COUNCIL OF THE TOWNSHIP OF MONROMINUTES 

SPECIAL & AGENDA MEETING – DECEMBER 29, 2014  

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for Special and Agenda Meetings. 

The Special Meeting was Called to Order at 7:00 p.m. by Council President Gerald W. Tamburro with a Salute to the Flag lead by grandson Grant and grand-daughter Caroline Kinsey. 

 

UPON ROLL CALL by Township Clerk, Sharon Doerfler, the following members of Council were present: Councilman Stephen Dalina, Councilman Michael Leibowitz, Councilwoman Elizabeth Schneider, Council Vice-President Leslie Koppel, and Council President Gerald W. Tamburro. 

ALSO PRESENT for Council:  Business Administrator Wayne R. Hamilton, Township Attorney Joel L. Shain, and Township Engineer Mark Rasimowicz. 

ABSENT:Mayor Richard Pucci 

There were approximately ten (10) members of the Public present in the audience. 

 

Council President Tamburro requested the following SUNSHINE LAW be read into the record: 

 

In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the Minutes of this meeting that adequate notice of this meeting has been provided by the following: 

 

1.Posted on January 3, 2014 on the Bulletin Board of the Office of the Township Clerk in the Municipal Building, 1 Municipal Plaza and remains posted at that location for public inspection; 

2.Communicated to the HOME NEWS TRIBUNE  and CRANBURY PRESS January 32013 

3.Posted on the Bulletin Boards within the Municipal Complex;

5.Sent to those individuals who have requested personal notice. 

In accordance with Chapter 3, Section 17 of the Monroe Township Code, Public Comment shall be limited to five (5) minutes unless further time is granted by the Council President. 

 

Council President Tamburro announced the Special Meeting is being Called to Order for the purpose of addressing the payment of year-end Claims, conducting Public Hearings on four (4) Second Reading Ordinances for final adoption, Consideration of various Resolutions and any other business that may come before the Council.  The regularly scheduled Agenda Meeting will immediately follow.

UPON MOTION made by Council Vice-President Koppel and seconded by Councilman Leibowitz, an Ordinance of which the following is the title was moved on Second Reading for final passage: ORDINANCE ACCEPTING A DEED OF DEDICATION FROM LUCILLE AND ANTHONY DiPASQUALE FOR LOTS 13, 20, 23 AND 24 IN BLOCK 106.50 AND LOT 54 IN BLOCK 106.91. 

 

 

ORDINANCE as follows: (O-12-2014-033) 

 

WHEREAS, Lucille and Anthony DiPasquale received Final Major Subdivision Approval, Application PB-1143-13, on January 23, 2014, and memorialized on February 27, 2014 for property identified as Block 109.15, Lots 17-22; Block 106.50, Lots 13, 20, 23 and 24 and Block 106.91, Lot 54 located on Duchess Drive, McKinley Street, Rossini Street, Umberto Avenue, Columbus Avenue and Manalapan Avenue; and 

 

WHEREAS, the Final Major Subdivision Approval was granted conditioned upon the dedication to the township of the non-contiguous tracts of land known as Lots 13, 20, 23 and 24 in Block 106.50 and Lot 54 in Block 106.91 (the “Dedication Lots”); and 

 

WHEREAS, the Dedication Lots are owned by Lucille DiPasquale; and 

 

WHEREAS, Lucille and Anthony DiPasquale have agreed to dedicate the aforementioned parcels of land to the Township of Monroe; and 

 

WHEREAS, the Township Engineer has reviewed the attached metes and bounds description in the Deed of Dedication and has found same to be in conformity with the Planning Board approval and hereby recommends acceptance of the Deed of Dedication; and 

 

WHEREAS, the Township Council has, after consultation with its legal and engineering professionals, determined that it is in the public interest to accept the Deed of Dedication from Lucille and Anthony DiPasquale; and 

 

WHEREAS, Township Counsel has reviewed the Deed of Dedication and has found same to be legally sufficient; 

 

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Township of Monroe, in the County of Middlesex, State of New Jersey as follows: 

 

SECTION 1.The Mayor, Township Clerk and Township Attorney are hereby authorized and directed to take all steps and execute any documents which are reasonably necessary to accept the Deed of Dedication from Lucille DiPasquale. 

 

SECTION 2.All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. 

 

SECTION 3.If any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subsection, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective. 

 

SECTION 4.This Ordinance shall take effect upon final passage and publication as provided by law. 

 

SO ORDAINED, as aforesaid.

ORDINANCE as follows: (O-12-2014-034) 

 

BE IT ORDAINED by the Council of the Township of Monroe, County of Middlesex, State of New Jersey that Chapter 39 of the Code of the Township of Monroe is hereby amended and supplemented as follows:  

 

SECTION 1. 

 

Section 39-3.Fees enumerated. 

 

The following fees shall be charged by the township for services rendered or licenses or permits issued.  All license fees shall be annual unless otherwise noted. 

 

A.General Fees. 

 

(5)Division of Ambulance Service. 

 

(b)Ambulance Third-Party Billing Fees.

SECTION 2.  All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance shall be and the same are hereby repealed. 

 

SECTION 3.  If any section paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the sections, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective. 

 

SECTION 4.  This Ordinance shall take effect twenty (20) days after adoption and publication according to law.

UPON MOTION made by Councilwoman Schneider and seconded by Councilman Dalina, an Ordinance of which the following is the title was moved on Second Reading for final passage: ORDINANCE GRANTING AUTHORITY TO THE MONROE TOWNSHIP BUSINESS ADMINISTRATOR TO ENTER INTO LIMITED INSTALLMENT AGREEMENTS FOR THE PAYMENT OF WATER AND SANITARY SEWER CONNECTION FEES. 

 

 

ORDINANCE as follows: (O-12-2014-036) 

 

WHEREAS, Residents of the Township of Monroe are required to connect to the Township’s water and sanitary sewer systems when those services become available; and  

 

WHEREAS, Residents are required to pay to the Township connection fees for those services; and 

 

WHEREAS, the lump sum payment of connection fees may cause some Residents of the Township an undue economic hardship; and 

 

WHEREAS, the Township desires to reduce the economic burden of its Residents by granting the Township’s Utility Department the authority to enter into installment payment plans not to exceed sixty (60) months with Township residents who owe less than Five Thousand Dollars ($5,000.00) in sanitary sewer and water connection fees; and 

 

WHEREAS, the Township Council has determined that the Business Administrator for the Township of Monroe shall be authorized by the Township to review and approve installment payment plans; 

 

NOW, THEREFORE, BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF MONROE, IN THE COUNTY OF MIDDLESEX AND STATE OF NEW JERSEY AS FOLLOWS: 

 

  1. The Monroe Township Business Administrator is hereby authorized to enter into an installment agreement with any owner of real property in the Township of Monroe to pay sanitary sewer and water service connection fees in installments for a period not to exceed sixty (60) months where those fees, in aggregate, are less than Five Thousand Dollars ($5,000.00), .   

 

  1. All agreements entered into by the Monroe Township Utility Department, pursuant to this Ordinance, shall set forth in the agreement an interest rate accruing on the outstanding balance in an amount not more than the annual interest rate, or less than one percent (1%) below the annual interest rate, charged by the MONROE TOWNSHIP UTILITY DEPARTMENT for delinquent accounts. 

 

  1. Where the MONROE TOWNSHIP UTILITY DEPARTMENT has entered into an installment agreement, pursuant to this Ordinance, but owner has failed to make timely payments pursuant to the agreement, the unpaid balance and accrued interest shall be a lien on the owner’s real property.  

 

  1. The Business Administrator for the Township of Monroe is authorized to execute, on behalf of the Township of Monroe, installment agreements complying with this Ordinance. 

 

  1. Amounts in excess of Five Thousand Dollars ($5,000.00) shall require approval of the Monroe Township Council. 

 

NOW, THEREFORE, BE IT FURTHER ORDAINED that if any section, subdivision, sentence, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective; and 

 

BE IT FURTHER ORDAINED, this Ordinance shall take effect upon final passage and publication, as provided by law.

Council President Tamburro asked the Business Administrator Hamilton to update everyone on the Resolutions. 

 

Administrator Hamilton explained that the majority of the Resolutions are Requests for Qualifications (“RFQ’s”) – annual professional service contracts that the Township enters into after an advertised RFQ process.  Proposals are received and qualifications are reviewed and a selection is based on a certain criteria.  This is the end of that process.   

 

Council President Tamburro asked if anyone on the Council or Public had any questions on the resolutions.

Administrator Hamilton – Regarding Item #11.tt. on the Agenda – Resolution Canceling Emergency Appropriation Balance – he explained that before the revaluation was done we appropriated approximately $2 million dollars.  This Resolution will cancel $632,000.00 of that $2 million and will decrease the last 2 yrs. of payments which will have a positive impact in the budget. 

 

 

He further advised that we are in the process of finishing labor contracts for white and blue collar unions which will result in putting together Salary Ordinance Introductions for those two unions and a Memorandum of Understanding Ratification at the end of the month. 

 

 

He wished everyone a Happy & Healthy New Year.

COUNCIL REPORTS: 

 

Council President Tamburro – Introduced his grandchildren, Grant and Carolina Kinsey, in attendance at the meeting this evening.  He stated that his grandson Grant is involved with the San Juan Capistrano Mayors Advisory Board. 

 

Grant & Caroline attended Grandparents Day today along with 600 other Grandparents & Grandchildren.  It was the largest Grandparents Day to date. 

 

He commended those involved for a great job in organizing the event. 

 

Councilman Leibowitz – Hoped everyone had a wonderful Chanukah and Christmas and wished everyone a Safe and Happy New Year. 

 

Councilman Dalina – Wished everyone a Happy New Year. 

 

Councilwoman Schneider – Attended her first Grandparents Day and was very impressed.  She thanked the High School Key Club for all their help throughout the day.   

 

Council President Tamburro  mentioned that The Gardens at Monroe pays for all the food, gifts and prizes and the town provides the movie tickets and buses.
