) sealed bid was received by Monroe Township for the Monroe Township Outside Snow & Ice Removal; and

            WHEREAS, the Township Business Administrator recommends in a letter dated December 17, 2018, a copy of which is attached hereto as Exhibit "A", that a one (1) year contract with the option to renew for two (2) additional one (1) year contracts, be awarded to K & A Excavating Co. Inc., at the unit pricing provided on the attached Proposal Form and Price Schedule; and

            WHEREAS, the Township Council has reviewed and hereby consents to the recommendations made by the Township Business Administrator; and

            WHEREAS, the Certified Municipal Finance Officer has determined that sufficient funds are available, as set forth in Certificate No. C-1800078, a copy of which is attached hereto as Exhibit "B"; and

            WHEREAS,no contract that is subject to the requirements of Article 3 of the Affirmative Action Regulations pursuant to Public Law 1975, Chapter 127 (N.J.A.C.17:27-1 et seq.) shall be awarded by the Township of Monroe, nor shall any monies be paid thereunder, to any contractor, subcontractor of business firm that has not agreed and guaranteed to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the affirmative action plan approved under the terms established in the above-cited regulations;

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, that it has rendered its advice and hereby consents to the award of a one (1) year contract with the option to extend for an additional year for Monroe Township Outside Snow & Ice Removal; and

            BE IT FURTHER RESOLVED,that the Mayor and Township Clerk are hereby authorized and directed to execute a one (1) year contract with K & A Excavating Co. Inc., for Monroe Township for Outside Snow & Ice Removal, with said contract becoming effective January 1, 2019 and expiring December 31, 2019; and

            BE IT FURTHER RESOLVED,that the Certified Municipal Finance Officer is hereby authorized and directed to pay K & A Excavating Co. Inc., 198 Major Road, Monmouth Junction, NJ 08852,in accordance with the contract entered into between the parties; and

            BE IT FURTHER RESOLVED, that the contract is awarded with the stipulation that K & A Excavating Co.             WHEREAS, on December 13, 2018 three (3) sealed bids were received by Monroe Township for Monroe Township HVAC & ATC Maintenance and Repairs; and

            WHEREAS, the Township Business Administrator recommends in a letter dated December 17, 2018, a copy of which is attached hereto as Exhibit "A", that a two (2) year contract with the option to renew for one (1) additional one (1) year contract, be awarded to T.L.P. Climate Control Systems, Inc., at the unit pricing provided on the attached Proposal Form and Price Schedule; and

            WHEREAS, the Township Council has reviewed and hereby consents to the recommendations made by the Township Business Administrator, a copy of which is attached hereto as Exhibit “A”; and

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, that it has rendered its advice and hereby consents to the award of a one (1) year contract with the option to extend for an additional year for Monroe Township Outside Snow & Ice Removal; and

            BE IT FURTHER RESOLVED,that the Mayor and Township Clerk are hereby authorized and directed to execute a one (1) year contract with T.L.P. Climate Control Systems, Inc., for Monroe Township for HVAC & ATC Maintenance and Repairs, with said contract becoming effective January 1, 2019 and expiring December 31, 2020; and

            BE IT FURTHER RESOLVED,that the Certified Municipal Finance Officer is hereby authorized and directed to pay T.L.P. Climate Control Systems, Inc. 400 Rike Drive, Suite A, Millstone, NJ 08535in accordance with the contract entered into between the parties; and

            BE IT FURTHER RESOLVED, that the contract is awarded with the stipulation that T.L.P. Climate Control Systems, Inc.shall comply with Affirmative Action Regulations, including revising their contracts as necessary to add mandatory affirmative action language, and submitting a Certificate of Employee Information Report or a completed Form AA302 at the time the signed contracts are returned to the Township of Monroe, or seven (7) days thereafter, or risk being declared non-responsive and forfeiting the award.

R-12-2018-352             RESOLUTION AUTHORIZING THE BUSINESS ADMINISTRATOR TO                         PREPARE SPECIFICATIONS AND ADVERTISE FOR RECEIPT OF                                  BIDS FOR VARIOUS GOODS AND SERVICES.

R-12-2018-353             RESOLUTION AUTHORIZING REFUND OF HOMESTEAD REBATES.

          WHEREAS, the Tax Collector for the Township of Monroe has recommended Council approval to make refunds for homestead rebates in the amount of Sixty-nine thousand three hundred eight dollars and fifty-nine cents ($69,308.59) for the amounts described on Schedule A and attached hereto; and

             WHEREAS, good cause has been shown.

            NOW, THEREFORE, BE IT RESOLVEDby the Township of Monroe in the County of Middlesex in the State of New Jersey that the Township’s Certified Municipal Finance Officer is hereby authorized and directed to draw a check from the Township’s General Account to refund the tax overpayments described above, to be distributed as set forth on the attached Schedule A.

R-12-2018-356             RESOLUTION AUTHORIZING THE PURCHASE OF VEHICLES FOR                           THE MONROE TOWNSHIP DEPARTMENT OF PUBLIC WORKS                                  UNDER N.J. STATE CONTRACT. ($159,540)

            WHEREAS, the Township of Monroe, in the County of Middlesex, wishes to purchase two (2) Vehicles from Bucks County International, Inc. under New Jersey State Contract #79123for the Monroe Township Department of Public Works as hereinbelow set forth:

R-12-2018-358             RESOLUTION AUTHORIZING AWARD OF CONTRACT TO                                          KLENDZOID INC. FOR CONTRACT 484 “LIQUID ZINC                                                      PYROPHOSPHATE” BY THE MONROE TOWNSHIP UTILITY                                       DEPARTMENT (“M.T.U.D.”).    ($38,000)

            WHEREAS, on December 4, 2018 two (2) sealed bid were received, and publicly opened and read aloud, by the Monroe Township Utility Department Purchasing Agent for Contract 484, “Liquid Zinc Pyrophosphate”, required by the M.T.U.D.

            WHEREAS, the low bidder Klenzoid Inc. located at 912 Spring Mill Ave, Conshohocken PA 19428, submitted a bid that meets all requirements of the bid; and

            WHEREAS, the M.T.U.D. Purchasing Agent, after consultation with the M.T.U.D. Director has recommended in a letter dated December 5, 2018, a three (3) year contract be awarded to low bidder Klenzoid, Inc. based upon the unit pricing and estimated quantities contained within their bid documents estimated at $38,000 annually, a copy of which is attached hereto as Exhibit “B”; and

            WHEREAS,the Township Council has reviewed the recommendations made by the M.T.U.D. Purchasing Agent regarding said bid; and

            WHEREAS,pursuant to N.J.A.C. 5:30-5.4, the Chief Financial Officer has certified availability of funds in Certificate No. M-180038 copy of which is attached hereto as Exhibit "A"; and

           

            WHEREAS,pursuant to N.J.A.C. 5:30-5.5(d)(l)(ii), multi-year contracts entered into for periods in excess of twelve (12) months shall be certified and charged to the respective budgets in accordance with the time(s) at which the respective work or services are performed or liability for payment is otherwise incurred.  Accordingly, commitments and payments required in excess of the initial twelve (12) months are contingent upon necessary funds being appropriated in future budgets by a subsequent governing body; and

            WHEREAS,Klenzoid, Inc. has submitted all the required documents with their bid; and

WHEREAS,pursuant to Chapter 116 of the Monroe Township Code entitled, “Towing and Storing of Vehicles”, towing contractors are required to be licensed through the Office of the Township Clerk; and

WHEREAS,the aforementioned Ordinance mandates that towing contractors must file for renewal of their licenses on or before November 1stof each year; and

WHEREAS,all towing contractors have filed for renewal of their licenses for the 2019 license term; and

WHEREAS, the Township of Monroe has a need to acquire services related to the Medical Care of stray animals found within the Township of Monroe for Calendar Year 2019, as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.5; and

WHEREAS, the Township Business Administrator and QPA have determined and certified in writing that the Contract will be open-ended and based on unit pricing as outlined in the Contract, a copy of which is attached hereto as Exhibit “A”; and

WHEREAS, the anticipated term of this contract is one (1) year, effective January 1, 2019 and expiring December 31, 2019; and

WHEREAS, NorthStar VETS, 315 Robbinsville-Allentown Rd., Robbinsville, NJ 08691 has submitted a Contract indicating they will provide the referenced services; and

WHEREAS, NorthStar VETS has completed and submitted a certification pursuant to N.J.S.A. 19:44A-20.8; and

            WHEREAS, pursuant to N.J.S.A. 40A:11-5 that Monroe Township and the Monroe Township Utility Department (“M.T.U.D.”) may procure a professional service without the necessity of advertising for bids pursuant to N.J.S.A. 40A:11-1 et seq.; and

            WHEREAS, Delta Dental of New Jersey, Inc., 1639 Route 10, Parsippany, NJ 07054 has prepared a proposal and schedule of rates and services which shall be the basis for payment for Dental Insurance; and

            WHEREAS, in accordance with the Local Public Contracts Law Regulations N.J.A.C. 5:34-1 et seq. the Township desires to retain Delta Dental of New Jersey, Inc. as the Dental provider, this Contract will be for a period of one year effective January 1, 2019 until December 31, 2019; and

            WHEREAS, said services provided by Delta Dental of New Jersey, Inc. would be subject to contracting requirements for Extraordinary Unspecified Services pursuant to N.J.A.C. 5:34-2.1 et seq. only if they exceed the threshold amount established by N.J.S.A. 40A:11-3; and

            WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available in the Township budget in the amount of $307,000.00, as evidenced by Certificate No. C-1800084, a copy of which is attached hereto as Exhibit ”A”; and

                                    (General Legal not to exceed $286,560 annually; Township Attorney not to exceed $27,347 annually)

WHEREAS,on November 24, 2018, in accordance with N.J.S.A.40A:11-1 et seq., the Township of Monroe, in the County of Middlesex, has solicited resumes’ setting forth qualifications for ID # 19-1 – TOWNSHIP ATTORNEY, for various legal professional services required by the Township for Calendar Year 2019; and

           

WHEREAS,Marguerite M. Schaffer, Esq. and Shain Schaffer P.C. and other attorneys within the firm, satisfy the established criteria for said professional legal services; and

            WHEREAS, the Township Business Administrator, by copy of letter dated December 11, 2018, has recommended Council approval and award of a professional service contract to Marguerite M. Schaffer, Esq. and Shain Schaffer, P.C. in accordance with the hourly rates and fees outlined within the attached Agreement; and

            WHEREAS, the Director of Law, Township Attorney shall be paid $27,347.00 annually; and

            WHEREAS,the General legal fees shall not exceed $23,880.00 per month;and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No.C-1800101, a copy of which is attached hereto as Exhibit "A";

           

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

            (1)        The Mayor and Township Clerk are hereby authorized to enter into a one (1) year professional service contract with Marguerite M. Schaffer, Esq., with the firm of Shain Schaffer, P.C. in accordance with the proposal attached hereto as Exhibit “B” commencing January 1, 2019; 

            (2)        The Certified Municipal Finance Officer is hereby authorized and directed to pay invoices for services rendered by Marguerite M. Schaffer, Esq., with the firm of Shain Schaffer, P.C., in accordance with the attached Agreement;

            (3)        The contract is awarded without competitive bidding as a “professional service” in accordance with N.J.S.A.40A:11-5(1)(a) of the Local Public Contracts Law because the contract is for a service performed by persons authorized by law to practice a recognized profession that is regulated by law;

            (4)        This contract is awarded with the stipulation that Marguerite M. Schaffer, Esq., with the firm of Shain Schaffer, P.C., shall include mandatory Affirmative Action language pursuant to N.J.S.A. 10:5-31 and shall submit to the Township of Monroe any appropriate Affirmative Action documents within the time period prescribed by law.

R-12-2018-366             RESOLUTION AUTHORIZING AWARD OF CONTRACT TO SHAIN SCHAFFER, P.C. FOR TOWNSHIP TAX APPEAL LEGAL SERVICES WITHIN THE TOWNSHIP OF MONROE FOR CALENDAR YEAR 2019.

                                    (Not to exceed $195,000)

WHEREAS,on November 24, 2018, in accordance with N.J.S.A.40A:11-1 et seq., the Township of Monroe, in the County of Middlesex, has solicited resumes’ setting forth qualifications for ID # 19-3 – TAX APPEAL ATTORNEY, for various tax appeal legal professional services required by the Township for Calendar Year 2019; and

           

WHEREAS,Shain Schaffer P.C. satisfies the established criteria for said professional legal services; and

            WHEREAS, the Township Business Administrator, by copy of letter dated December 11, 2018, has recommended Council approval and award of a professional service contract to Shain Schaffer, P.C. in accordance with the hourly rates and fees outlined within the attached Agreement; and

            WHEREAS,legal services shall be billed at the rate of $199.00 per hour not to exceed $195,000.00and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No.C-1800085, a copy of which is attached hereto as Exhibit "A";

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

            (1)        The Mayor and Township Clerk are hereby authorized to enter into a one (1) year professional service contract with Shain Schaffer, P.C. in accordance with the proposal attached hereto as Exhibit “B” commencing January 1, 2019; 

            (2)        The Certified Municipal Finance Officer is hereby authorized and directed to pay invoices for services rendered by Shain Schaffer, P.C., in accordance with the attached Agreement;

WHEREAS,on November 24, 2018, in accordance with N.J.S.A.40A:11-1 et seq., the Township of Monroe, in the County of Middlesex, has solicited resumes’ setting forth qualifications for

ID # 19-20 – TAX MAP MAINTENANCE, for professional updating of the Township’s tax maps required by the Township for Calendar Year 2019; and

            WHEREAS, The Firm of Center State Engineering Associates, Inc. possesses the technical expertise required for such an engagement; and

            WHEREAS, the Township Business Administrator, by copy of letter dated December 11, 2018, has recommended Council approval and award of a professional service contract to Center State Engineering Associates, Inc. in accordance with the hourly rates and fees outlined within the attached Agreement; and

            WHEREAS, the fee for such services shall not exceed $63,000.00; and

            WHEREAS, the Certified Municipal Finance Officer has determined that sufficient funds are available, as evidenced by Certificate No.C-1800096, a copy of which is attached hereto as Exhibit “B”; and

            NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

            WHEREAS, the Township of Monroe has a need to acquire medical, educational and administrative services related to the Township's compliance with Federal laws and regulations in the development of its Substance and Alcohol Misuse policy and testing, under the provisions of N.J.S.A. 19:44A-20.5; and

            WHEREAS, Ambassador Medical Services, Inc.has submitted a proposal indicating the fees for such services shall be in accordance with the attached fee schedule and payment for such services shall be made on an “as needed” basis; and

WHEREAS, the fee for drug collection as-needed services shall be $65.00 per collection; and

            WHEREAS, the term of this contract is one (1) year; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township’s Certified Municipal Finance Officer has certified the availability of funds in Certificate No.C-1800099,a copy of which is attached hereto as Exhibit “A”; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Utility Finance Officer has certified the availability of funds in Certificate No.                  , a copy of which is attached hereto as Exhibit “B”; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township’s Certified Municipal Finance Officer has certified the availability of funds in Certificate No. C-1800100, a copy of which is attached hereto as Exhibit “A”; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township’s Certified Municipal Finance Officer has certified the availability of funds for the Township Utility Dept. in Certificate No.               copy of which is attached hereto as Exhibit “B”;

            WHEREAS, the Township of Monroe seeks professional engineering services in connection with the preparation of a project design, preparation of plans and specifications, contract preparation, contract administration and construction inspection for the following Capital Project:

2018-2019 Daniel Road and 10thStreet Pedestrian and Roadway Improvements

            WHEREAS, CME Associatespossesses the technical expertise required to perform professional engineering, surveying and planning services regarding this project; and

            WHEREAS, the fees for such services will not exceed Seventy Four thousand Eight Hundred Seventy Two dollars ($74,872.00); and

            WHEREAS, no agreement that is subject to the requirements of Article III of the Affirmative Action Regulations pursuant to P.L. 1975, Chapter 127 (N.J.S.A.17:27-1 etseq.) shall be awarded by the Township of Monroe, nor shall any monies be paid thereunder, to any contractor, subcontractor or business firm that has not agreed and guaranteed to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the Affirmative Action approved under the terms established in the above-cited regulations.

R-12-2018-354            RESOLUTION AUTHORIZING THE EXECUTION OF A                                                              SHARED SERVICE AGREEMENT BETWEEN MONROE                                                                       TOWNSHIP AND MONROE FIRE DISTRICT #3 PROVIDING                                                             FOR USE OF A PORTION OF THEIR NEW FACILITY FOR                                                         MONROE TOWNSHIP EMERGENCY SERVICES. ($65,000)

WHEREAS, the Township of Monroe and Monroe Fire District #3 wish to enter into a shared service agreement to permit the exclusive use of approximately 2,000 square feet of space in the new proposed fire house for emergency services personnel and equipment; and

WHEREAS, the Township agrees to pay an annual sum of Sixty-five thousand dollars ($65,000.), payable in equal monthly installments, with a 2% increase at the conclusion of the 5th and 7thyears and at the commencement of the 9thyear of this agreement; and

            WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available in the Township budget, as evidenced by Certificate No. C-1800081,

a copy of which is annexed hereto as Exhibit “A”; and

WHEREAS, the initial term of this agreement shall be ten (10) years and shall commence on the date the Township occupies the space; and

WHEREAS,the Township shall have the option to renew this agreement for an additional ten-year term, upon terms to be agreed to by the Parties; and

WHEREAS, the proposed Agreement has been reviewed by the law firm of Shain Schaffer, P.C., on behalf of the Township, which has advised that said Agreement is acceptable;

                       

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, and State of New Jersey, that the Mayor and Township Clerk are hereby authorized to execute the Shared Service Agreement with Monroe Fire District #3, copies of which are attached hereto and made a part hereof.

R-12-2018-355             RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE AN AGREEMENT TO TRANSFER AN UNDERGROUND WATER TANK TO FIRE DISTRICT NO.1.

            WHEREAS, The Township of Monroe (“Township”) recently removed an underground Water Tank located at Well #8a (“Water Tank”), that is no longer used or useful to the Monroe Township Utilities Department (“MTUD”); and,

            WHEREAS, Fire District #1 has requested that the Township transfer ownership of the Water Tank to it for its own purposes; and

            WHEREAS, the Township wishes to honor the request to transfer ownership of the Water Tank to Fire District #1 for nominal consideration, pursuant to a transfer agreement; and

            WHEREAS, Fire District #1 will take the Water Tank AS IS, and agrees to conduct any environmental testing of the Water Tank at its own cost and expense; and

           

            WHEREAS, Fire District #1 agrees to indemnify, defend and hold the Township, its employees, managers, elected officials, and agents harmless from any and all liability on account of any loss, damage, injury to person or property or loss of life and from all liens, claims, and demands of any kind or nature relating to or arising out of the transfer, transport and use of the Water Tank, and for any and all costs, fees, expenses, including counsel fees, incurred as a result of any such loss or claim; and

            WHEREAS, the transfer is valued at $1.00 (One Dollar) as good and valuable consideration; and

            WHEREAS, immediately upon execution of the transfer agreement, Fire District #1 shall have the right to take possession of the Water Tank and to remove the Water Tank from MTUD premises to its own premises at its own risk and cost; and

            WHEREAS, upon taking possession of the Water Tank, Fire district #1 shall bear all risk of loss regarding its possession, transport and use; 

NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, as follows:

  1. The Township Council hereby authorizes and directs the Mayor and Township Clerk to execute the transfer agreement in substantially the form attached hereto as Exhibit A.

R-12-2018-369             RESOLUTION AUTHORIZING THE SELECTION OF QUALIFIED FIRMS FOR CONFLICT OR ALTERNATE ENGINEER FOR 2019 MUNICIPAL ENGINEERING SERVICES WITHIN THE TOWNSHIP OF MONROE AND AUTHORIZING THE AWARD OF CONTRACTS ON AN AS NEEDED BASIS.

            WHEREAS,the Township of Monroe desires to create a pool of qualified professionals to serve as Township Conflict or Alternate Engineer for the Township as the need arises, using a fair and open process pursuant to the provisions of P.L. 2004, c19 (N.J.S.A. 19:44A-20.5 et seq; and

WHEREAS,the Township of Monroe (the “Township”) received and reviewed statements of qualifications from engineering firms determined to pre-qualify those firms that possess the professional and administrative capabilities to provide such services and that they offer the terms and conditions determined by the Township to provide the greatest benefit to the taxpayers of the Township, so that the Township may engage any one or more of the Qualified Firms when the need for such services arises; and

            WHEREAS,such services are to be performed and rendered by a person or persons licensed and authorized to practice in the State of New Jersey and accordingly constitute professional series exempt from public bidding pursuant to the Local Public Contracts law, specifically N.J.S.A. 40A:11-5(1)(a); and

            WHEREAS, certification of available funds shall be made by the Chief Financial Officer at the time that services, if any, are requested from the qualified professional; and

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, that the following qualified firms are hereby approved to provide Conflict or Alternate Engineering Services:

  • The Mayor and Township Clerk are hereby authorized and directed to execute contracts by and between the Township and the Qualified Firms, which contracts shall set forth the terms and conditions of, among other things, payment for Services at such time as the Firms are called upon by the Township to render services; and
  • That the Contracts shall be awarded without competitive bidding as professional services in accordance with Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a); and
  • That a copy of this resolution and the Contracts upon the execution shall be placed on file with the Municipal Clerk; and
  • That a notice in accordance with the Local Public Contracts Law shall be published in a local newspaper within (10) days of passage of this resolution.

R-12-2018-377                         RESOLUTION AUTHORIZING AWARD OF A CONTRACT

                                                TOLOU RAINONE, WITH THE FIRM OF RAINONE, COUGHLIN, MINCHELLO AS SPECIAL COUNSEL / ALTERNATE /CONFLICT ATTORNEY WITHIN THE TOWNSHIP OF MONROE AND THE TOWNSHIP UTILITY DEPARTMENT FOR CALENDAR YEAR 2019.

                                                (Not to exceed Township - $20,000 and MTUD - $20,000)

WHEREAS,on November 24, 2018, in accordance with N.J.S.A.40A:11-1 et seq., the Township of Monroe, in the County of Middlesex, has solicited resumes’ setting forth qualifications for

ID # 19-2 – TOWNSHIP SPECIAL COUNSEL/CONFLICT/ALTERNATE ATTORNEY, for various legal professional services required by the Township and the Township Utility Department (“M.T.U.D”) for Calendar Year 2019; and

WHEREAS,Lou Rainone and Rainone, Coughlin, Minchello P.C. and other attorneys within the firm, satisfy the established criteria for said professional legal services; and

            WHEREAS, the Township Business Administrator, by copy of letter dated December 11, 2018, has recommended Council approval and award of a professional service contract to Lou Rainone and Rainone, Coughlin, Minchello P.C. in accordance with the hourly rates and fees outlined within the attached Agreement; and

           

            WHEREAS,the hourly rate shall be $199.00/hour; not to exceed $20,000.for special conflict counsel as may be assigned by the Township; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No.C-1800094, a copy of which is attached hereto as Exhibit "A";

WHEREAS,the hourly rate shall be $199.00/hour; not to exceed $20,000.for special counsel for the utility department as assigned; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Certified Municipal Finance Officer has certified the availability of funds, for the Utility Department, in Certificate No. M-190002, a copy of which is attached hereto as Exhibit “B”;

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

            (1)        The Mayor and Township Clerk are hereby authorized to enter into a one (1) one year professional service contract with Lou Rainone from the firm Rainone, Coughlin, Minchello P.C.., 1 Woodbridge Center, Suite 515, Woodbridge Twp., N.J.  07095, commencing January 1, 2019; 

            (2)        The Certified Municipal Finance Officer is hereby authorized and directed to pay invoices for services rendered by Lou Rainone with the firm Rainone, Coughlin, Minchello P.C, in accordance with the attached Agreement;

            (3)        The contract is awarded without competitive bidding as a “professional service” in accordance with N.J.S.A.40A:11-5(1)(a) of the Local Public Contracts Law because the contract is for a service performed by persons authorized by law to practice a recognized profession that is regulated by law;

            (4)        This contract is awarded with the stipulation that Lou Rainone with the firm Rainone, Coughlin, Minchello P.C, shall include mandatory Affirmative Action language pursuant to N.J.S.A. 10:5-31, and shall submit to the Township of Monroe any appropriate Affirmative Action documents within the time period prescribed by law.

            (5)        A notice of this action shall be printed once in the Home News Tribune.

            SO RESOLVED, as aforesaid.

R-12-2018-378             RESOLUTION AUTHORIZING AWARD OF CONTRACT TO LOU RAINONE WITH THE FRIM OF RAINONE, COUGHLIN, MINCHELLO AS LABOR ATTORNEY FOR GENERAL EMPLOYMENT LAW WITHIN THE TOWNSHIP OF MONROE FOR CALENDAR YEAR 2019.

                                    (Not to exceed $45,000)

WHEREAS,on November 24, 2018, in accordance with N.J.S.A.40A:11-1 et seq., the Township of Monroe, in the County of Middlesex, has solicited resumes’ setting forth qualifications for ID # 19-8 - LABOR ATTORNEYfor various general employment law services required by the Township for Calendar Year 2019; and

WHEREAS,Lou Rainone and Rainone, Coughlin, Minchello P.C. and other attorneys within the firm, satisfy the established criteria for said professional legal services; and

            WHEREAS, the Township Business Administrator, by copy of letter dated December 11, 2018, has recommended Council approval and award of a professional service contract to Lou Rainone and Rainone, Coughlin, Minchello P.C. in accordance with the hourly rates and fees outlined within the attached Agreement; and

           

            WHEREAS,the hourly rate shall be $199.00/hour; not to exceed $45,000.; and

            WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No.C-1800095, a copy of which is attached hereto as Exhibit "A";

           

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

Prakash Parab, 33 Dayna Dr. – Mr. Parab thanked the Mayor and Council for approving R-12-2018-

336 as he had written letters to the Assemblymen and Senator asking that a bill be drafted to impose

impact fees to developers. He asked that we lobby the Governor as well. Mr. Parab added that

affordable housing is important, especially for those who have been on waiting lists for years but it

should be debated at not solely the taxpayer’s responsibility. Council President Dalina commented

that this is a good way of keeping the process moving along and stated that we will continue the fight.

REPORTS:

Mayor’s Report– Reminded everyone that tomorrow is Grandparent’s Day which has been a great

program for the children and grandparents.
