TOWNSHIP OF MONROE COUNCIL MEETING MINUTES
REGULAR MEETING - NOVEMBER 9, 2016
The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for a Regular Meeting.
The Regular Meeting was Called to Order at 7:00 p.m. by Council President Leslie Koppel with a Salute to the Flag.
UPON ROLL CALL by the Township Clerk, Patricia Reid, the following members of Council were present: Councilman Blaise Dipierro, Councilman Michael Leibowitz, Councilwoman Elizabeth Schneider, Council Vice-President Stephen Dalina and Council President Leslie Koppel.
ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Wayne R. Hamilton, Township Attorney Joel L. Shain, Engineer Mark Rasimowicz and Deputy Township Clerk Christine Robbins.
There were approximately fourteen (14) members of the Public present in the audience.
Council President Koppel requested the Township Clerk to read the following SUNSHINE LAW into the record:

SECTION 1.

- 39-1.Title
This chapter shall be known as the “Codification of Fees and Costs of the Township of Monroe.”
- 39-2.Purpose
This chapter is adopted in order to advise the citizens of the township, and any and all persons doing business with the township, of the various fees charged for services rendered by the departments of township government and to provide ready access to any and all such information.
- 39-3.Fees enumerated.
The following fees shall be charged by the township for services rendered or licenses or permits issued. All license fees shall be annual unless otherwise noted.
A.GENERAL FEES:
(2)Codification.
(a)Code Book - Two hundred dollars ($200.).
(b)Chapter 108 - "Land Development Ordinance" - One hundred dollars
($100.), One hundred and fifty dollars ($150).
(c)Chapter 130 "Zoning" has been repealed by the adoption of the above
Chapter 108.
(d)Land Development Map - Five dollars ($5.).
(e)Master Plan as of July, 2003 - Seventy-five dollars ($75.), One hundred
dollars ($100).

SECTION 2.
All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance shall be and the same are hereby repealed.
SECTION 3.
If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.
SECTION 4.
This Ordinance shall take effect twenty (20) days after passage, adoption and publication according to law.

George Gunkelman, 5 Kelly Court – Mr. Gunkelman asked for clarification as the ranges seem
very broad and loose; Administrator Hamilton responded that the Fair Labor Standards Act is
putting in new requirements which will become effective December 1st. This adjusts the salaries
to be in compliance so not to trigger overtime.

THE TOWNSHIP OF MONROE ENTITLED “LAND DEVELOPMENT”.

WHEREAS, certain revisions made to Chapter 108 in connection with the approved Housing Element and Fair Share Plan limited the height of certain inclusionary developments to 45 feet; and
WHEREAS, the VC I Village overlay height restrictions were inconsistent with those amendments; and
WHEREAS, the Council believes that the inclusionary housing zones should have similar height restrictions;
BE IT ORDAINED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey that Chapter 108, § 6.7 J (7)(b)[4] shall be revised to read:

Mayor’s Report -
- Mayor Tamburro commented that it was a very successful election with over 61% of voter turnout. He congratulated Township Clerk Patricia Reid and her staff on doing a terrific job. He also congratulated Councilman Dipierro on his win.
- He reminded everyone of the Veteran’s Day services being held within the Township, adding that it is also the 50th anniversary of Vietnam and he feels that those who served did not receive the proper recognition when they returned home and it is important to honor them. It is also the 75th anniversary of Pearl Harbor.
- On November 13th there will be a chorus at the Marasco Center at 2pm recognizing those who have served.
- He was Invited to attend the mock election at the high school on Monday which went over how to understand the polling process and meeting of the Electoral College. There were 1,700 children in attendance and continues to be a wonderful program.
Administrator’s Report –
- Administrator Hamilton reminded everyone of the Veteran’s Day services being held.
- He also mentioned that the Monroe Township High School Marching Band will be representing New Jersey at the Pearl Harbor Memorial Parade in Hawaii, adding that it is very important to support their fundraising efforts.
Engineer’s Report –
- Engineer Rasimowicz reported that tomorrow and next week Perrineville Road will be milled and paved from the northern section which includes Forsgate Drive entrance to Thompson Park – expect delays.
Council’s Reports -
Councilman Dipierro – Councilman Dipierro thanked the Clerk’s office for a great job with the election.
Reported that a little boy was struck by a car on Old Forge Road. Councilman Dipierro knows the family and the driver and said everyone was very shaken by the accident and asked for prayers for the little boy. He reminded everyone to wear their helmets when out bike riding and to watch for deer.
He also extended get well wishes to Lorena from the Clerk’s office who is recovering from emergency appendectomy surgery.
Councilwoman Schneider – Councilwoman Schneider attended the mock election and was very impressed with the students.
She extended thanks to the Clerk’s office for a great job with the election.

November 24th the Senior Center will be having Thanksgiving dinner. The cost is $10 and includes great food and great company. If anyone needs a ride please reach out and arrangements will be made to get you there. Joe Harvie will be missed at this event.

Once a week the high school is looking for volunteers from the adult communities to come and socialize with the special needs children; if anyone would like to volunteer please contact Bonnie at the Senior Center.
Councilman Leibowitz – Councilman Leibowitz reminded everyone of the Veteran’s Day services being held this Friday at the Monroe Township Jewish Center.
He extended thanks to the Clerk’s office for a job well done in handling the election.
He congratulated Blaise on behalf of the Republican Party, as well as, Michele, Ken and Patty in winning the school board election.
Council Vice-President Dalina – Council Vice-President Dalina thanked the Clerk’s office, poll workers and congratulated all of the candidates.
Commented that Octoberfest is more than just a street fair; it is an opportunity for our Recreation Department to recognize those leaders in the community.
The Youth Advisory Committee has four new members and will be working on a possible environmental project but are leaning more towards a mock crash prior to prom season that will be filmed. They have been reaching out to the parties involved in hopes of pulling off this event.
The Monroe Township Library will be holding a book sale from December 9th through the 12th.
Council President Koppel – Council President Koppel reminded everyone that on Sunday, November 20th at 4:00pm at the Marasco Center there will be a show, “Think Pink Floyd”. There are other events being held as well which should be checked out.

The Police Unity Tour Fundraiser is being held tonight at Baker’s American Bar & Grill until 10:00pm; 15% of the bill gets donated back to the Monroe Township Police Unity riders.

Giuseppe Bongiovi, 9 Jurgelsky Rd. – mentioned there were downed trees on a power line on Dey Grove Road and also on Federal Road; Engineer Rasimowicz will look into.

Michele Arminio, 9 Nathaniel St. – extended congratulations to all of the winners.
Mrs. Arminio had questions regarding several of the following resolutions and the costs:
R-11-2016-376; Administrator Hamilton answered that this is for the cost of demolition, the original amount was $35,000 and now an additional $4,645 is needed for asbestos removal.
R-11-2016-377; Administrator Hamilton answered that the cost is $25,000 to the Township Attorney for litigation with DR Horton.
R-11-2016-385; Administrator Hamilton answered that this is for an additional $10,000 to the Township Attorney for extraordinary litigation. Mrs. Arminio asked what the total cost is, to which Administrator Hamilton answered that he did not have the total cost but will get.
She thanked all veterans for fighting for democracy, Colin Pasick and her husband who was a Vietnam Veteran as well. She extended thanks to her brother-in-law, who was diagnosed with a disease as a result of Agent Orange. She continued that because of them there is freedom and freedom of speech. Mayor Tamburro responded that this is why we are honoring the Vietnam Veteran’s as they deserve praise and honor.
Hy Grossman, 15 Doral Dr. – Mr. Grossman asked if R-11-2016-396 was the Monroe Park Development; Engineer Rasimowicz responded that it was.
He also asked if there was any progress with the County in having the speed limit reduced on Spotswood-Englishtown Road; Engineer Rasimowicz answered that the County does not recommend it now but will reassess after the traffic signal is installed.
George Gunkelman, 5 Kelly Ct. – Mr. Gunkelman asked what R-11-2016-381 was; Administrator Hamilton explained that it is a lift needed for vehicle repair and it is being purchased under state contract.
He asked what the gross amount for R-11-2016-395 was; Administrator Hamilton explained that it is $96,000. He added that funds cannot be moved from line items until after November 1st with most of that money going into the accumulated absence fund.
Lucille DiPasquale, 70 Avenue K – Mrs. DiPasquale spoke about the Emerald Ash Borer Study and explained that the treatment must be done by May 15th. She added that even healthy trees need to be treated and they would need to be treated every other year. The trees can be treated with an over the counter insecticide unless they are more than 30% affected which then a professional would have to treat with a pesticide. She explained the importance of educating the public so they can save their trees. Councilman Leibowitz asked what the cost of treating a tree would be; Mrs. DiPasquale answered it would cost $5.00 per inch of the diameter of the tree. Council President Koppel added that she would like a copy of the Emerald Ash Borer flyer to be posted on the Township website.
