TOWNSHIP OF MONROE COUNCIL MEETING MINUTES 

SPECIAL & AGENDA MEETING – JUNE 26, 2017 

 

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for a Regular Meeting.  

The Regular Meeting was Called to Order at 7:00 p.m. by Council President Stephen Dalina with a Salute to the Flag. 

 

UPON ROLL CALL by the Township Clerk, Patricia Reid, the following members of Council were present: Councilwoman Miriam Cohen, Councilman Michael Leibowitz, Council Vice-President Elizabeth Schneider and Council President Stephen Dalina. 

 ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Alan M. Weinberg, Township Attorney Joel Shain, Engineer Mark Rasimowicz and Deputy Township Clerk Christine Robbins. 

There were approximately ten (10) members of the Public present in the audience. 

 

Council President Dalina requested the Township Clerk to read the following SUNSHINE LAW into the record: 

In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the Minutes of this meeting that adequate has been provided by the following: 

1.Posted on the Bulletin Boards within the Municipal Building on December 30, 2016 and remains posted at that location for public inspection; 

2.Printed in the HOME NEWS TRIBUNE and CRANBURY PRESS on January 6, 2017;   

3.Posted on the Monroe Township website; and 

4.Sent to those individuals who have requested personal notice. 

 In accordance with Chapter 3, Section 17 of the Monroe Township Code, Public Comment shall  

be limited to five (5) minutes unless further time is granted by the Council President. 

 

Council President Dalina announced the Special Meeting is being held for the consideration of  

various resolutions, conducting an appeal hearing for denied solicitor’s permit and any other  

business that may come before the Council.  The regularly scheduled Agenda Meeting will  

immediately follow. 

 

Council President Dalina announced that we are here for an Appeal Hearing for a Denial of a  

Peddling and Soliciting Permit, in accordance with Monroe Township Code, Chapter 77-9 entitled  

“Appeal from denial or revocation of certificate”. He also clarified that the hearing was not open  

for public discussion. He asked Township Clerk Patricia Reid to put the following documents into  

evidence: 

  • Application received from Mr. Boyce on May 8, 2017 
  • Memo dated May 8, 2017 to Chief Lloyd from Township Clerk, Patricia Reid, requesting review of the application.  
  • Memo dated May 10, 2017 to Township Clerk, Patricia Reid, from Chief Lloyd denying the application.  
  • Letter dated May 10, 2017 addressed to Mr. Boyce from Chief Lloyd, notifying Mr. Boyce of his denial and the reasons.  
  • Letter from Mr. Boyce received on June 1, 2017 requesting an appeal hearing for his denial.  
  • Letter dated June 16, 2017 to Mr. Boyce from Township Clerk, Patricia Reid, advising him of his appeal hearing date.  

 

Council President Dalina asked Mr. Boyce to please come forward and for the Township Clerk,  

Patricia Reid to swear in Mr. Boyce. 

 

Township Clerk, Patricia Reid directed Mr. Boyce to place his left hand on the bible and raise his  

right hand, then asking, (verbatim) Mr. Mark Louis Boyce do you solemnly swear to tell the truth,  

the whole truth and nothing but the truth, so help you God?” 

 

Mr. Boyce: (verbatim) “I do”. 

 

Council President Dalina directed Mr. Boyce to take a seat and advised him that at this time he is  

being asked to tell the Council as to why his denial should be reversed also advising him that after  

his testimony the Council may have some questions.  

 

Mr. Boyce: (verbatim) Absolutely, I didn’t come here to tell the Council to do anything today, I  

came here to try and turn this around. I made some mistakes in the past as a young person even  

making one without having my permit, when the nice young lady warned me that we are a very  

strict town. I work with a bunch of door knockers and some of them had been in this business for  

so many years and none of them have had a single knocking permit ever and I kinda felt like you  

know or it was made to feel like I was kinda not stepping up. I had already filed for my appeal and  

I should have listened to the young lady in the office when she said this is a very strict town if   

you try to mess around and I think last time one of our guys got in trouble years and years ago with  

Trinity, because I am with Trinity Solar and that was a mistake, I shouldn’t have done that and that  

was stupid thing to do, I was eager to get started and I’ve never been a door knocker and they  

were like oh nothing is going to happen, it’s ridiculous, I’ve been doing it for years, I knock in this  

town and that town and I was like yeah you know what maybe I’ll just go out and stretch my legs  

a little bit and I got to the fourth door, I was on two little streets I was on and I mention the name  

of the second street I was on to the officer who came up to me at this moment and since that day I  

haven’t set foot into Monroe only to come to the municipality to try to file for my appeal. As for  

why I, might consider changing your mind, believe it or not I come from good stock, um as I wrote in my letter, I come from a father who is a farmer who served our country and was there in the hour of need when Jamesburg-Monroe took on a big fire, in fact there were a lot of Boyce’s, a lot of my kin running around in these backwoods in brush trucks and what we had to do to fight those fires back on that day. So when I got denied I felt a lot of shame and had a lot of emotion over it  

and it was disappointing to my wife and I and I had my birthday in two days and I’m over fifty  

and I got this wonderful job with Trinity and they are a wonderful Christian company and I’m  

flattered to be there and lucky and I made a really silly mistake that day on that doorstep of those  

four individual houses, and incidentally the house where I was approached by the officers, they  

were interested I haven’t followed up with them or haven’t pursued them I was to contact and  

speak to the husbandI was a little embarrassed by the situation but I also felt obligated to not tread  

any deeper into any suspicion whatsoever so I haven’t even been in the territory.   I’ve been  

shadowing some of our people who have been with the company for a while to pick up what’s  

been going on. I feel terrible about it and there was also an incident that cast some negativity on  

the decision of me having a knocker’s permit which happened nine years ago.  A stupid thing that  

happened over a relationship which I later married the young lady, it was a bad night of emotions  

and my car had gone off the road, I had been drinking quite a bit, and I had hit a curb and broke  

one axle and hit another curb breaking the other axle, nobody was hurt except for me somewhat. I  

ended up hitting a tree in the front yard off to the side of a guy’s house and it was winter time and  

it was cold and I was really gone and I should have stayed right at that location but I was cutting  

through the woods trying to get to the gas station which was at the corner of Tennent Road and 79  

where I was hoping to get somebody there I was calling my older brother Steve and trying to get  

somebody there and it was stupid I should have stayed and there was snow on the ground and it’s  

a really curvy, nutty place to be, there’s zero shoulders on either side, it’s by where there’s a  

ballpark over there where they play little league if anybody has been by there. I should not have  

left that scene and I think it cast some doubts on my character by doing so and it was a dumb thing  

to do. I hardly drink at all anymore, the last time I drank out, besides my house was at my wedding,  

I did one shot and that was it but I realized that’s something I can’t really play around with. I also  

feel terrible that I had to bring all of you nice people here out on this day, it’s a terrible thing. If  

you knew how many pancake breakfasts I set up for in Robertsville, my dad was the first fire chief  

in Robertsville. We have had nothing but first aiders, people on the fire department around me my  

whole life, (inaudible) going off around and all of that stuff. When I was denied it did strike me  

quite emotionally and I do feel terrible and I don’t think the Chief made a mistake in saying what  

he said, he is out for the best of the people in this community and bless him for that. Your decision  

you know today is your own and I’m open for any questions”.  

 

Council President Dalina asked if anyone from the Council had any questions or concerns, in which 

they did not. He thanked Mr. Boyce for his testimony.  

 

 

Council President Dalina asked Lieutenant Jason Grosser from the Monroe Township Police  

Department to come up, as he oversees the application process 

 

Mr. Boyce asked if he should sit somewhere else; Council President Dalina instructed him to sit  

back in his seat.  

 

Township Clerk, Patricia Reid directed Lt. Grosser to place his left hand on the bible and raise his  

right hand, then asking, (verbatim) “Lieutenant Jason Grosser do you solemnly swear to tell the  

truth, the whole truth and nothing but the truth, so help you God?” 

 

Lt. Grosser: (verbatim) “I do”. 

 

Council President Dalina thanked Lt. Grosser for coming out and asked for him to share his  

professional opinion as to his findings.  

 

Lt. Grosser: (verbatim) “The peddler/solicitor permits are specifically outlined in the ordinance  

that was referenced by Mr. Boyce prior to me coming up, in there it indicates that there are certain  

parameters that we look at that gives us an indication of what we feel this person’s background or  

potential conduct will be. We express to them in the application when they pick it up at the Clerk’s  

office that a background will be done. One of the questions asked specifically is whether or not  

the applicant has been convicted of any crime, misdemeanor or violation, if so, the nature of the  

offense and the punishment or penalty assessed. In addition to that they’re told with a cover letter,  

as well as, verbally by the Clerk’s office that they are not to start soliciting for sales until the permit  

has either been approved or not at all and denied, and that usually takes about fourteen days.  

Personally, I come from a family of business owners so I try to get that done as fast as I can as it  

ends up on my desk to do the background check, so I try and get these people through as fast as I  

can, thoroughly but as quickly as I can. In this particular instance once I started the background on  

Mr. Boyce I had found some offense issues that had happened in the past. So when I look back on  

the application regarding question number four, it specifically says, his answer specifically ‘no’,  

that in and of itself would be grounds for a denial because he wasn’t truthful on the application.  

Had he indicated ‘yes’, the offenses that I had found, in the ordinance indicates anything from ten,  

within the last ten years specifically, within the last ten years we had the incident that Mr. Boyce  

indicated that took place in Marlboro where he had the accident, fled the scene, was found and  

failed to comply with officer’s commands. That in and of itself would raise issue to health, safety  

and welfare of the community which is specifically outlined in our ordinance. So once we received  

this application, I had gotten it on the 9th, I got my recommendations and everything that I could  

regarding this, made my recommendation to the Chief of Police and the denial letter and everything  

was developed on the 10th. That was prior to the incident that happened on Fox Run, where he was  

found soliciting without a permit after being told not to do so until given a permit. So the  

background in and of itself thoroughly affirms our concern that with his pattern of behavior in the  

past of not following the rules, which rightfully did the very next day on the 11th which is when  

the incident occurred because our department had received a phone call for suspicious persons/  

suspicious vehicle on Fox Run. The officer had found Mr. Boyce soliciting without his permit.  

He’s indicated that he is very sorry and whatnot, however, it’s a pattern of behavior that was  

concerning that sparked the denial. After the denial was sent out, Mr. Boyce had come in to see  

me to find out what exactly he was denied for and I had a very lengthy, in depth conversation with  

him basically explaining everything I just did to the Council just now. He expressed the same  

concern about what his family has done for the town and based on those aspects would it be  

possible for the Chief of Police to overlook the ordinance. I expressed to him that the ordinance is  

specifically spelled out, you have every right to appeal this decision but based on what we have  

right now as far as our concern my recommendation is a denial”. 

 

Council President Dalina thanked Lt. Grosser for his testimony and asked if the Council had any  

questions for the lieutenant, in which they did not.  

 

Council President Dalina then asked Mr. Boyce if he had any questions for Lt. Grosser regarding  

his testimony to which Mr. Boyce was instructed to come back up and address his questions.  

 

Mr. Boyce: (verbatim) “Character witnesses, such as, um Chiefs of Police, people that are actually  

friends of mine, does that have any type bearing on this situation and again I haven’t done anything  

where um I think that I’m a danger to society, and if it is I’d like to talk about it if there’s  

something that concerns the officer. The night in question where I supposedly had fled the scene I  

kinda did it on foot, my bell was good and rung, I had two broke axles and a small car and I hit the  

tree coming off two curbs head on and like I said I was pretty out of it and um I shouldn’t have  

left that scene that’s for sure but if there’s, and that happened about nine years ago and it was a  

really dumb thing to do guys and I love the community and if it’s your decision tonight one way  

or the other, I know what you’re doing is for the best of the community. But believe me my heart  

has nothing but Monroe’s good intentions in it and I’m here to spread solar energy to people who  

are interested and the people that are not on our system and our sales rep I take the no as quick as  

I take the yes. We are a professional company, it’s very much documented and I’m here to help  

but in regard to my character there’s something that you know I did, there’s some things  

that you know I’m not proud of as a kid and he’s right I should have checked yes, things have  

happened in the past. I thought it was so far in the past that since I already passed a background  

check with Trinity, I kinda thought that I was past that loop, I should have read into that a little bit  

more and been very very specific. If I had to do over again I certainly would have done it again.  

As far as the court like I said I feel terrible that I have all you beautiful people here tonight on this  

night, this officer that had to come out and take his time from the community and cost this  

community money and you know I would do everything in my heart and power to pay it forward  

and pay it back in just honest good service in looking out for you guys, you can count on me for  

the truth and I don’t feel like that’s coming from the officer tonight and I know he is doing his job  

to protect the community but I think if he knew me a little just a little bit like Chief Schriefer in  

Freehold knows me and some other people um you know I think that he would say Mark is a great  

guy, Mark’s the guy who jumps out of his truck to save people who lost their leg in front of  

McDonald’s on Route 9 in front of Mr. Yaki’s McDonald’s there where a guy got hit and I put my  

jeep sideways to protect him on Route 9, Marco something or other, Officer (inaudible) was the  

officer on the case, can tell you the kind of human being I am and I don’t cut and run. I did make  

some dumb mistakes that put the Chief and this nice officer in a spot where their jobs to throw  

shoulder blocks to keep this community with the right people around it but the only thing in my  

heart, the thing that I’m most disappointed in is what some folks might think of me because of this,  

certain things in my past um it was a stupid thing, I should have checked the other thing the other  

box and said yeah I didn’t fully understand what criminal charges or the verbiage, I checked no, I  

had already been through a criminal background check and I thought that this was really something  

that was a procedural thing and then going to those doors and getting too eager was a really dumb  

thing to do and um hat in hand I’m here today, hat in hand. Decision up or down I understand”. 

 

Council President Dalina thanked Mr. Boyce for his additional testimony and thanked Lt. Grosser  

for his service. He advised that to move this process along he explained that the Council will now  

vote on whether to Affirm the Denial or Reverse the Denial.  

 

He asked that Township ClerkPatricia Reid, take and record the vote for those in favor to Affirm  

the Denial of the Permit:

Council President explained that the majority has voted to Affirm the Denial and once again  

thanked everyone for their time. 

 

  

RESOLUTIONS for CONSIDERATION under the CONSENT AGENDA: 

 

UPON MOTION made by Council Vice-President Schneider and seconded by Councilman Leibowitz, the following Resolutions were moved for Adoption under the CONSENT AGENDA as herein below set forth: 

 

R-6-2017-175RESOLUTION AUTHORIZING AND APPROVING EXTENSION OF LIQUOR LICENSE TO BARRY R. SHARER, CHAPTER 7 BANKRUPTCY TRUSTEE. 

WHEREAS, an application has been filed for the extension of Plenary Retail Consumption License 1213-33-013-015 to the Chapter 7 Bankruptcy Trustee, Barry R. Sharer; and 

 

WHEREAS, the application, as submitted, has been reviewed and found to be in proper form and complete in all aspects, including proof of appointment to act as Bankruptcy Trustee; and 

 

NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Monroe, in the County of Middlesex and State of New Jersey, does hereby approve, effective June 30, 2017, the extension of the aforesaid Plenary Retail Consumption License for Barry R. Sharer, to conduct business under the privileges, terms, and conditions of the license as Chapter 7 Bankruptcy Trustee, until such time as the license may be transferred in compliance therewith; and 

 

BE IT FURTHER RESOLVED that the Township Clerk is hereby authorized and directed to endorse the License Certificate as follows: “This license is hereby extended, subject to all its terms and conditions, to Barry R. Sharer, Bankruptcy Trustee, until June 30, 2018.” 

 

SO RESOLVED, as aforesaid. 

 

 

R-6-2017-176RESOLUTION AUTHORIZING AND APPROVING RENEWAL OF LIQUOR LICENSES FOR THE 2017-2018 LICENSE TERM. 

WHEREAS, the Plenary Retail Consumption and Plenary Retail Distribution Applications set forth on the attached list for licenses heretofore issued by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey for the licensing year 2017-2018 have been submitted in proper form and no objections have been received in writing or otherwise; and 

 

WHEREAS, the applications submitted for the licenses set forth have been found complete in all respects; and 

 

WHEREAS, the applicants have been found qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes and regulations promulgated thereunder, as well as pertinent local Ordinances and conditions consistent with Title 33; 

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe in the County of Middlesex and State of New Jersey that the Plenary Retail Consumption and Plenary Retail Distribution Licenses, as outlined on the attached list, heretofore issued for the licensing term of 2017 – 2018 be and are hereby renewed for the licensing term of 2017 – 2018, effective July 1, 2017;

                          R-6-2017-177RESOLUTION AUTHORIZING THE SUBORDINATION OF AN AFFORDABLE HOUSING LIEN (BLOCK 14, LOT 12.51, QUAL. C063) 

WHEREAS, on February 24, 2016, Prakashbhai R. Patel and Vaishaliben P. Patel, (“Patel”), married, gave a repayment mortgage in accordance with the State’s Affordable Housing Program, to the Township of Monroe, requiring the Patel’s to pay the sum of $20,000.00 to the Municipality upon the first non-exempt sale of their property having an address of 63 Casselberry Way, as provided under the rules of the New Jersey Housing and Mortgage Finance Agency set forth in N.J.A.C. 5:80-26.5(c), said mortgage having been recorded with the Middlesex County Clerk on March 14, 2016, in Book 16287, Page 0645 et seq. (the Affordable Housing Lien); and 

 

WHEREAS, on February 24, 2016, the Patel’s gave a mortgage to Weichert Financial Services, in the amount of $120,000.00, said mortgage having been recorded with the Middlesex County Clerk on March 14, 2016 in Mortgage Book 16287, Page 633 et seq (the “2016 Weichert Mortgage”); and  

 

WHEREAS, the Patel’s have applied to refinance the 2016 Weichert Financial Services and has asked the Township of Monroe to subordinate the Affordable Housing Lien; and 

 

WHEREAS, the proposed refinancing qualifies for the subordination of Monroe’s affordable housing lien under the New Jersey Fair Housing Act, N.J.S.A. 52:27D-301 et seq and the rules of the New Jersey Housing and Mortgage Finance Agency set forth in N.J.A.C. 5:80-26.1 et seq; 

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey, that the Mayor and Township Clerk are hereby authorized and directed to execute the Mortgage Subordination, annexed hereto as Exhibit “A”.

Engineer’s Report – Engineer Rasimowicz reported that the Middlesex County Road Paving  

Projects are as scheduled:  

  1. Forsgate Drive railroad tracks to Applegarth Road, being done on both sides; the milling and paving will begin this week.  
  1. Prospect Plains Road from Cranbury Road to Applegarth Road; milling to begin June 27th and paving to begin on July 11th 
  1. Cranbury Station Road from the railroad to the new pavement by Linwood; milling to begin June 28th and paving to begin July 5th 

 

The approximate time will be from 7:00am to 3:30pm, Monday through Friday.

  •  Attended the Rossmoor Women’s guild scholarship ceremony; Seven scholarships of $1,000 each were given out. Very nice ceremony.
