COUNCIL OF THE TOWNSHIP OF MONROEMINUTES

REGULAR MEETING -JUNE 4, 2014

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for a Regular Meeting.

The Regular Meeting was Called to Order at 7:00 p.m. by Council President Gerald W. Tamburro.  He asked everyone to join Tara Pietrulewicz and Ari Nair as they lead everyone in the Salute to the Flag.

UPON ROLL CALL by the Township Clerk, Sharon Doerfler, the following members of Council were present: Councilman Stephen Dalina, Councilman Michael Leibowitz, Councilwoman Elizabeth Schneider, Council Vice-President Koppel and Council President Gerald W. Tamburro.

ALSO PRESENT for Council:  Mayor Richard Pucci, Business Administrator Wayne R. Hamilton, Township Attorney Joel L. Shain and Engineer Mark Rasimowicz.

There were approximately one hundred forty (140) members of the Public present in the audience.

Council President Tamburro requested the Township Clerk to read the following SUNSHINE LAW into the record:

In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the Minutes of this meeting that adequate notice of this meeting has been provided by the following:

1.Posted on January 3, 2014 on the Bulletin Board of the Office of the Township Clerk in the Municipal Building, 1 Municipal Plaza and remains posted at that location for public inspection;

2.Printed in the HOME NEWS TRIBUNE and CRANBURY PRESS on January 3, 2014; 

3.Posted on the Bulletin Boards within the Municipal Complex; 

4.Posted on the Monroe Township website; and

5.Sent to those individuals who have requested personal notice.

In accordance with Chapter 3, Section 17 of the Monroe Township Code, Public Comment shall be limited to five (5) minutes unless further time is granted by the Council President.

Council President Tamburro opened the Annual Human Relations Commission Ceremony honoring and presenting Awards to those students who have been selected by their teachers as exemplifying the 6 Pillars of Character:  caring, responsibility, respect, fairness, citizenship and trustworthiness.  

Council President Tamburro then turned the Program over to Councilwoman Elizabeth Schneider who introduced Sergeant Lisa Robinson, Chair of the Human Relations Commission. 

Sergeant Robinson thanked everyone for coming out tonight, parents, relatives and friends who have come out to support these outstanding students who have shown and exemplified the six pillars of character.  She also thanked the Mayor and Council for being given the opportunity to have this Program with the Human Relations Commission members.  She thanked Principals, Teachers and Parents for the continued dedication for empowering our students to become honest, respectful, responsible and caring citizens.  She asked that the Award recipients continue to work on developing their good character, to become outstanding citizens and our future leaders.

Mayor Pucci thanked the Human Relations Commission for their outstanding efforts throughout the year.   He also added that to the winners, this is a very special Award and one they will not forget.  

Councilwoman Schneider and Council Vice-President Koppel helped Sergeant Robinson with handing out the Awards.

UPON MOTION made by Councilman Dalina and seconded by Councilman Leibowitz, an Ordinance of which the following is the title was moved on second read for final passage: ORDINANCE RELEASING, VACATING AND EXTINGUISHING ANY AND ALL PUBLIC RIGHTS IN AND TO PORTIONS OF FULTON STREET AND LIBERTY STREET.

ORDINANCE as follows: (O-6-2014-008)

WHEREAS, application has been made By Gary Hipko, on behalf of Renaissance Properties, Inc., t/a Old Forge Land Holdings, LLC for the passage of an Ordinance vacating, releasing and extinguishing the public rights in and to certain portions of Fulton Street and Liberty Street, as shown on Tax Map Sheet No. 83.02 and as more particularly described in the Metes and Bounds Descriptions prepared by FWA Associates, P.A.., a copy of which is attached hereto as Exhibit “A”; and

WHEREAS, the Township Engineer has reviewed said application and per his letter dated April 2, 2014, attached hereto as Exhibit “B”, recommends the Township move forward with the request provided it is in conformance with the plans submitted for Minor Subdivision Application PB-1144-13 and subject to the creation of an easement protecting the existing drainage improvements at the intersection of Cottonwood Court and Liberty Street; and

                                                                                                                        

WHEREAS, the Monroe Township Utilities Department (“M.T.U.D.”) has reviewed said application for street vacation and per letter dated January 23, 2014, attached hereto as Exhibit “C”, has no objections to the granting of this vacation; and   

WHEREAS, the Township Council of the Township of Monroe is of the opinion that the public interest will best be served by vacating and releasing the public rights in said portions of Fulton Street and Liberty Street; 

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Monroe, County of Middlesex and State of New Jersey as follows:

1.The public rights and interests in the portions of Fulton and Liberty Streets, as described in attached Exhibit "A", are hereby released, vacated and extinguished.

  1. Pursuant to N.J.S.A. 40:67-1, the following described rights of public utilities and cable television companies are hereby expressly reserved and accepted from this vacation.  All rights and privileges possessed at the time of the adoption of this Ordinance by public utilities, as defined in R.S. 48:2-13, and by any cable television company, as defined in the “Cable Television Act”, P.L. 1972, c. 186 (C.48:5A-1, etseq) to maintain, repair and replace their existing facilities in, adjacent to, over or under the street, highway, lane, alley, square, place or park, or any part thereof, to be vacated. 

3.The Township’s Certified Municipal Finance Officer is hereby authorized to draw a check in the sum of $11.00 payable to the Middlesex County Clerk, and upon receipt of same, the Township Clerk shall thereupon file a certified copy of this Ordinance in the Office of the Middlesex County Clerk.

4.This Ordinance shall become effective twenty days after final passage and publication according to law.

Council President Tamburro opened the Public Hearing to Council and Public discussion of this Ordinance.

Councilman Dalina – announced that Mikey Nichols was unable to come home today as originally planned.  He possibly will be coming home tomorrow. 

He gave an update on the re-construction being done on Mikey’s home.

He also thanked Mike Barnes and the Utility Department for working with Boy Scout Troop# 50.  They went out on Saturday and painted some of the neighborhood fire hydrants.

Council President Tamburrocomplimented the Clerk’s Office on all their work for the Primary Election.

Public:

Charles Petretti, Concordia – asked for an update on the Traffic Light on Union Valley-Half Acre Rd.

Engineer Rasimowicz explained that it is presently at the County.  The County is doing a design of that intersection.  There are environmental Issues on the corners which they are discussing with the DEP as well as the property takings.  

Next, Mr. Petretti questioned Item#15.e. Raffle License Refund which Council President Tamburro explained was a refund of an overpayment.

He then asked about the barren trees at the Senior Center – Administrator Hamilton explained that we are presently in arbitration with the general contractor.  There are many punch-list items that are still remaining.  We expect to have the mediation process finished by the end of July.  At that point, if settlement is reached, we can have the punch-list items addressed, which includes the tree plantings.

Mr. Petretti also mentioned that some of the trees on Centre Drive, in which the Township planted, are dead.

He next asked if there was a water increase being considered and Council President Tamburro explained that annually the rates need to be adjusted.   Mike Barnes, MTUD Director, further explained that only the connection fees went up.  The fees went up for everything, but, by law, we have to adjust the rates based on value and number of connections annually.

Mr. Petretti then asked about Well#22 and MTUD Director, Mike Barnes, explained that it was taken out of service and they are now putting treatment on it and it will deliver 1.7 million gallons of additional water supply.

He next questioned Item#15.qReceipt of proposals for independent supervised living facilities and Council President Tamburro explained that in order to preserve our Affordable Housing money, the Dept. of Community Affairs require that we place three (3) Group Homes in the Township.  These homes would be for people with special needs.  One home has been completed and we are now soliciting bids for two additional homes.

Hy Grossman, 15 Doral Drive finds himself in agreement with Councilman Leibowitz on the fracking issue.

He then asked about this yearCapital Improvement Programasking if items #12 & 13 on the Agenda will take care of this year's requirements.  Administrator Hamilton confirmed that Ordinances#12 & 13 are the roll-out and funding of all capital improvements listed as part of the Capital Budget for both the Utility and the General Budget.

Mr. Grossman next questioned Item#15.h. – Extended Sick Leave which Administrator Hamilton explained.

He next questioned Item#15.r. – Professional Service Contract awarded to Utility Service Affiliates, Inc. and Administrator Hamilton explained this is the company that employs Mr. Barnes.  It’s a Management Contract with proper licensing and Ancillary Services that have assisted us in the running of the Utility Department.  

Mr. Grossman asked the status of the cautionary signs he recommended on Spotswood-Englishtown Rd. and Route 522.  Engineer Rasimowicz stated they are still pursuing this with Middlesex County and the Road Dept.  They are looking to put up the advance warning signs to the driveways.

Audrey Cornish, Schoolhouse Rd. – stated that after she received the notice that Parker House was going to proceed with information from the DEP about the property next door, she requested from the DEP a copy of their findings, asking if the township is proceeding with them regarding the buffer zones before they receive their money.  Engineer Rasimowicz explained that there is still a Performance Bond in place.  They must meet all requirements on their site plan approval.  

She then mentioned the water run-off from Heritage Chase directly onto Parker House and advised that she allowed the previous owner to put in underground drains to drain the water run-off onto her property but that she will not allow Parker House to do the same.

Engineer Rasimowicz reminded everyone that the adjacent property has no application before the Township Planning or Zoning Boards.  They just have an application into the State.  All the testing done on the site and the surveys are not things under review by the Township.  If something comesbefore one of the Boards, then certainly it will be taken into account and noted.
