COUNCIL OF THE TOWNSHIP OF MONROE MINUTES 

AGENDA MEETING  MARCH 31, 2014

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for an Agenda Meeting. 

The Agenda Meeting was Called to Order at 7:00 p.m. by Council President Gerald W. Tamburro with a Salute to the Flag.   

 

UPON ROLL CALL by Township Clerk, Sharon Doerfler, the following members of Council were present: Councilman Stephen Dalina, Councilman Michael Leibowitz, Councilwoman Elizabeth Schneider, Council Vice-President Leslie Koppel and Council President Gerald W. Tamburro. 

ALSO PRESENT for Council:  Mayor Richard Pucci, Business Administrator Wayne R. Hamilton, Attorney Kevin Boris, sitting in for Township Attorney Joel L. Shain, and Engineer Mark Rasimowicz. 

There were approximately fifteen (15) members of the Public present in the audience.

ABSENT from this meeting was Township Attorney Joel L. Shain.  

Council President Tamburro requested the Township Clerk to read the following SUNSHINE LAW into the record: 

 

In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the Minutes of this meeting that adequate notice of this meeting has been provided by the following: 

1.Posted on January 3, 2014 on the Bulletin Board of the Office of the Township Clerk in the Municipal Building, 1 Municipal Plaza and remains posted at that location for public inspection;

3.Posted on the Bulletin Boards within the Municipal Complex;

In accordance with Chapter 3, Section 17 of the Monroe Township Code, Public Comment shall be limited to five (5) minutes unless further time is granted by the Council Vice-President. 

 

The following PROCLAMATIONS of Mayor Richard Pucci were read into the record: 

 

APRIL – AUTISM AWARENESS MONTH 

April 2, 2014 – World Autism Awareness Day 

 

Council President Tamburro read the following entitled ORDINANCES for SECOND READING  at the MONDAYAPRIL 7, 2014 Regular Council Meeting: 

 

a.ORDINANCE ACCEPTING A WATER MAIN EASEMENT FROM TOLL NJ II, LP ON A PORTION OF LOT 1 (NEW PROPOSED LOT 1.10) IN BLOCK 16.   

 

b.ORDINANCE FURTHER AMENDING CHAPTER 108 OF THE CODE OF THE TOWNSHIP OF MONROE ENTITLED, “LAND DEVELOPMENT”. (If adopted, will delete Extended  Intermediate & Long Term Care facilities as Conditional Uses from the R20, R30 & RRFLP zones & eliminate Hospitals as Conditional Uses in the RRFLP zones)

Council President Tamburro read the following entitled ORDINANCES for INTRODUCTION at the MONDAYAPRIL 7, 2014 Regular Council Meeting: 

 

  1. ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK. 

 

b.ORDINANCE AMENDING CHAPTER 78 THEREOF ENTITLED “PERSONNEL POLICIES AND PROCEDURES” 

 

c.ORDINANCE AMENDING CHAPTER 39 THEREOF ENTITLED “FEES”. 

 

 

Council President Tamburro requested the following entitled RESOLUTIONS for  CONSIDERATION at the MONDAY, APRIL 7, 2014 Regular Council Meeting be reviewed and any questions will be addressed: 

 

  1. RESOLUTION AUTHORIZING MODIFICATION TO THE CALCULATION OF THE TAX COLLECTION RATE. 

 

  1. RESOLUTION INTRODUCING THE 2014 MUNICIPAL BUDGET. 

 

  1. RESOLUTION PROVIDING THAT THE 2014 MUNICIPAL BUDGET BE READ BY TITLE AT THE TIME OF THE PUBLIC HEARING. 

 

  1. RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH INTERNATIONAL FIREWORKS MANUFACTURING COMPANY.  (July 4th Fireworks Display in Thompson Park - $16,000) 

 

  1. RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE AN AGREEMENT WITH INSURANCE DESIGN ADMINISTRATORS. 

 

  1. RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE A SHARED SERVICES AGREEMENT BETWEEN THE TOWNSHIP OF MONROE AND THE COUNTY OF MIDDLESEX, DIVISION OF SOLID WASTE MANAGEMENT FOR THE E-WASTE SUBSIDY PROGRAM. 

 

  1. RESOLUTION PROVIDING ADVICE AND CONSENT TO THE APPOINTMENT OF MEMBER TO THE LIBRARY BOARD OF TRUSTEES.   

 

  1. RESOLUTION AUTHORIZING AWARD OF A PROFESSIONAL SERVICES CONTRACT TO TIMOTHY HOFFMAN REAL ESTATE APPRAISERS, INC. FOR APPRAISAL SERVICES RELATED TO BLOCK 27.02, LOTS 17.01, 17.02, 18.04 AND 18.05.  

 

  1. RESOLUTION AUTHORIZING AMENDMENT TO A GRANT AGREEMENT BETWEEN THE COUNTY OF MIDDLESEX, DEPARTMENT OF HUMAN SERVICES AND THE TOWNSHIP OF MONROE, OFFICE ON AGING FOR OUTREACH SERVICES. 

 

  1. RESOLUTION REFUNDING TAX OVERPAYMENTS. 

 

  1. RESOLUTION REFUNDING THIRD PARTY TAX LIEN PREMIUM PAYMENTS. 

 

  1. RESOLUTION AUTHORIZING THE PURCHASE OF UPGRADED RADIO EQUIPMENT FOR THE MONROE TOWNSHIP EMS UNDER THE STATE OF NEW JERSEY COOPERATIVE PURCHASING PROGRAM.

  1. RESOLUTION AUTHORIZING ASSIGNMENT OF TOWNSHIP TAX LIEN NO. 92-00220 (BLOCK 106.89, LOT 31) TO LUCILLE DiPASQUALE. 

 

  1. RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE AN AGREEMENT BY AND BETWEEN FRANCIS E. PARKER MEMORIAL HOME, INC.   1. RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK TO EXECUTE AN AGREEMENT BY AND BETWEEN THE TOWNSHIP OF MONROE AND USGOVBID FOR THE SALE OF SURPLUS PERSONAL PROPERTY NO LONGER NEEDED FOR PUBLIC USE ON AN ON-LINE AUCTION WEBSITE. 

 

  1. RESOLUTION AUTHORIZING THE PURCHASE OF TWO VEHICLES UNDER THE STATE OF NEW JERSEY COOPERATIVE PURCHASING PROGRAM FOR THE MONROE TOWNSHIP POLICE DEPARTMENT.

  1. RESOLUTION AUTHORIZING THE PURCHASE OF TWO VEHICLES UNDER THE STATE OF NEW JERSEY COOPERATIVE PURCHASING PROGRAM FOR THE MONROE TOWNSHIP POLICE DEPARTMENT.

  1. RESOLUTION AUTHORIZING THE DISCHARGE OF AFFORDING HOUSING LIEN GIVEN BY JAMES DWYER ON 1145 MORNING GLORY DRIVE. 

 

  1. RESOLUTION RESCINDING RESOLUTION NO. R-3-2014-074 AUTHORIZING THE PURCHASE OF A VEHICLE UNDER STATE CONTRACT NO. A83777, HAVING NOW EXPIRED, AND AUTHORIZING THE PURCHASE OF A VEHICLE FROM AN APPROVED VENDOR UNDER THE STATE COOPERATIVE PURCHASING PROGRAM. 

 

  1. RESOLUTION AUTHORIZING AWARD OF CONTRACT TO LEGGETTE, BRASHEARS & GRAHAM, INC. FOR GENERAL HYDRO-GEOLOGICAL CONSULTING SERVICES FOR THE MONROE TOWNSHIP UTILITY DEPARTMENT (“M.T.U.D.”)

  1. RESOLUTION AUTHORIZING THE APPROVAL OF CHANGE ORDER NO. 2 SUBMITTED BY DeMAIO ELECTRICAL COMPANY, INC. FOR CONTRACT 402 – “ASHMALL AVENUE PUMP STATION #7 IMPROVEMENTS” FOR THE MONROE TOWNSHIP UTILITY DEPARTMENT (“M.T.U.D.”). 

 

 

 

Mayor’s Report:  No Report 

 

 

Administrator’s Report:  Administrator Hamilton gave an update on the Shopping Center at the corner of Texas Rd & Spotswood-Englishtown Rd.  The Construction Department has issued construction permits about 3 weeks ago.  Tomorrow, remediation of the southern commercial building will begin and hopefully the property owners and the contractor will be finished with the remedial work in that building and have some of the tenants moving back in by the end of the month.  The other building is more involved and there is no time-frame on that one. 

 

Engineer’s:  No Report 

 

 

Council Reports: 

 

Councilman Leibowitz was glad to be back after being sick.  He also mentioned that he had read in the newspaper about a Town Council being sued for texting at a meeting.  So, there will be no texting at any meetings. 

 

 

Councilman Dalina – Advised that the Library will be celebrating its 25th Anniversary with a Gala Event at the Forsgate Country Club this Friday at 6pm.    

 

Softball Opening day will be April 12th and Baseballs Opening day will be April 5th. 

 

On April 12th there will be an Egg Hunt at the Community Center. 

 

Councilwoman Schneider – No Report 

 

 

Council Vice-President Koppel – reported on two upcoming events for Cultural Arts, St. Peter by the Sea is producing - “Once Upon an Opera” on Sat. April 26th at 7pm.  All Cultural Arts events are free to students.   Also coming is the Atlantic City Ballet “Dracula” on Sat., May 3rd and on June 7th there will be Argentine Musicians at the Monroe Township High School.  The Series in the Park will be on Thursday evenings starting this summer. 

 

Council President Tamburro – No Report 

 

 

Public: 

 

Gary Busman, 7 Monarch Rd.  Questioned Item #8.w. – An agreement between the Twp. and USGOVBID for the sale of surplus property no longer needed at an on-line auction, asking for an explanation.  

 

Administrator Hamilton explained the process and Tim Stoessler from the M.T.U.D. gave some examples of the type of equipment that would be auctioned i.e., pumps, motors etc. 

 

Audrey Cornish, Schoolhouse Rd. – Questioned Item #8.bbasking the regulations regarding the lighting at the Francis Parker Memorial Home, example – length of time on, etc. 

 

Council President Tamburro asked Engineer Rasimowicz if he knew if there were any conditions put on the lighting at the Parker House facility and Engineer Rasimowicz stated he was not aware of any conditions but will look into it further.

Her concern is for her thoroughbred pregnant horses, which are very sensitive to outside stimulus and the possibility of an expansion of that facility. 

 

Council President Tamburro stated Engineer Rasimowicz will look into it further as to whether there were any conditions or restrictions placed on the outside light at the facility.
