COUNCIL MEETING MINUTES

REGULAR MEETING – MARCH 5, 2018

 

 

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for an Regular Meeting.

 

The Regular Meeting was Called to Order at 7:00 p.m. by Council President Stephen Dalina with a Salute to the Flag.

                                         

UPON ROLL CALLby the Township Clerk, Patricia Reid, the following members of Council were present: Councilman Baskin, Councilwoman Cohen, Councilman Charles Dipierro, Council Vice-President Elizabeth Schneider and Council President Stephen Dalina.

 

ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Alan M. Weinberg, Township Attorney Joel Shain, Engineer Mark Rasimowicz and Deputy Township Clerk Christine Robbins.

 

There were approximately forty (40) members of the Public present in the audience.

Mayor Tamburro called upon Zachary Biennas to present him with a Proclamation for Becker

Muscular Dystrophy Awareness Month. Mayor Tamburro read aloud the proclamation and noted

that Zachary will be participating in a walk to raise money and awareness for this terrible disease.

His team is called “Zach Attack”. Mayor Tamburro wished Zachary good luck in his walk and in

his endeavors to raise awareness.

 

 

Council President Dalina asked Renee Haider and the members of the Green Team to come

forward. Renee Haider introduced Randy Solomon from Sustainable New Jersey to present the

silver certification to the Mayor and Council. He stated that we are improving the quality of life

since Monroe Township is one of the leaders of this program, having the largest Green Fair in the

State, as well as, participating in the clean energy program, swapping out HVAC and improving

the Library parking lot lighting. He stated that Monroe Township is also the leader in Open

Space Preservation, as well as, having an active Environmental Commission and Shade Tree

Commission, also having one of the leading recycling programs in the State and for those reasons

and many more he would like to present the Silver Certification Plaque to Mayor Tamburro on

behalf of the Township.

 

Council President Dalina thanked the Green Team for all of their hard work.

an Ordinance of which the following is the title was moved on second reading for final passage:

O-2-2018-001ORDINANCE ESTABLISHING CHAPTER A132 OF THE MONROE TOWNSHIP CODE ENTITLED “CABLE TELEVISION ADVISORY COMMITTEE”.

 

ORDINANCEas follows: (O-2-2018-001)

 

            BE IT ORDAINED BY THE Township Council of the Township of Monroe, County of Middlesex, New Jersey, the Municipal Code of the Township of Monroe, Middlesex County, New Jersey is hereby amended creating Chapter A132 “Cable Television Advisory Committee” as follows: 

  1. Creation and Duties. There shall be created a Cable Television Advisory Committee (CTAC) whose purpose shall be to:

 

  1. Ascertain by means of survey or other investigations the needs of the community in relation to cable television, telephone, FIOS®, internet and any other related needs and desires and make recommendations to the Township Council of the       results of their findings in connection with these services provided by all companies    licensed to operate in the Township.

 

  1. Participate in the Franchise renewal process in conjunction with the Township Council;

 

  1. Monitor progress of all franchised providers to ensure compliance with franchise requirements and State regulations;

 

  1. Compile and forward complaints to the Office of Cable Television or applicable office   as per N.J.S.A. 48:5A-1.

 

  1. Membership.
  2. The Mayor, with the advice and consent of the Township Council, shall appoint themembers of the CTAC for a term of one year expiring on December 31 of each     year. The CTAC shall consist of nine members as follows:
  3. One representative of the Board of Education.

 

  1. One representative of the Township Library

 

  1. One representative of the Mayor Senior Advisory Committee

 

  1. One Township staff representative

 

  1. Four members of the general public

 

  1. One member of the Township Council who shall serve as Chairperson.

 

  1. In addition, the Mayor shall appoint a Vice Chairperson from the appointed members and a Secretary.
  2. The Chairperson shall establish a meeting schedule which shall be open to the public.
  3. All members of the Committee shall each have one equal vote on all policy decisions.

 

SECTION 2.  All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance be and the same are hereby repealed to the extent of such inconsistency.

 

SECTION 3.  If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

 

SECTION 4.  This Ordinance shall take effect twenty days after final passage, adoption and publication according to law.

PRICES AND RENT LEVELS FOR AFFORDABLE HOUSING.

 

ORDINANCEas follows: (O-2-2018-002)

 

            WHEREAS, the Township’s Affordable Housing Ordinance contemplates the establishment of income limits, resale prices and rent levels by COAH or a successor entity; and

 

            WHEREAS, COAH has not published income limits or rent increases since 2014 and no successor entity has been approved by the Court; and

 

            WHEREAS, in the absence of COAH published limits the Township must annually update its income limits and rent increases by applying COAH’s established process to the median income determined by HUD for the ensuing fiscal year;

 

NOW, THEREFORE, BE IT ORDAINED THAT CHAPTER 131 BE AMENDED AS FOLLOWS:

 

  • 131–2. Definitions

 

            The following terms, as used in this Ordinance, shall have the following meanings:

 

“Median Income” means the annual determination of median income as published by HUD.

 

“Regional Asset Limit” means the limit calculated pursuant to § 131-19A(3).

 

            Add the following defined term:

 

“Regional Income Limit” means the limit calculated pursuant to § 131-19A(1) and (2).

 

  • 131A–19. Establishment of Annual Income Limits, Resale Prices and Rent Levels

 

  1. Income limits for all units that are part of Monroe Township’s Housing Element and Fair Share Plan and for which income limits are not already established through a federal program exempted from the Uniform Housing Affordability controls pursuant to N.J.A.C. 5:80-26.1 shall be updated by Monroe Township annually with 60 days of the publication of determinations of median income by HUD as follows:

 

  1. Regional income limits shall be established for the region that Monroe Township is located within, based on the median income by household size, which shall be established by a regional weighted average of the uncapped Section 8 income limits published by HUD. To compute this regional income limit, the HUD determination of median county income for a family of four is multiplied by the estimated households within the county according to the most recent decennial Census. The resulting product for each county within the housing region is summed.  The sum is divided by the estimated total households from the most recent decennial Census in Monroe Township’s housing region.  This quotient represents the regional weighted average of median income for a household of four.  The income limit for a moderate-income unit for a household of four shall be 80 percent of the regional weighted average median income for a family of four.  The income limit for a low-income unit for a household of four shall be 50 percent of the HUD determination of the regional weighted aver median income for a family of four.  The income for a very low-income unit for a household of four shall be 30 percent of the regional weighted average median income for a family of four.  These income limits shall be adjusted by household size based on multipliers used by HUD to adjust median income by household size. In no event shall the income limits be less than those for the previous year.

 

  1. The income limits are the result of applying the percentages set forth in paragraph (1) above to HUD’s determination of median income for FY 2016, and shall be utilized until Monroe Township updates the income limits after HUD has published revised determinations of median income for the next fiscal year.

 

  1. The Regional Asset Limited used in determining an applicant’s eligibility for affordable housing pursuant to N.J.A.C. 5:80-26.16(b)3 shall be calculated by Monroe Township annually by taking the percentage increase of the income limits calculated pursuant to paragraph (1) above over the previous year’s income limits, and applying the same percentage increase to the Regional Asset Limit from the prior year. In no event shall the Regional Asset Limit be less than that for the previous year.

 

  1. In establishing sale prices and rents of affordable housing units, the administrative agent shall follow the procedures set forth in UHAC, utilizing the regional income limits established pursuant to the process defined above.

 

  1. The resale prices of owner-occupied low- and moderate-income units may increase annually based on the percentage increase in the regional median income limit for each housing region determined pursuant to the process outlined above. In no event shall the maximum resale price established by the administrative agent be lower than the last recorded purchase price.

           

  1. The rent levels of very-low-, low- and moderate-income units may be increased annually based on the percentage increase in the Housing Consumer Price index for the Northeast Urban Area, upon its publication for the prior calendar year. This increase shall not exceed nine percent in any one year.  Rents for units constructed pursuant to low income housing tax credit regulations shall be indexed pursuant to the regulations governing low income housing tax credits.

 

            Section 2.       All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

 

Section 3.        If any section, subdivision, sentence, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

 

Section 4.        This Ordinance shall take effect upon final passage and publication as provided by law.

Establishment; Division head; appropriate authority; duties of the Chief of Police.There shall be a Division of Police, the head of which shall be the Chief of Police.  Pursuant to N.J.S.A. 40A:14-118, the Mayor is the appropriate authority.  The following titles and positions shall exist within the Police Department: One (1) Chief of Police, not to exceed One (1) Captain, not to exceed Four (4) Lieutenants, not to exceed Eleven (11) Sergeants and not to exceed Fifty-five (55) Patrol Officers.  The Chief of Police shall be directly responsible to the appropriate authority for the efficiency and routine day-to-day operations, and heshall, pursuant to policies established by the appropriate authority:

 

  • Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the force and its officers and personnel;

 

  • Have, exercise and discharge the functions, powers and duties of the force;
  • Prescribe the duties and assignments of all subordinates and other personnel;

 

  • Delegate such of hisauthority as he maydeemednecessary for the efficient operation of the force to be exercised under his the Chief’s direction and supervision; and

 

  • Report at least monthly to the appropriate authority in such form as shall be prescribed by such authority on the operation of the force during the preceding month, and make such other reports as may be requested by such authority.

            WHEREAS,the Township of Monroe operates a Senior Bus Program for the benefit of qualifying Monroe Township residents; and

 

            WHEREAS,the Township of Monroe, through a grant received from the New Jersey Department of Transportation, is a sub-receipt of grant money from the Federal Transit Administration utilized for the operation of the Senior Bus Program; and

 

 

            WHEREAS, to receive grant money from the Federal Transit Administration as a recipient or sub-recipient, the Township of Monroe is required to implement a program to ensure compliance with Title VI of the Civil Rights Act of 1964; and

 

            WHEREAS, The Township of Monroe operates its Senior Bus Program and services without regard to race, color, or national origin in accordance with Title VI of the Civil Rights Act of 1964; and

 

            WHEREAS,The Township of Monroe’s staff drafted a Title VI Program to ensure continued compliance with Title VI of the Civil Rights Act of 1964, which was subsequently reviewed by the New Jersey Department of Transportation and found to be fully compliant with federal requirements.

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the attached Title VI Program is hereby approved and adopted.

 

BE IT FURTHER RESOLVED, by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Mayor or his designee is authorized to execute such documents consistent with this Resolution and to take such other action on behalf of the Township of Monroe in furtherance of this Resolution.

                                    BOARD FOR THE PURCHASE OF A DEVELOPMENT

                                    EASEMENT ON BLOCK 20, LOTS 12.3 AND 14.3 “ESTATE OF

                                    ANTHONY ZIMBICKI SR.”.                                                                                                                    (Gravel Hill Road/Federal Road - 36.8 acres- Monroe Township’s 20%

WHEREAS,by copy of letter dated January 29, 2018, the Middlesex County Agricultural Development Board informed Monroe Township that it has received approval for farmland preservation funding for the purchase of a Farmland Preservation Easement on the property of the Estate of Anthony Zimbicki, Sr., consisting of approximately 36.8 acres on Block 20, Lot 12.3 and 14.3; and

 

WHEREAS,the State Agriculture Development Committee (“SADC”) provides between sixty and eighty percent of the funds to acquire a development easement on a farm; and

 

WHEREAS,for the balance of the easement purchase funds, Middlesex County will employ a modified cost-share formula based on the appraised value of the farm to determine the portion to be paid by the County and the portion to be paid by Monroe Township; and

 

WHEREAS,the Middlesex County Agriculture Development Board has requested confirmation from the Township that Monroe will cost-share its portion of the “Estate of Anthony Zimbicki, Sr”, determined by Middlesex County to be $5,400 per acre.  The final cost-share amount will be contingent upon the final acreage reported in the final survey of the property; and

                                  MAINTENANCE AGREEMENT WITH QUEUES ENFORTH

WHEREAS, the Township of Monroe, County of Middlesex, had purchased Q.E.D. Software for the Monroe Township Police Department; and

 

WHEREAS, the Township of Monroe wishes to enter into an annual Maintenance Agreement with Queues Enforth Development, Inc. (Q.E.D.); and

 

WHEREAS, N.J.S.A.40A:11-1(dd) authorizes the provision or performance of goods or services for the support or maintenance of proprietary computer hardware and software, except that this provision shall not be utilized to acquire or upgrade non-proprietary hardware or to acquire or update non-proprietary software; and

 

WHEREAS, the actual cost of the Software Maintenance Agreement for calendar year 2018 shall not exceed Thirty-Eight Thousand, Three Hundred Twenty-Eight dollars ($38,328.00); and

 

WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available, as set forth in Certificate No. C-1800023, a copy of which is attached hereto as Exhibit "A"; and

            WHEREAS,redemption has been made to the following Tax Title Lien #17-00055 for the property known as Block 84 Lot 16 assessed to Casey White; and

 

            WHEREAS,the Tax Collector has requested that the aforesaid Tax Sale Certificate now be cancelled of record;

 

            NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe in the County of Middlesex and State of New Jersey that the Mayor and Clerk are hereby authorized to execute the authorization for cancellation of record for the above Tax Sale Certificate: Tax Title Lien #17-00055 assessed to Casey White.

            WHEREAS, the HCD Citizens Advisory Committee has submitted to the Township Council for its review, the 2018 Project Proposal Applications for:

            WHEREAS, the Mayor of the Township of Monroe has requested that Shain Schaffer, P.C. defend the interests of the township and that these matters be treated as extraordinary litigation; and

 

            WHEREAS, acknowledgment of the status of “extraordinary litigation” requires the advice and consent of the Township Council; and

 

            WHEREAS,Shain Schaffer, P.C. will render legal services at a cost not to exceed $15,000.00pending further authorization from the Township Council; and

 

            WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available in the budget, as evidenced by Certificate No. C-1800024, a copy of which is annexed hereto as Exhibit “A”;

            WHEREAS, the Tax Collector for the Township of Monroe has recommended this Council’s approval to make refunds for tax overpayments in the amount of Forty-one thousand four hundred seventy-eight dollars and twenty-seven cents ($41,478.27) for the amounts described on Schedule A and attached hereto;

 

            WHEREAS,good cause has been shown

            WHEREAS, the Mayor of the Township of Monroe has requested that Shain Schaffer, P.C. defend the interests of the township and that these matters be treated as extraordinary litigation; and

            WHEREAS, acknowledgment of the status of “extraordinary litigation” requires the advice and consent of the Township Council; and

 

            WHEREAS,Shain Schaffer, P.C. will render legal services at a cost not to exceed $100,000.00, pending further authorization from the Township Council; and

 

            WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available in the budget, as evidenced by Certificate No. C-1800025, a copy of which is annexed hereto as Exhibit “A”;

            WHEREAS, pursuant to Resolution No. R-9-2017-244, adopted by the Monroe Township Council at its meeting held on September 6, 2017, a contract was awarded to Jaffe Communications, Inc., 312 North Avenue E Suite 5, Cranford, N.J. 07016; and

 

            WHEREAS,said contract was in the original amount not to exceed $15,000.00 per issue for services in connection with the Monroe Township Publication; and

 

            WHEREAS, in the event additional copies per issue of the Monroe News are ordered, a modification to said contract not to exceed $1,400.00is needed; and

 

WHEREAS, the Certified Municipal Finance Officer has certified in Certificate

No.C-1700041, a copy of which is attached hereto, that sufficient funds are available;

            WHEREAS,an emergent condition has arisen with respect to payment of normal operating expenses and no adequate provision has been made in the 2018 temporary appropriations for the aforesaid purpose, and N.J.S.A.40A:4-20 provides for the creation of an emergency temporary appropriation for the purposes above mentioned; and

            WHEREAS, the total emergency temporary Resolutions adopted in Year 2018, pursuant to the provisions of Chapter 96, P.L. 1951 (N.J.S.A.40A:4-20), including this Resolution, is $511,500.00;

            WHEREAS, on February 22, 2018 one (1) sealed bid was received from Whirl Construction in connection with Monroe Township’s Daniel P. Ryan Memorial Field ADA Restroom Improvements; and

 

            WHEREAS, by copy of letter dated February 23, 2018, the Township Engineer advised that the bid received exceeded the engineering estimate and the budgeted funding for this project; and

 

            WHEREAS, the Township Engineer further recommends that the governing body reject the bid and further authorize that the scope of the work be revised and the project be re-advertised for receipt of bids; and

 

            WHEREAS, the Township Council has reviewed and consents to the recommendations made by the Township Engineer;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex and State of New Jersey that the bid received in connection with the Daniel P. Ryan Memorial Field ADA Restroom Improvements be and are hereby rejected; and

WHEREAS,no contract that is subject to the requirements of Article 3 of the Affirmative Action Regulations pursuant to Public Law 1975, Chapter 127 (N.J.A.C.17:27-1, etseq.) shall be awarded by the Township of Monroe, nor shall any monies be paid thereunder, to any contractor, subcontractor of business firm that has not agreed and guaranteed to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the affirmative action plan approved under the terms established in the above-cited regulations;

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex that it has rendered its advice and hereby consents to the award of contract, to Aquatic Technologies, Inc.,for 2018 wet basin maintenance for a total contract price of $17,999.04; and

 

WHEREAS,the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available, as evidenced by Certificate No. C-1800026, a copy of which is attached hereto; and

 

BE IT FURTHER RESOLVED that the Mayor and Township Clerk are hereby authorized and directed to execute a contract with Aquatic Technologies, Inc..; and

 

           BE IT FURTHER RESOLVED that the Certified Municipal Finance Officer is hereby authorized and directed to pay Aquatic Technologies, Inc.in accordance with the contract entered into between the parties; and

 

BE IT FURTHER RESOLVED that the contract is awarded with the stipulation that Aquatic Technologies, Incshall comply with Affirmative Action Regulations, including revising their contracts as necessary to add mandatory affirmative action language, and submitting either a letter of federal approval or a certificate of employee information report, or a completed form AA302 at the time the signed contracts are returned to the Township of Monroe, or seven (7) days thereafter, or risk being declared non-responsive and forfeiting the award.

R-3-2018-100             RESOLUTIONAUTHORIZING AWARD OF CONTRACT TO J.                                       FLETCHER CREAMER & SON FOR GUARDRAIL                                                                         REPLACEMENT ON WYCOFF MILLS ROAD.  ($23,320) 

 

WHEREAS, on February 15, 2018, proposals were received for guardrail replacement for two locations on Wycoff Mills Road; and

 

WHEREAS, on behalf of Monroe Township,Center State Engineering received proposals froma total of four (4) companies as follows:

 

  1. Fletcher Creamer & Son -$23,320.00

                        Road Safety Systems, LLC -              $34,905.00

                        SF Systems Corporation -                 $36,350.00

                        Z Brothers Concrete Contractors, Inc. -         $41,906.00                 

                       

 

            WHEREAS, the Township Engineer has reviewed the four (4) proposals received and, by copy of letter dated February 23, 2018, recommends the award of contract to J. Fletcher Creamer & Son, in the amount of $23,320.00; and

            BE IT FURTHER RESOLVED that the Certified Municipal Finance Officer is hereby authorized and directed to pay J. Fletcher Creamer & Sonin accordance with the contract entered into between the parties; and

 

BE IT FURTHER RESOLVED that the contract is awarded with the stipulation that J. R-3-2018-101            RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE

                                    OF SPOTSWOOD-ENGLISHTOWN ROAD BETWEEN LEGENDS                                     AND MOUNTS MILLS ROADS FOR THE INSTALLATION OF A                                             SANITARY SEWER FORCE MAIN AND PSE&G’s                                                                 INSTALLATION OF A GAS MAIN  WITHIN THE PUBLIC                                                  RIGHT OF WAY.

 

            WHEREAS,JSM at Monroe, LLC, by copy of letter received February 21, 2018, seeks the temporary closure of Spotswood-Englishtown Road between Legends and Mounts Mill Road for the installation of a sanitary sewer force main and PSE&G’s installation of a gas main within the public right of way; and

 

            WHEREAS,the temporary closure of Spotswood-Englishtown Road necessitates the detour of traffic, as shown on the Detour Plan prepared by EP Design Services, a copy of which is attached hereto and made a part hereof; and

 

            WHEREAS,the Township Engineer, by copy of letter dated February 23, 2018, recommends Council approval of the temporary road closure and detour route conditional upon JSM at Monroe LLC. providing resident and school bus notification and access as well as Emergency vehicle access and the traffic control plan being revised to provide additional signage and barricades; and

 

            WHEREAS,the Detour Plan, as presented by EP Design Services, has been reviewed by the Monroe Township Police Department and by copy of letter dated February 23, 2018, have approved the Detour Plan as submitted;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey that Spotswood-Englishtown Road between Legends and Mounts Mill Road shall be temporarily closed and traffic shall be detoured as per the attached Detour Plan.

R-3-2018-102            RESOLUTION AUTHORIZING AWARD OF A CONTRACT TO

                                    TJM CONTROLS, INC. FOR CONTRACT 470

                                    MONROE TOWNSHIP UTILITY DEPARTMENT (“M.T.U.D.”).

                                    (Per unit pricing)

 

WHEREAS, on February 21, 2018 two (2) sealed bids were received, and publicly opened and read, by the Monroe Township Utility Department for Contract 470, “Instrumentation Calibration and Repair Service”, required by the M.T.U.D.; and

 

 

WHEREAS, the Purchasing Agent of the M.T.U.D., by copy of a letter dated February 22, 2018, has recommended that a (2) two year open-ended contract be awarded to the low bidder TJM Controls, Inc. of 37 Oakland Avenue, Edison, New Jersey 08817,, based upon the unit pricing and estimated quantities contained within their bid documents, a copy of which is attached as Exhibit "B"; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Finance Officer has certified availability of funds in Certificate No. M-180020 acopy of which is attached hereto as Exhibit "A"; and

 

WHEREAS, TJM Controls has submitted all the required documents with their bid; and

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

 

  • The Mayor and Township Clerk are hereby authorized to enter into a two (2) year contract with TJM Controls, Inc. in accordance with the unit pricing provided in their bid; and

 

(2)       Township Chief Finance Officer is hereby authorized and directed to pay invoices for material delivered by TJM Controls, Inc. in accordance with their bid;

 

(3)       The contracts are awarded through the competitive bidding process as a fair and open contract in accordance with the Local Public Contracts Law;

 

(4)       This contract is awarded with the stipulation that TJM Controls, Inc. shall provide a properly executed certificate of insurance as required by the specifications.

                                    BY THE MONROE TOWNSHIP UTILITY DEPARTMENT

                                    (M.T.U.D.). (Per unit pricing)

 

WHEREAS, on February 21, 2018 three (3) sealed bid were received, and publicly opened and read, by the Monroe Township Utility Department for Contract 475, Mechanical Maintenance & Repair Services, required by the M.T.U.D.

 

WHEREAS, the Purchasing Agent of the M.T.U.D., by copy of a letter dated February 22, 2018, recommends a one (1) year contract be awarded to Longo Electrical – Mechanical Inc., 1 Harry Schupe Blvd., Wharton, New Jersey, 07885 at the unit pricing provided by the bidder, and as shown on the attached schedule of rates for the Mechanical Maintenance & Repair Services.  A Copy of which s attached as Exhibit B; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the M.T.U.D.’s Township Chief Finance Officer has certified availability of funds in Certificate No. M-180019, a copy of which is attached hereto as Exhibit "A"; and

 

WHEREAS, pursuant to N.J.A.C.5:30-5.5(d)(l)(ii), multi-year contracts entered into for periods in excess of twelve (12) months shall be certified and charged to the respective budgets in accordance with the time(s) at which the respective work or services are performed or liability for payment is otherwise incurred.  Accordingly, commitments and payments required in excess of the initial twelve (12) months are contingent upon necessary funds being appropriated in future budgets by a subsequent governing body.

                       

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey that it has rendered its advice and hereby consents to the award of a contract for the Monroe Township Mechanical Maintenance & Repair Services, for 12 months per the unit price rates indicated in their proposal, and with the provision authorizing the M.T.U.D. Purchasing Manager to extend said contract for two additional 12 months, with the consent of the bidder; and

 

WHEREAS, Longo Electrical Mechanical, Inc. has submitted, with their bid, all the required documents.

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

Purchasing Agent has recommended in a letter dated January February 22, 2018, a two (2) year contract be awarded to the low bidder Longo Electrical Mechanical, Inc. at 1 Harry Shupe Blvd, Wharton NJ 07885., based upon the unit pricing and estimated quantities contained within their bid documents, a copy of which is attached hereto as Exhibit “B”; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Municipal Finance Officer has certified availability of funds in Certificate No. M-180018acopy of which is attached hereto as Exhibit "A"; and

WHEREAS, the Monroe Township Utility Department (M.T.U.D.) seeks Professional Engineering Services in relation Georgetown Estates Pump Station Construction Services; and

 

WHEREAS, on December 5, 2017 at 10:30 AM, pursuant to the provisions of N.J.S.A. 19:44A-20.5 et seq, after advertisement on the M.T.U.D. website for not less than 10 days, Statements of Qualifications were publicly opened by the Township Business Administrator for calendar Year 2018; and

 

WHEREAS, after review of all the Statement of Qualifications by the review committee, R3M Engineering, Inc. was determined to be qualified to perform said services; and

 

WHEREAS, R3M Engineering, Inc has submitted a proposal dated February 21, 2018 in the amount not to exceed $20,900.00, to perform the required tasks outlined in the proposal; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-55, the Chief Financial Officer has certified the availability of funds in Certificate No. M-180014a copy of which is attached hereto as Exhibit "A";

 

WHEREAS, the it is the Monroe Township Utility Department Director’s recommendation that R3M Engineering, Inc. be awarded a contract based on their proposal, a copy of which is attached as Exhibit “B”; and

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

WHEREAS, on December 5, 2017 at 10:30 AM, pursuant to the provisions of N.J.S.A. 19:44A-20.5 et seq, after advertisement on the M.T.U.D. website for not less than 10 days, Statements of Qualifications were publicly opened by the Township Business Administrator for calendar Year 2018; and

 

WHEREAS, after review of all the Statement of Qualifications by the review committee, R3M Engineering, Inc. was determined to be qualified to perform said services; and

 

WHEREAS, R3M Engineering, Inc has submitted a proposal dated February 21, 2018 in the amount not to exceed $41,500.00, to perform the required tasks outlined in the proposal; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-55, the Chief Financial Officer has certified the availability of funds in Certificate No. M-180015a copy of which is attached hereto as Exhibit "A";

 

WHEREAS, the it is the Monroe Township Utility Department Director’s recommendation that R3M Engineering, Inc. be awarded a contract based on their proposal, a copy of which is attached as Exhibit “B”; and

WHEREAS, the Monroe Township Utility Department (M.T.U.D.), at this time, has a need for Professional Engineering Services in relation to performing a Sequestration and Corrosion Control Study; and

 

WHEREAS, on December 5, 2017 at 10:30 AM, pursuant to the provisions of N.J.S.A. 19:44A-20.5 et seq, after advertisement on the M.T.U.D. website for not less than 10 days, Statements of Qualifications were publicly opened by the Township Business Administrator for calendar Year 2018; and

 

WHEREAS, after review of all the Statement of Qualifications by the review committee, H2M & Associates, Inc. was determined to be qualified to perform said services; and

 

WHEREAS, H2M & Associates, Inc. has provided a proposal dated February 22, 2018 for the Sequestration and Corrosion Control Study in the amount of $23,100.00; and

 

 WHEREAS, the Director of the M.T.U.D. has recommended that a contract be awarded to H2M & Associates, Inc. based on their proposal for the above referenced work in the amount of $23,100.00, a copy of which is attached hereto as Exhibit C; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Finance Officer has certified availability of funds in Certificate No. M-180017acopy of which is attached hereto as Exhibit "A"; and

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

 

(1)       The Mayor and Township Clerk are hereby authorized to modify and enter into a contract with H2M & Associates, Inc., for Professional Engineering Services, in accordance with the proposal; 

 

(2)       The Township Chief Finance Officer is hereby authorized and directed to pay invoices for services rendered by H2M & Associates, Inc. in accordance with the attached proposal;

 

(3)       The contract is awarded without competitive bidding through a fair and open RFQ process as a “professional service” in accordance with N.J.S.A.40A:11-5(1)(a) of the Local Public Contracts Law because the contract is for a service performed by persons authorized by law to practice a recognized profession that is regulated by law;

WHEREAS, the Monroe Township Utility Department (M.T.U.D.), at this time, has a need for Professional Engineering Services in relation Rehabilitation and Elevating the Route 522 Standpipe; and

 

WHEREAS, on December 5, 2017 at 10:30 AM, pursuant to the provisions of N.J.S.A. 19:44A-20.5 et seq, after advertisement on the M.T.U.D. website for not less than 10 days, Statements of Qualifications were publicly opened by the Township Business Administrator for calendar Year 2018; and

 

WHEREAS, after review of all the Statement of Qualifications by the review committee, H2M & Associates, Inc. was determined to be qualified to perform said services; and

 

WHEREAS, H2M & Associates, Inc. has provided a proposal dated February 22, 2018 for the Rehabilitation and Elevating of the Route 522 Water Tank in the amount of $78,100.00; and

 

 WHEREAS, the Director of the M.T.U.D. has recommended that a contract be awarded to H2M & Associates, Inc. based on their proposal for the above referenced work in the amount of $78,100.00, a copy of which is attached hereto as Exhibit C; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Finance Officer has certified availability of funds in Certificate No. M-180016 acopy of which is attached hereto as Exhibit "A"; and

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

 

(1)       The Mayor and Township Clerk are hereby authorized to modify and enter into a contract with H2M & Associates, Inc., for Professional Engineering Services, in accordance with the proposal; 

 

(2)       The Township Chief Finance Officer is hereby authorized and directed to pay invoices for services rendered by H2M & Associates, Inc. in accordance with the attached proposal;

                                    PERFORMANCE GUARANTEE UPON THE ACCEPTANCE OF A

                                    MAINTENANCE GUARANTEE POSTED FOR SUNRISE ACRES

                                    (PB-924-04/PB-840-03)  

                                    (Gravel Hill Spotswood Road)

 

            WHEREAS,P.P.F. INC., has posted Performance Guarantees for the Sunrise Acres project (PB-924-04/PB-840-03);and

 

            WHEREAS,a request was made for the release of the Performance Guarantees posted for this project; and

 

            WHEREAS, pursuant to Section 108-13.1 F and G of the Code of the Township of Monroe, the Township Engineer, by copy of letter dated January 30, 2018, has recommended, release of the Performance Guarantees; and

 

            WHEREAS, the Township Council has reviewed and hereby approves the recommendations of the Township Engineer;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Performance Guarantees posted for the Sunrise Acres project (PB-924-04), be released as reflected in the Township Engineer’s letter dated January 30, 2018, attached hereto.  This approval for release of the Performance Guarantee is conditioned upon the posting of a maintenance guarantee in the amount of $166,631.72.  Such maintenance guarantee shall run for a period of not less than two years from the date of memorialization of such action by the Council.

 

BE IT FURTHER RESOLVED, in accordance with the Monroe Township Code, “the developer shall maintain funds throughout the maintenance period in the engineering inspection escrow account in the amount of fifty percent (50%) of the original deposit” however the Township Engineer’s office feels the funds currently being held in escrow with the township is sufficient.

 

            SO RESOLVED, as aforesaid.

 

 

R-3-2018-092            RESOLUTION AUTHORIZING THE PAYMENT OF ADDITIONAL

                                    FEES TO SHAIN SCHAFFER, P.C. TO HANDLE MATTERS

                                    RELATED TO THE CASE OF TOWNSHIP OF MONROE v. BLACK

                                    ROCK ENTERPRISES, LLC et al. AND DR HORTON et al v.

                                    MONROE TOWNSHIPAS EXTRAORDINARY LITIGATION. 

                                    ($7500 and $651.03)

 

            WHEREAS,the Township of Monroe, has the need for legal representation in connection with the matters of Township of Monroe v. Black Rock Enterprises, LLC. Et Al.and DR Horton et al. v. Monroe Township; and

 

            WHEREAS, Shain, Schaffer & Rafanello, P.C. possesses the expertise necessary to represent the Township in these matters; and

 

            WHEREAS,the Mayor of the Township of Monroe has requested that Shain, Schaffer & Rafanello, P.C. defend the interests of the Township and these matters be treated as extraordinary litigation; and

 

            WHEREAS,acknowledgement of the status of “extraordinary litigation” requires the advice and consent of the Township Council; and

 

            WHEREAS,the Township Council, by Resolution No. R-7-2016-258 and R-11-2016-377 acknowledged the status of “extraordinary litigation” and provided its advice and consent to the legal services of Shain, Schaffer & Rafanello, P.C. pending further authorization of the Township Council; and

 

            WHEREAS, Shain, Schaffer & Rafanello, P.C. has incurred legal fees in excess of the budgeted amounts and has requested authorization for the following:

 

Township of Monroe v. Black Rock Enterprises– additional $7,500; and

DR Horton et al. v. Monroe Township– additional $651.03(final payment).

 

            WHEREAS,the Council has reviewed the request and believes that an additional authorization in the amount of $8,151.03for the above two (2) referenced litigations is reasonable at this time; and

 

            WHEREAS,theTownship’sCertified Municipal Finance Officer has certified the availability of funds in Certificate NoC-160031and C-160067copiesof which areannexed hereto as Exhibit “A”;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, that it has rendered its advice and hereby authorizes Shain, Schaffer & Rafanello, P.C.be paidadditional fees for legal services rendered in connection with the matter Township of Monroe v. REPORTS:

Mayor’s Report– Mayor Tamburro discussed that in response to the shooting that occurred in Parkland, Florida, where 17 students were killed, he had asked the Police Department to be very present in all of our schools so there was no copycat. Following that day there was a School Board meeting in which parents expressed their concern for their children’s safety. The Mayor and Chief of Police spoke with the school district and advised that it would be in their best interest to change their policy to now allow off duty police officers and security to carry guns in the school. The policy change takes two months. The Township’s commitment was to place off duty police officers in all of our schools and to cover the expenses until the school district policy change takes effect.

 

Read Across America was held on Friday; the Chief of Police also attended and spoke to the children about the dangers of guns, as this was an opportune time to teach the children that the police are their friends.

 

The Township will be adding 37 acres to our Farmland Preservation program, the latest parcel is located on Spotswood-Gravel Hill Road. This is a partnership between the Township, the State and County. No development will ever be allowed to take place.

 

Also formed an Open Space Task Force for the Training School which will have members of the State, County and local officials. Governor Murphy was agreeable with appointing someone from his office to our commission; as soon as the Ordinance creating this Task Force is completed then a meeting will be held. The underlaying zone is Farmland Preservation and we want to ensure that the land is always protected as either Open Space or Farmland.

 

Received a $475,000 grant from the DOT for resurfacing and improvement of Spotswood Ave. and Ellingham Road. This grant covers 87% of the cost of that project.

 

 

Administrator’s Report – In regards to the school security, Business Administrator Weinberg

recognized the efforts of the Mayor and Chief of Police in prioritizing and taking a leadership role for our children’s safety, as well as, the Board of Education. He commented that not every community has the level of cooperation that we have with the school districts and praised that we have great lines of communication with all government agencies.  

 

The DOT grant is the largest grant received in a while, with the project being covered 87%. We

will continue to move forward in applying for grants to help the Township.

 

The Training School Task Force will have their first meeting once the Ordinance is adopted. He

noted that it is very important to preserve this land. 

 

The Rabies Clinic was held this past Saturday and was a very successful event; thanks to the

Clerk’s Office and our DPW for all of their hard work.

 

Reported that the Township will continue to monitor the impending storm coming tomorrow; DPW

will be preparing their plows and getting ready to tackle whatever weather is thrown our way. 

 

 

Engineer’s Report – Reported there were several traffic control items that were approved

tonight, one being the reduction of the speed limit on two roads, Spotswood-Englishtown

Road and Old Bridge-Englishtown Road. The Council also approved a “No Turn on Red” signal

on Union Valley Road and Perrineville Road, that was a new traffic signal installed by the County

last year establishing “No Turn on Red” at three of those corners. Additionally, there was an award

for guide rail replacements on Wykoff Mills Road which was brought up numerous times at

meetings and now has been awarded.

 

 

COUNCIL REPORTS:

 

Council Vice-President Schneider

  • An Easter Egg Hunt will be held on March 24th, at noon at the Recreation Center.
  • The Middlesex County Paper Shredding Event will be held on April 13thfrom 9am-Noon at the Senior Center.
  • Attended the Girl Scouts World Thinking Day; there were over 77 girl scouts in attendance. Applause to the people that stick with the scouting.
  • Attended the Indian US Forum’s celebration of Black History Month.
  • As the liaison for the Commission on Aging, attended the Empty Bowl Project, where a $5 donation gives you a handcrafted bowl and complimentary soup with the money going to many local food pantries.
  • Monroe Township has the 3rdlargest senior population in the State of New Jersey.
  • Free tax preparation at the Senior Center starting in April; make an appointment if interested.

 

Councilman Baskin

  • Owners of farmland can preserve their property through the State Farmland Preservation Program if interested as there will be a meeting held on March 27that 6:30pm which will be very informative.
  • Community Gardens will open soon; there are 10x10 spots still available and for those interested you can visit the website for more information or contact Gary Busman.
  • Attended the Girl Scouts World Thinking Day; was very impressed with the Fiji dancers.
  • As the liaison of the Monroe Township Historical Preservation Committee, he attended his first meeting where it was discussed restoration of the house on Dey Farm. He has asked Harold Klein to help in securing grant money to do so.
  • Attended the Green Team meetings as they are the sponsors of the Green Fair.
  • Attended the Indian US Forum which held a Black History Month celebration. The organization is very active in all of our community service projects.
  • Attended the Budget Workshop for Newly Elected Officials where the history of State Aid to municipalities was a very provocative topic.
  • Attended a forum regarding medical marijuana; antidotally proven to medically help people in pain.

 

Councilman Dipierro –

  • Attended the Black History Month celebration at the Recreation Center; a great job was done on all of the presentations and educating the public.
  • Attended the Girl Scout World Thinking Day which was very impressive and well done.
  • Attended the medical marijuana forum and was educated on a property on Brickyard Road in Trenton which is one facility that is growing marijuana in greenhouses for medical use.
  • Attended the Farmland Open Space seminar on Friday; 22ndyear that this is being held. Spoke with representatives from the State Agricultural Department in regard to the Training School property. They spoke about New Jersey being the Garden State however there is not a lot of new farmers, with the average age to own a farm being 65 years old. He added that he is very shocked to see that 270,000 acres have been paved over since 1990. Extended thanks to the Green Team for their efforts in making Monroe Township shine. Added that he would like to thanks Joe Slomian from our DPW Department for all of his hard work informing our residents of the importance of being “green”.
  • Asked Mike Barnes if there was an update on Spotswood-Englishtown Road regarding the gas line and the sewer and inform the residents as to how this will be done; Mike Barnes answered that there are shop drawings that are still being submitted and has estimated that it will take 6-8 weeks for construction with the road being open at night time and it will not be done in the summer as we had planned. The gas company is going to take the Right of Way at the center of the road and we will go in first for the force main. Township Engineer Rasimowicz further explained that the resolution on tonight’s agenda was for the road closure and the anticipated start date is April 2ndbut could be as far out as April 16th. PSE&G is still fine tuning the locations for the lines. If the gas line is ready to go first that will start first. There will be meetings with the Police Department regarding the school buses and traffic, as well as, notification being given to the residents. Administrator Weinberg added that when the gas line goes in the residents will be contacted to see if they are interested in connecting to the gas line. Councilman Dipierro asked how deep it would be; Mike Barnes answered that it will be 3-4 feet deep and the line is a 6” PVC line.
  • Mentioned that Spring Cleanup will begin on April 2ndand reminded those who are interested to schedule with DPW.
  • A tree recovery campaign which will begin on April 14th; you can pick up seedlings at the DPW, Library or the Community Center.
  • March 13this the Special Election for the Bond Referendum for the Board of Education. He noted that it is important for everyone to come out and vote.
  • The Budget Workshop meetings will be held March 19thand March 22nd.

 

 

 

 

 

 

Councilwoman Cohen –

  • Regarding the security in the schools, reminded everyone when asked for an ID it is important to show it and it must become a force of habit for the personnel to ask. We are safer if we are routinely asking for this information.
  • The Green Team spends many hours in looking for new ways to recycle. There are hours and hours of volunteer labor that goes into this which should be noted.
  • There will be a free blood pressure and blood sugar screening at the Senior Center on March 27th from 10:30am to 12:30pm.
  • 67% of residents are a part of the energy aggregation program. If you are not participating please contact Harold Klein to become part of the program to save money.

 

Council President Dalina –

  • The Annual Makerfest will be held on March 10that the Library.
  • Opening Day for Baseball and Softball will be on April 14th, along with the annual Spring Soccer Kick-Off at Thompson Park.
  • Summer Recreation Camp applications are now open through March 31stand the deadline for Mt. SEPA Special Education Summer Camp is March 30th. Further information can be found at the Community Center.
  • Mentioned that his son is a freshman at the School of Environmental and Biological Sciences at Rutgers and he asked that it be brought to everyone’s attention that there will be seminar held on the ‘State of Agriculture and Our Food Systems’ on March 20that Davidson’s Mill Pond Park in South Brunswick.

 

 

Public:

 

Charlie Lerman, 11 Doral Dr. – Mr. Lerman read aloud a letter regarding his position on the

Master Plan and the effect it has had on our Township. His letter reads, “The Master Plan which

was prepared by the Town Planner Mark Remsa with the assistance of then Chair of the Master

Plan Committee, Jerry Tamburro, at that time also the Council Chair and presently the Mayor of

Monroe Township. My position had always been that the plan was extremely ambitious in that it

called for over 3,000 non-age restricted units which I strongly felt would put a huge burden on our school system and to a lesser degree on the township’s service. I was advised in an open session by Mayor Tamburro that I did not know what I was talking about and that development would occur over many years. I leave for the citizens of Monroe Township to decide who was correct. Development attributed to the Master Plan has presently burdened our school system to the point that the Township is in dire need of two new schools and an addition to the high school in order to give our students a proper education. Our elected and appointed officials are mandated by the public to protect their constituent’s interests which in my opinion they failed. I point to Mark

Remsa and Mayor Tamburro in the preparation of the Master Plan and the Planning Board and the Council and past Mayor Pucci for approving such an ambitious plan. We are faced on March 13thwith the first of possibly three referendums involving school construction. Not only will the

citizens be burdened with massive construction costs but more importantly infrastructure costs

such as payroll for educators, busing, as well as, general maintenance which will remain with us

forever. Last year I asked the following question: ‘how could the many citizens of Monroe who

are getting by, afford to continue to live in Monroe Township when they see their school taxes

skyrocketing mainly attributed to the near-term problem caused by an ambitious Master Plan’.

There was silence on the part of the Mayor and Council. In my wildest imagination I cannot fathom

the cost to the residents of Monroe Township involving the need for two new schools and am

addition to the high school. To be fair the affordable housing formula mandated by the courts

calling for some 3,500 non-age restricted units will exert an even further burden on our school

system but the near terms problem rests squarely on the shoulders of the Master Plan. The Mayor

and Council are proud of the fact that the municipal portion of the budget remains stable but are

not transparent when their actions have a direct burden on the school budget. The Master Plan is

certainly proof of such an action. Many residents who I speak to are not aware of the Council’s

position and point a finger at the School Board regarding the need for schools. The School Board,

by no fault of their own, have been dealt an impossible hand, attributed to the approval of the

Master Plan. In summation it appears that our elected and appointed officials have not protected

the interests of the constituents regarding development and have favored developers who develop

property, leave and we the tax payers are left holding the bag. Those officials are accountable for

what is presently occurring in our schools for the reasons stated above.”

 

 

 

 

 

Council President Dalina thanked Mr. Lerman for presenting a plethora of information and

commented that there was a recent Master Plan review in regards to the affordable housing

litigation in which we changed some of the zoning from 6 to 10 acres. Council Vice-President

Schneider added that the Governor has frozen our funding and we have not received our fair

share. She added that if we did receive our fair share then that would help the tax burden to the

residents. 

 

Prakash Parab, 33 Dayna Dr. – Thanked the Mayor and Council for putting our police officers

at the schools, but at the same time the debate is going on as to what the solution could be for this.

It would be nice to have an Ordinance to look at a real solution in making tighter laws so guns do

not land in the wrong hands.

 

In regards to the medical marijuana issue, it is unfair that the FDA allows research in marijuana

but insurance will not cover its use for medical purposes for people who suffer from debilitating

diseases. Very happy to see Cranbury did an Ordinance banning recreational marijuana and again

requests the Mayor and Council to do the same.

 

Asked what Ordinance #O-2-2018-002 is for; Administrator Weinberg explained that each year

the Department of Housing and Urban Development sets the income rates, which used to be done

by COAH which has since been disbanded, and this is tied to the index set in the Affordable

Housing limits.

 

Councilwoman Cohen commented that the Center for Disease Control is not permitted to do

research in gun violence. We have at least one state in this country where it is not legal for

physicians to speak to families about how their guns are handled and stored; the same

organization handles marijuana. She added that Mr. Parab’s concerns should be addressed beyond

us, as they are the folks who have the authority to enact the appropriate legislation.

 

Joe Sapia, 2 Thomas St. – 61 year lifelong resident. In regards to the Mayor’s Task Force for the Training School, as a member of the Open Space Commission he was told that there would not be a task force. He said that he was told by someone in the office that this was not happening, is this true; Mayor Tamburro responded that there will be a task force.

 

Mr. Sapia asked if there was a State Historic Preservation Officer Review of that site because if

you go on the DEP website that status is still there and has not changed as far as having it registered

as a SHPO, adding that to really preserve that land we should pursue it being listed as such.

 

In regards to Open Space, he stated there are several Open Space lists and asked when they will

be joined; Council President Dalina asked Administrator Weinberg to get one cohesive list so the

commission knows what it is that they are pursuing. Councilman Dipierro added that council

should see a list of all targeted properties.  Administrator Weinberg added that one of the goals is

to acquire as much land as we can get and one of our priorities in particular is to buy land that

could possibly be developed. Mr. Sapia commented that we should put schools on property that

could be potentially developed as housing and instead we are putting it on commercial property.

 

Gary Busman, 7 Monarch Rd. – Mr. Busman asked for an explanation on R-3-2018-096;

Councilman Dalina answered that the dollar amount is $511,000 coming from Public Advocate,

Finance, Police Department, Parks, Division of Ambulance and the Zoning Board. Administrator

Weinberg also explained that this resolution is being done so that we are able to operate the budget

until it is passed in May.

 

Also asked for an explanation in regards to R-3-2018-097; Administrator Weinberg explained that

we have a series of trust funds to be used for a rainy day so to speak and when we end the year

you can move money within the first three months within your budget. One of the funds is a storm

fund, the second is a worker’s compensation fund and the third is accumulated sick. In our town

we are limited to $15,000, so we will transfer $175,000 and add it to our surplus.

 

Mr. Busman commented that he always travels on Wycoff Mills Road and has always worried

about the guardrails, as for over eleven years those guardrails have been in disrepair. He noted that

there is no guardrail by the farmhouse in Twin Rivers and without one you can risk ending up in

the gully. Engineer Rasimowicz commented that the area is not in Monroe Township but in East

Windsor, so he will reach out to them for repair.  

 

 

 

 

 

Michele Albergo, 57 Avenue G– Ms. Albergo noted that Veteran’s Park was closed last

year because of contaminated soil and asked if it will reopen this year; Council President Dalina

stated that we are addressing that as stated in one of the resolutions on tonight’s agenda, adding

that there may be a portion of it that may not be open but the park itself will open this summer.

Administrator Weinberg that it is not contamination, it is just glass. We were using the fields for

the Soccer League and we found glass. We immediately closed the fields and approached the

contractor expecting him to fix the problem. To date we have not been successful in getting the

contractor to repair and we are holding the contractor’s maintenance bond so if he does not act we

will repair ourselves and litigate with the contractor. If they do not take action to fix within the

next few weeks we will be seizing the bond and unfortunately starting the litigation process.

 

Roger Meaney, 22 Harrigan Ave. – Mr. Meaney asked where we stand in court with the eminent

domain, has it been settled or solved yet it court; Council President Dalina answered that all is in

order and both parties have come to an agreement. Administrator Weinberg added that the

landowner has been terrific and has agreed to a path so we can finalize the cost. It also means

that we can move forward with the project. He added that the expectation is at the next meeting

we can have a full discussion and have a final dollar amount which will be up to the court who is

normally very fair in an eminent domain situation. Monroe Township is now the owner of the

property.

 

Mr. Meaney commented that he thinks it is totally irresponsible to vote on a referendum when we

do not have specific information. $68 million dollars is the starting number and I think it is totally

irresponsible to have residents vote on this before we have full information. In the referendum, it

says that adjacent properties may also be pursued. Mayor Tamburro commented that we did not

write the referendum, that was done by the Board of Education. We did our part and got the land

for them as they requested.

 

Lori Winter, 308 Federal Rd. – Ms. Winter commented that Perrineville Road is being closed to

Route 33 and asked why traffic was diverted down Federal Road which is extremely narrow and

falling apart. This traffic could have been diverted another way. She added that the speeding on

Federal Road is terrible and asked if something can be done; another issue on Federal Road when

you put the guard rails up mailboxes were behind the guard rails. Years ago, one of the residents

died trying to get her mail and they should be offered an opportunity to move their mailboxes so

they can retrieve their mail safely.

 

Another issue is the Nixle Alerts; Ms. Winter asked why we receive so little alerts from

Monroe Township. If the roads are closed for an accident we should be notified by Nixle. She

added that when TD Bank was robbed and someone was on the loose with a gun, the residents

should have been notified. She asked where our police blotter is to see what is going on with the

Township.

 

Lastly, cannot lift her recyclables into the dumpsters because they are too high and the resident

bins are too heavy; asked if there is anyway the recycling can be changed so it is easier for people

to put things in the dumpsters.

 

Council President Dalina responded in regards to the Nixle Alerts and asked Administrator

Weinberg if we can get a police presence on Federal Road for the speeding. Councilman Dalina

said he would look into the police blotter and mentioned that there is usually someone available to

help at the recycling yard for any heavy items you need to dispose of.  Administrator Weinberg

and Engineer Rasimowicz will also reach out to the postal service regarding the placement of

mailboxes. Councilman Dipierro added that he is very aware of the issue on Federal Road and

asked if we can put a weight limit on that road, at least during construction to help these residents.

Engineer Rasimowicz responded that he will look into this and speak with the Police Department

as well.

 

Hy Grossman, 15 Doral Dr.– Mr. Grossman commended Council Vice-President Schneider on

her efforts in eliminating the hunger problem in New Jersey, as well as, the State Assembly

Speaker who addressed the hunger issue in an article in the Star Ledger.

 

Commented that in regards to R-3-2018-088 and R-3-2018-095, a list of the appointees should be

noted to remain transparent.
