TOWNSHIP OF MONROE COUNCIL MEETING MINUTES 

SPECIAL & AGENDA MEETING – OCTOBER 30, 2017 

 

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for a Special & Agenda Meeting. 

The Special & Agenda Meeting was Called to Order at 7:00 p.m. by Council President Stephen Dalina with a Salute to the Flag. 

 

UPON ROLL CALL by the Township Clerk, Patricia Reid, the following members of Council were present: Councilwoman Miriam Cohen, Councilman Michael Leibowitz, Council Vice-President Elizabeth Schneider and Council President Stephen Dalina. 

ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Alan M. Weinberg, Township Attorney Joel Shain, Engineer Mark Rasimowicz and Deputy Township Clerk Christine Robbins. 

There were approximately thirty (30) members of the Public present in the audience. 

 

Council President Dalina requested the Township Clerk to read the following SUNSHINE LAW into the record: 

In accordance with the Open Public Meetings Act, it is hereby announced and shall be entered into the Minutes of this meeting that adequate has been provided by the following: 

1.Posted on the Bulletin Boards within the Municipal Building on October 27, 2017 and remains posted at that location for public inspection; 

2.Printed in the HOME NEWS TRIBUNE and CRANBURY PRESS on January 6, 2017; Special Meeting noticed to the HOME NEWS TRIBUNE and CRANBURY PRESS on October 26, 2017. 

3.Posted on the Monroe Township website; and 

4.Sent to those individuals who have requested personal notice. 

In accordance with Chapter 3, Section 17 of the Monroe Township Code, Public Comment shall  

be limited to five (5) minutes unless further time is granted by the Council President. 

 

Council President Dalina announced the Special Meeting is being held for conducting an appeal  

hearing for denied solicitor’s permit and any other business that may come before the Council.   

The regularly scheduled Agenda Meeting will immediately follow. 

 

Council President Dalina announced that we are here for an Appeal Hearing for a Denial of a  

Peddling and Soliciting Permit, in accordance with Monroe Township Code, Chapter 77-9 entitled  

“Appeal from denial or revocation of certificate”. He also clarified that the hearing was not open  

for public discussion. He asked Township Clerk Patricia Reid to put the following documents into  

evidence: 

  • Application received from Mr. Trager on September 15, 2017 
  • Memo dated September 15, 2017 to Chief Lloyd from Township Clerk, Patricia Reid, requesting review of the application.  
  • Memo dated September 21, 2017 to Township Clerk, Patricia Reid, from Chief Lloyd denying the application.  
  • Letter dated September 19, 2017 addressed to Mr. Trager from Chief Lloyd, notifying Mr. Trager of his denial and the reasons.  
  • Letter from Mr. Trager received on October 3, 2017 requesting an appeal hearing for his denial.  
  • Letter dated October 13, 2017 to Mr. Trager from Township Clerk, Patricia Reid, advising him of his appeal hearing date of October 30, 2017 

 

Council President Dalina asked Mr. Trager to please come forward and for the Township Clerk,  

Patricia Reid to swear in Mr. Trager. 

 

Township Clerk, Patricia Reid directed Mr. Trager to place his left hand on the bible and raise his  

right hand, then asking, (verbatim) “Do you Howard Trager solemnly swear to tell the truth, the  

whole truth and nothing but the truth, so help you God?” 

 

Mr. Trager(verbatim) “I do”. 

 

Council President Dalina directed Mr. Trager to take a seat and advised him that at this time he is  

being asked to tell the Council as to why his denial should be reversed also advising him that after  

his testimony the Council may have some questions.  

 

Mr. Trager(verbatim) I’m a resident of Monroe for the last seven years. I had a job doing sales  

and just recently was hired by a company called Vivant Solar. They gave me a territory to go out  

and solicit, I have never done any soliciting on my own or have gone door to door in my life so I  

had no idea what was required or what was necessary, and they didn’t bother telling me either. I  

had done soliciting that day and I’d gone to a person’s house soliciting and the woman told me,  

she was an Indian woman, she told me to come back when her husband was home, and I said fine.  

I continued to solicit homes in the neighborhood and as I was leaving the neighborhood I saw the  

husband return home, so I figured that would be the perfect opportunity to come back. So, I came  

back to the house and knocked on the door, the husband answered the door and said we’re not  

interested, I’m terribly sorry so I left. I went back to my car and was doing some paperwork on my  

iPad when the police officer approached me and knocked on my window.  I was visibly scared I  

didn’t know what was going on cause I was just doing my work, he asked me if I was soliciting  

in the area and I said that I had been soliciting and he said well you had a complaint from this  

woman right here; I said, well she told me, what I assumed, was an appointment to come back  

when her husband was home so that’s what I did when I saw that the husband came home so I took  

it as an appointment, not that I was soliciting the house again for a second time. The woman didn’t  

speak good English I should have not gone back based on that, but I did tell the officer that I was  

soliciting, and I had been soliciting cause I was wearing a yellow vest but I was visibly nervous,  

visibly shaken as far as being stopped for something I thought was okay. He didn’t bother to tell  

me that I needed a permit, he did tell me afterwards that I needed a permit, but he kept harassing  

me, not harassing me but telling me you’re lying to me, you’re lying to me, and I said no, I went  

back to the persons house; they said you didn’t have an appointment and I took it as going back  

to when the husband was home, as for me, an appointment and that was the whole bone of  

contention and the officer said I lied to him and thus my assuming why my permit was denied. It’s  

my only way of making a living right now so it’s vital I have a soliciting permit to be able to do  

my job and make a living for my family 

 

Council President Dalina asked if anyone from the Council had any questions for Mr. Trager. 

 

Councilman Leibowitz: (verbatim) “I had a question, but you’ve answered that and that was if you  

were in sales previously I was going to ask you about that but is this the only place you’re allowed  

to sell for that company?  

 

Mr. Trager: (verbatim) This is the only area they gave me to sell. This is the only area I can  

work 

 

Councilman Leibowitz: (verbatim) “And you want to work for a company that doesn’t provide  

you the proper guidance? I was in sales for forty years, so I understand (inaudible) 

 

Mr. Trager: (verbatim) I’ve never worked for a company that doesn’t tell you ahead of time what  

is expected and what’s done. They overlooked telling me that I needed a permit and as soon as I  

found out I applied for the permit. Is it a good company? It’s a reputable company, it’s a well- 

known company in the United States, it’s the largest solar company in the United States and they’re  

a public company, they’re on the Stock Exchange so I took it. I’m working, I’m the oldest person  

in the company so I’m working with kids that are my sons age, so it’s been a learning experience  

to that end because I’m much older than them and I’m more laid back and not aggressive like them  

as far as that goes so, um, if I could find a different job which I have another interview this week  

with someone else but right now this is the only way I have for me to make a living 

 

Council President Dalina: (verbatim) I’m interested Mr. Trager, so when you applied for the job  

they offered you this position to go out and solicit, did they tell you the specific area that you were  

to go to, did they say general go to Monroe or did they give you a map 

 

 

Mr. Trager: (verbatim) They gave me a map with an area, as far as, west of Perrineville Road I  

had to work, that was my area. So that was the only thing they had told me as far as they sent me  

a map like that. They instructed me and educated me on solar, that was all they did. They didn’t  

bother telling me I needed a soliciting permit for each township you work in. I had no clue  

cause I never have done this before in my entire life, it’s not something I really wanted to do in 

my life it was something that was appealing as I have solar panels on my home and I thought it 

would be a natural thing and plus my age is more comforting to people talking to because I’m  

not a young kid, I’m not gung ho, pushing and driving and giving a whole spiel I don’t believe  

in, this is something I believe in. So, it’s something I figured I’d try and hopefully work out 

 

Council President Dalina: (verbatim) “Do you know of or did you know of any other people or  

representatives that may have been soliciting in Monroe Township”. 

 

Mr. Trager: (verbatim) “I knew of another person from Vivant that was in Monroe and after the  

fact he told me that he had been stopped once and he had a warning put in his folder because he  

didn’t have a permit but that was after the fact because when I told him I got stopped he said ‘no  

one told you to get a permit’ and I had said no, no one had told me to get a permit so that’s when  

I went right away to get the pictures and fill out the application and everything else. So right now  

this is what I’m doing. Am I looking forward to going door to door in the winter time? Absolutely  

not but this is the way I have to make a living at this point until I am ready to retire”. 

 

Council President: (verbatim) “Any other questions from the Council?” 

 

Council Vice-President Schneider: (verbatim) “No, just a comment. That is why there are rules  

and regulations. I am sorry your company did not say that but we have to abide by that because  

going door to door can be scary for people”. 

 

Mr. Trager: (verbatim) “I know. I’m a homeowner so I know. Like I said had I been aware the  

first thing I would have done would be to apply for a permit because I don’t do things illegally”.  

 

Council President Dalina asked Lieutenant Jason Grosser from the Monroe Township Police  

Department to come up, as he oversees the application process.  

 

Township Clerk, Patricia Reid directed Lt. Grosser to place his left hand on the bible and raise his  

right hand, then asking, (verbatim) “Lieutenant Jason Grosser do you solemnly swear to tell the  

truth, the whole truth and nothing but the truth, so help you God?” 

 

Lt. Grosser: (verbatim) “I do”. 

 

Council President Dalina asked Lt. Grosser to take a seat and please explain to the Council why  

he denied Mr. Trager’s application. 

 

Lt. Grosser: (verbatim) “The purpose of the denial, and we have gone through the process of how  

this works in the past, the subject makes the application through the Clerk’s office, the Clerk send  

a file over to the Police Department for us to do a background investigation on the individuals in  

order to ensure that the Township Ordinance is upheld. So, in Mr. Trager’s incident when I started  

doing the background on him obviously one of the first things I do is I check for any contact with  

our law enforcement agency in the past and of course the September 13th incident had arisen, which  

he just explained. The officer, Officer Taylor, had written a detailed report indicating the purpose  

of why he was there and what he had found when he was there. And in the report it indicated he  

was called to that location specifically by dispatch for residents on Mayfair Court reporting a 

subject going door to door selling solar panels. So upon his arrival he came in contact with Mr.  

Trager and when he asked Mr. Trager at his vehicle what he was doing in the area, Officer Taylor  

states that Mr. Trager had indicated to him he was visiting a good family friend. He asked Mr.  

Trager where the friend lived, Mr. Trager pointed to the house of 8 Mayfair Court, asked him what  

his friend’s name was and he stated Mr. Shah. When asked what Mr. Shah’s first name was, Mr.  

Trager stated he did not know and he would have to look at his paperwork. He then asked Mr.  

Trager if he was going door to door attempting to solicit for solar panels and he stated no, he  

stated that he had a scheduled appointment with Mr. Shah regarding solar panels with Vivant  

Solar which he was working for. He asked Mr. Trager if he was telling the truth about having an  

appointment with Mr. Shah and he stated yes but he may have made the appointment with Mr.  

Shah’s wife. At that time both Mr. and Mrs. Shah happened to be at their home preparing to leave  

their house for the evening and the officer had an opportunity to speak with them at which point  

he had asked them if they had made an appointment with the solar panel company and they both  

stated no. They indicated that Mr. Trager has been knocking on their door several times during  

the day attempting to speak about solar panels. The officer then came back and spoke to Mr.  

Trager again and advised him about having to have a permit to solicit within the town and Mr.  

Trager’s response to the officer was that he had applied for a permit early in the morning and had  

thought that was sufficient enough. He was ultimately served with a summons for failure to have  

a permit to solicit. My issue as to why I denied it is was specifically those three questions. The  

officer asked the questions, the officer wrote a detailed report, this is an official police report,  

pretty much a sworn statement. That course of questioning indicated to me that Mr. Trager was  

not being honest with the officer at the scene. Not only that but we were able to prove the  

dishonesty showing that when he had made the last statement when asked about the permit he had  

indicated that he had applied for a permit that morning, that was September 13th, and as discussed  

in the very beginning of this hearing the application wasn’t applied for until two days later. Had  

he applied that morning, our employees in the Clerk’s office indicate on every application that no  

one is to go door to door until the background and the permit is complete and handed out so we  

wouldn’t even be having this conversation here tonight had that been done the way Mr. Trager  

had indicated. That lack of honesty towards law enforcement raises a tremendous red flag for me  

in the concern of the safety and welfare of the residents which is specifically what is described in  

our Township ordinance which is the purpose of preventing dishonest business practices and  

dishonest solicitation of funds and that’s the reason for the denial. I had an opportunity to speak  

to Mr. Trager, as he had come in to ask questions as to what the specifics were on the denial and  

we had an excellent conversation. He is a very nice man, I have no problem with the gentleman  

sitting next to me, the problem I have is his course of conduct in dealing with the law enforcement  

officer regarding the very topic of what we are here for. And I expressed to him, he doesn’t believe  

that the officer report is completely accurate and then my response to him was were you 100%  

honest with my officer at the scene and Mr. Trager answered me in our meeting that no he was not  

entirely honest. That in and of itself raises my concern about the proper business practices which  

is specifically described in our ordinance.  

 

Council President Dalina: (verbatim) “Anyone from the Council have any questions for Lieutenant  

Grosser?”      

 

Councilman Leibowitz: (verbatim) “I’m glad that we had this much information because the  

previous hearing, we did not have all the information and I was not sure how I wanted to vote on  

it but I appreciate both of your honesty tonight.  

 

Council President Dalina: (verbatim) “Mr. Trager do you have any questions for Lieutenant  

Grosser at this time?” 

 

Mr. Trager: (verbatim) “I did tell the officer that I was soliciting. I had my badge on me and my  

vest on me, I did tell him. He kept yelling at me through the window with the window down ‘you’re  

lying, you’re lying, you’re lying, you’re lying’ and like I said I got scared the only thing that I  

interpreted as far as coming back to the woman’s house, I had only been to the woman’s house  

once, not multiple times and I told him that she didn’t speak good English and I never said it was  

a family friend. Never. At all. This is somebody I solicited and they told me to come back when  

the husband was home so I took that as an appointment, that was my interpretation. I was wrong  

in that regard I was interpreting it that way. I went back and solicited the house for a second time  

when the husband was home but I was soliciting and I did tell the officer that but he kept saying  

‘you’re lying to me, you’re lying to me, you’re lying to me’ and I just I was literally shaking I  

didn’t know what to do”. 

 

Councilman Baskin: (verbatim) “Did the husband speak good English?” 

 

Mr. Trager: (verbatim) “The husband spoke the same amount of English as the wife as far as it  

was broken English. I told him I, was here from Vivant, Vivant Solar and your wife told me to  

come back and see you’”. 

 

Councilman Baskin: (verbatim) “Mr. Trager I just wanted to ask the officer, the officer that was  

doing the questioning did he speak to them in a language they understood”. 

 

Lieutenant Grosser: (verbatim) “He spoke to them in English, I would presume, and they spoke  

enough English to have a conversation with him to answer the questions he was asking”. 

 

Mr. Trager: (verbatim) “But the incident said I was back their numerous times and I’d only been  

there once. Probably the reason why they called is because I was in my car working on my iPad  

as far as I didn’t drive away and leave and they probably got a little nervous about that which I can  

understand that”.    

 

Councilwoman Cohen: (verbatim) “I just have a procedural question. When someone’s been  

denied a permit what is the period of time for when they can reapply again or may they never apply  

for a permit”. 

Lieutenant Grosser (verbatim): “So here is the other issue. The other issue is part of the ordinance  

indicates that if you’ve been found guilty of a violation of the ordinance you cannot apply for five  

years. He has an outstanding case with our court regarding the summons that he was issued that  

afternoon. Originally the court date was scheduled for October and would have been adjudicated  

by the time we were here this evening but Mr. Trager has had it postponed to November”. 

 

Mr. Trager: (verbatim) “I didn’t postpone it. The prosecutor wanted to postpone it because the  

officer wasn’t there”. 

 

Lieutenant Grosser: (verbatim) “In any event, the case has been postponed to November. So as far  

as answering your question correctly, I can’t because we don’t know what’s going to happen with  

that ordinance violation. The denial here today, I mean obviously if he reapplies next year, I’m  

going to recall the incident that took place and again my basis for the denial was the lack of honesty 

with the officer at the scene. And my concern with the officer and you’re not completely truthful  

with the officer is how can I trust that you will be completely honest with the residents who you  

are selling to. And this is not the first incident we have had with Vivant Solar which is another  

issue I know the Clerk has brought up with the Council before regarding this company. Which is  

no fault to him please understand that.  

 

Mr. Trager: (verbatim) “Most of the people are in their 20’s and 30’s that work for the company.  

I mean I’m 66 years old and if anything, I am an honest person. Do I get scared and nervous at  

certain times, yeah, I do especially when I’m in situations like that because I’ve never had anything  

like that happen to me. The fact of the matter is this is the only way I have right now, unless I get  

another job, of making a living and it’s something that do I regret, you know not agreeing with the  

officer I probably should have agreed with the officer as far as I solicited the house multiple times  

but I only went to the house once. I wasn’t going to lie about that. In going back to the situation,  

the couple did not speak good English and I solicited other homes who were Indian and I couldn’t  

get anywhere because they do not understand English and some of them have their families living 

there and the husband and wife who own the house aren’t there and they don’t want you talking to  

them so you just leave. You know I have not solicited in Monroe since that incident which basically  

means I haven’t been able to earn a living”. 

 

Lieutenant Grosser: (verbatim) “I had asked him in our meeting, what was the training. Because  

obviously they had to train this man to have knowledge in the product and the direction of the 

company and what their strengths and weaknesses are. At no time did they indicate that they  

were required to find out if there is an ordinance for going door to door for what we are getting  

ready to pay you to do. And again, there is a track record of issues, such as this, with Vivant to  

begin with.  

 

Mr. Trager: (verbatim) “They read it saying, ‘we should have told you’, but I told them that was  

after the fact and had you told me originally, I would have gotten a permit and waited to go  

soliciting until I had gotten the permit but they didn’t bother informing me of that, they overlooked  

that. They taught me well about the product but they didn’t go over the details as far as to do it. I  

mean I used to train sales people for a living and I can teach somebody how to sell and you can  

give the parameters but something like this I have never done anything door to door ever in my  

life. So, having not known that I wouldn’t have known there was any ordinance other than living  

in an adult community and you cannot solicit in an adult community. But I wasn’t soliciting in any  

adult communities that’s for certain. Do I regret everything? I do, I can’t take it back but I am an 

honest person.  

 

Council President Dalina: (verbatim) “So ignorance is certainly something that we can’t hide  

behind, but however, I do believe five years is too much and if we do move forward with this  

denial I would like to make it a one-year denial, especially with winter time coming up anyhow, I  

would like to make it a one-year denial of the application as opposed to a five year as I think that  

is just a little too restrictive and again I think I would ask that at some point we do reach out to this  

company and again reinforce that Monroe Township has laws and ordinances in regard to  

solicitation. So, with that being said, I would like the Council to vote on whether to affirm the  

denial for one-year or reverse the denial”. 

 

Councilman Leibowitz: (verbatim) “One year ending when?”   

 

Council President Dalina: (verbatim) “A year from today”.  

 

Councilman Leibowitz: (verbatim) “I’ll make that motion”. 

 

 

 

He asked that Township Clerk, Patricia Reid, take and record the vote for those in favor to Affirm  

the Denial of the Permit:

Council President explained that the majority has voted to Affirm the Denial for one-year and once  

again thanked everyone for their time. 

 

 

UPON MOTION made by Council Vice-President Schneider and seconded by Councilman Leibowitz, the Special Meeting was Adjourned at 7:27pm and the regularly scheduled Agenda Meeting was Called to Order.

Mayor’s Report – Mayor Tamburro reported that on Saturday, October 28th, the annual  

Halloween Parade took place at the Community Center, with over 300 children in attendance.  

 

The Green Fair was held on Saturday, October 28th as well at the high school. There was paper  

shredding and recycling available to those who attended. Dr. Choy, a neurologist who lives in  

town, was in attendance at the event and spoke about the dangers of GMO’s and the importance  

of organic foods. There were a lot of great programs available and a lot of people took part in them 

 

Administrator’s Report – Administrator will give a full report at the Regular Meeting.  

 

 

Engineer’s Report – Engineer Rasimowicz reported that we partnered with Middlesex  

County and Rossmoor’s Homeowner Association for the Cedar Brook Pump Station.  

 

Gave an update regarding the paving projects within the Township; reporting that Union  

Valley Road will be completed tomorrow, and south of Half Acre Road will be completed on  

Wednesday, November 1st 

 

 

Council’s Reports:  

 

Council Vice-President Schneider –  

  • Attended the Halloween Parade, where children from 2 years old to 13 years old dressed up in costume and won prizes.  
  • The Green Fair was a very informative event and largely attended.  
  • The Cultural Arts Commission will be hosting a performance on December 9th of the Three Tenors with the N.J. Festival Orchestra at the Richard P. Marasco Performing Arts Center. 

 

Councilman Baskin –  

  • Attended the Halloween Parade as well and was very impressed with the creativity of some of the costumes.  
  • Attended the Octoberfest which was also a great event.  

 

Councilman Leibowitz –  

  • Reported that Monroe Township has the lowest crime rate in the County.  
  • Stated that he felt justified in denying the soliciting permit earlier and felt that it was fair to give him another chance to reapply in one year 

 

Councilwoman Cohen –  

  • Reported that the Juried Art Show at the Library will be ending in a few days and encouraged young artists to attend as the work is very lovely.  

 

Council President Dalina –  

  • Reminded everyone that tomorrow is Halloween and to be aware of the trick-or-treaters.  

 

 

 

PUBLIC:   

 

Harold Kane, 480-B Newport Way – Mr. Kane stated that in regard to the pump station in Rossmoor, the intake cover is piled high with vegetation and from an operation’s viewpoint the DPW should clean out twice a year to help improve the water flow. Administrator Weinberg responded that he will alert DPW.
