MINUTES OF REGULAR MEETING

July 28, 2020

Meeting called to order at 7:00 P.M. by Vice Chairman Vincent LaFata who led the salute to the Flag.

Vice Chairman Vincent LaFata read the Sunshine Law as follows: In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the minutes of this meeting that adequate notice of this meeting has been provided by the following:

Posted on January 6, 2017 on the Bulletin Board of the Office of the Township Clerk, Municipal Complex, 1 Municipal Plaza, and remains on file at that location for public inspection;

Posted on the Bulletin Board of the Office of the Township Clerk;

MEMBERS PRESENT:     Vice Chairman Vincent LaFata, Mr. Marino Lupo, Mr. Louis Masters, Mr. Michael Maiolo,  Mr. Gary Busman, Alternate #1 Ms. Rajani Karuturi, Alternate#2 Mr. Donato Tanzi, Alternate #3 Mr. Richard Lans and Alternate #4 Mr. Arnold Jaffe.  Also present for the Board were Attorney Mark Moon, Planner Mark Remsa, Engineer Mark Rasimowicz and Director of Planning & Zoning Mr. Joe Stroin.

MEMBERS ABSENT:        Chairwoman Carol Damiani.

A motion to approve the February 25, 2020 Minutes made by Mr. Gary Busman and seconded by Mr. Michael Maiolo and passed unanimously by all members present.

 

 

 

BA-5178-19                          Dementia Home Care, LLC; Request for Use Variance with Bulk Variances; Block 42, Lot 7.02 located at 188 Prospect Plains Road R-30 (Residential) Zone

Carried without additional notice to the August 25, 2020 regular meeting. 

BA-5188-20              PDC Atlanta, LLC; Request for Preliminary and Final Site Plan;

Block 82, Lot 3.01 located on Cranbury South River Road, Docks Corner Road and Rhode Hall Road in the R-30 (Residential) Zone

Carried without additional notice to the August 25, 2020 regular meeting. 

BA-5186-20                          Estate of Maria Cegielka by Tibor Hetenyi, Executor; Request for Bulk Variance; Block 160.20, Lot 29.01located at 349 Spotswood Englishtown Road in the NC (Neighborhood Commercial) Zone (with previous approval for R-10 Zone)

                                   

Represented by Mr. Jared Pape who stated this application is a minor bulk variance application to ask for a variance relief for an existing setback.  The property is located at 349 Spotswood Englishtown Road, known as Block 160.20, Lot 29.01 in the NC Zone.  We are seeking variance for lot width, lot frontage, sideyard setback for principal and accessory structures.

Mr. Matthew Wilder, applicant’s Engineer stated the variances are existing and arise from a boundary overlap.  To rectify this we are planning on filing a deed to correct the overlap and seek relief for the variances.  We agree to the Board’s professional reports.

Mr. Mark Rasimowicz, Board Engineer, has no objections subject to applicant’s compliance with report dated July 15, 2020.

Mr. Mark Remsa, Board Planner, has no objections subject to applicant’s compliance with report dated March 4, 2020.

Motion to approve made by Mr. Marino Lupo and seconded by Vice Chairman Vincent LaFata and passed unanimously by all members of the Board present.

 

 

BA-5177-19                          Goldy’s Cream, Inc.; Request for Preliminary and Final Site Plan; Block 36, Lot 33 located at 510 Englishtown Road in the NC (Neighborhood Commercial) Zone

MEMORIALIZATION

No resolutions to be adopted.

DISCUSSION

A motion to approve request for additional funds for Attorney in the matter known as Black Rock Enterprises, LLC and Stanley Olbrys, as Executor of the Estate of Eleanor Olbrys  vs. Monroe Township Zoning Board made by Mr. Donato Tanzi and seconded by Mr. Michael Maiolo and passed unanimously by all members of the Board present.

A motion to approve request for additional funds for Attorney in the matter known as CT07 SPII, LLC and DT07 SPII, LLC vs. Monroe Township Zoning Board made by Mr. Donato Tanzi and seconded by Mr. Gary Busman and passed unanimously by all members of the Board present.
