REGULAR MEETING – NOVEMBER 7, 2018

 

The Council of the Township of Monroe met in the Municipal Building, 1 Municipal Plaza, for the Regular  Meeting.

 

The Regular Meeting was Called to Order at 7:00 p.m. by Council President Stephen Dalina with a Salute to the Flag.

                                         

UPON ROLL CALLby the Township Clerk, Patricia Reid, the following members of Council were present: Councilman Leonard Baskin, Councilman Charles Dipierro, Council Vice-President Elizabeth Schneider and Council President Stephen Dalina.

 

ALSO PRESENT: Mayor Gerald W. Tamburro, Business Administrator Alan M. Weinberg, Township Attorney Joel Shain, Engineer Mark Rasimowicz and Deputy Township Clerk Christine Robbins.

 

There were approximately twenty-five (25) members of the Public present in the audience.

Council President Dalina introduced Mayor Tamburro who presented Lieutenant Mike Daley from Fire

District #3 with a certificate recognizing his achievement in obtaining the Chief Training Officer Award

from the Center of Public Safety & Excellence. He is also one out of one hundred and fourteen Chief

Training Officers in the world. Lieutenant Daley thanked the Mayor and Council for recognizing his

achievements and stated that you only need to have compassion to help people in this world.

 

Mayor Tamburro then introduced Kim Molarz, Senior Center Transportation Dispatcher, who was

nominated by her boss Amy Rutherford for 2018 Dispatcher of the Year. Ms. Molarz thanked everyone for

the recognition.

O-10-2018-030ORDINANCE REPEALING AND REPLACING CHAPTER 96, OF THE CODE OF

THE TOWNSHIP OF MONROE ENTITLED “SHADE TREES AND SHRUBBERY;

LANDSCAPING”.  (Tabled at the 9/5/18 meeting prior to Introduction)

 

ORDINANCEas follows: (O-10-2018-030)

 

WHEREAS,the Monroe Shade Tree Commission was created by the Township Council of the Township of Monroe by section 3-84 of the Code of the Township of Monroe (“Code”); and

 

WHEREAS,the powers and duties vested in the Shade Tree Commission, as set forth in Chapter 96 of the Code, overlap with and/or conflict with the responsibilities of other municipal officials under the Code and New Jersey statutes in certain instances, including as pertaining to the regulation of tree removal on private land being developed within the Township; and 

 

WHEREAS,this overlap and/or conflict has created confusion and inconsistency in the manner in which tree regulations are applied and enforced in the Township; and

 

WHEREAS,the Township Council has determined that it would be in the best interests of the Township to repeal and replace Chapter 96 of the Code to provide that the Monroe Township Shade Tree Commission’s responsibilities encompass the planting, care and maintenance of trees in public spaces within the Township, as well as the other powers vested in the Shade Tree Commission set forth in Chapter 96-1; and

 

WHEREAS, the Township Council has further determined that the regulations regarding proper planting procedures and recommended plantings should be moved out of Chapter 96 and set forth in a separate reference document due to the detailed nature of the requirements and for ease of future modification as need be;

 

NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED,by the Township Council of the Township of Monroe, Middlesex County, that Chapter 96, “Shade Trees and Shrubbery; Landscaping,” is hereby repealed and replaced to read as follows:

Chapter 96  SHADE TREES AND SHRUBBERY

 

 

  • 96-1.     Powers of Shade Tree Commission.

  • 96-1.     Powers of Shade Tree Commission.

                

   The Shade Tree Commission, as created under § 3-84 of this Code, shall serve without compensation and have the following powers:

  1. To exercise full and exclusive control over the regulation, planting and care of shade and ornamental trees and shrubbery now located or which may hereafter be planted in any public highway, park or parkway of the Township or public right of way, exclusive of state or county highways, unless the proper authority gives assent thereto.
  2. To regulate and control the use of the ground surrounding same as far as may be necessary for their proper growth, care and protection.
  3. To move or require the removal of any tree or part thereof dangerous to public safety.
  4. To care for and control parks and parkways and to encourage arboriculture.
  5. To administer treatment to or remove any tree situate upon private property which is believed to harbor a disease or insects readily communicable to neighboring healthy trees in the care of the municipality and enter upon private property for that purpose, with the consent of the owner thereof, provided that the suspected condition is first confirmed by a certificate issued by or on behalf of the Department of Agriculture.
  6. To receive an oral report from the Township’s Licensed Tree Expert with regard to street trees proposed in the landscape plans associated with the development applications before the Planning Board or Zoning Board of Adjustment, and to provide comments and/or recommendations through the Licensed Tree Expert to such Board on an advisory basis.

 

 

  • 96-2.     Prohibited acts.

                

No person shall do or cause to be done any of the following acts affecting the trees, plants, shrubbery or other ornamental flora planted or growing naturally within the highway or public places under the jurisdiction of the Township, unless permission is first obtained from the Shade Tree Commission.

  1. Cut, trim, break, disturb the roots of or spray with chemicals any living tree or shrub; or injure, misuse or remove any structure or device to support or protect any tree or shrub.
  2. Plant or remove any living tree or shrub, or climb with spikes any living tree or shrub on Township land.
  3. Fasten any rope, wire, electric attachments, sign or other device to a tree or shrub, or to any guard about such tree or shrub.
  4. Close or obstruct any open space provided about the base of a tree or shrub or add fertilizer to the roots of such tree or shrub.
  5. Pile any building material, or make any mortar or cement within six (6) feet of a tree or shrub.
  6. Change the grade of the soil within the limits of the lateral spread of the branches of any such tree.
  7. Place or maintain or cause to be placed or maintained upon the ground on any street, or place any stone, cement or other substance, which shall impede the tree access of air and water to the roots of any tree or shrub in any street or place.
  8. Lay any sidewalk along, or open, construct, curb or pave any street or do any like act so as to interfere with or do injury to any highway shade tree.

 

  1. Place salt, brine, oil, gas, sewage water or other substances injurious to plant growth in any                     public highway or place in such a manner as to injure any tree or shrub growing thereon.
  2. Build any fire or station any tar kettle, road roller or other engine in any public highway in      such a manner that the heat vapors or fumes therefrom may injure any tree or shrub.
  3. Do any excavating within six (6) feet of any tree or shrub in any public highway or place.
  4. Cut roots when necessary of more than one (1) inch in diameter without first protecting such roots.

 

 

  • 96-3.     Enforcement.

                

The provisions of this Chapter shall be administered and enforced by the Shade Tree Commission through the Township Conservation Officer.  Upon ascertaining a violation of this Chapter, the Conservation Officer shall refer charges to municipal court.   If any person shall continue to violate any of the provisions of this Chapter after being duly notified of such violation, or shall neglect or refuse to comply with any lawful order of the Conservation Officer, the failure to comply with a second or each of any subsequent notifications or orders shall be construed as an additional violation of this Chapter, and each additional offense shall subject the offending party upon conviction to the same penalty as provided for the first offense.

  • 96-4.     Violations and penalties.

                

Any person, firm, partnership, association or other legal entity violating or causing to be violated any of the provisions of this Chapter shall be subject to a fine of not less than Two Hundred Fifty Dollars ($250.00) and not more than Two Thousand Dollars ($2,000.00) and shall replace each tree destroyed or removed in violation of this Chapter with nursery grown tree(s) of the same species having a caliper of not less than two (2) inches. Each tree destroyed or removed in violation of this Chapter shall be considered a separate offense.

 

 

Section 2.   If any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged by the Courts to be invalid, such adjudication shall only apply to the section, paragraph, subsection, clause or provision so adjudicated, and the remainder of the Ordinance shall be deemed valid and effective.

 

Section 3.  All ordinances or parts of ordinances inconsistent herewith shall be and the same are hereby repealed. 

 

Section 4.This Ordinance shall take effect upon passage and publication in accordance with applicable law.

  • 87.1     Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

 

VIDEO SURVEILLANCE CAMERA or CAMERA– A device installed outside a residence or business which, for security purposes, captures footage of an area outside of the residence or business.

 

REGISTRY– The list of individuals or businesses who, pursuant to and in accordance with this Chapter, registers their private video surveillance camera(s) or camera(s) on their property in the municipality with the Monroe Township Police Department.

 

REGISTRANT– An individual or business that voluntarily registers video surveillance camera(s) or camera(s) with the Monroe Township Police Department.

 

  • 87.2 Voluntary Registry and Regulations.

 

Pursuant to N.J.S.A.40:48-1.6, N.J.S.A.40:48-1.7 and N.J.S.A.40A:48-2, the Township authorizes and creates a Registry, which shall permit any person who owns private video surveillance camera(s) or camera(s) at a residence or business in Monroe Township to voluntarily register same with the Monroe Township Police Department for the sole purpose of assisting law enforcement investigations of criminal activity occurring within the vicinity of the camera(s) locations.

 

The registration of a camera does not and shall not constitute a waiver of any rights granted under the Constitution of the United States or the State of New Jersey or any other law.

 

  • 87.3 Registration Procedure.

In order to be on the Registry, an individual or business, shall fill out an application form available at the Monroe Township Police Department or through the website of the Police Department, and provide the following information in order for the video surveillance camera(s) or camera(s) on their property to be placed on the Registry:

  1. Name of Registrant;
  2. Address of residence or business;
  3. Contact information; i.e., telephone number, e-mail address;
  4. Type of property; i.e., residential or commercial;
  5. Recording period; i.e., motion sensor, constant, business hours only;
  6. If images and/or video are saved to a digital video recorder (DVR) style device;
  7. Duration of data storage;
  8. Description of area(s) recorded;
  9. Third party monitoring;
  10. If the registrant will grant access to Police Department if needed; and
  11. If the registrant is proficient in memorializing / downloading data.

 

  • 87.4 Access to Information.

The Registry shall be available for the exclusive use by the Monroe Township Police Department and other law enforcement officials investigating criminal activity within the vicinity of the video surveillance camera(s) or camera(s).  When appropriate for criminal investigative purposes, the Monroe Township Police Department may request camera footage from the Registrant.  Granting access to the footage is entirely voluntary on the part of the Registrant.  Registering video surveillance camera(s) or camera(s) does not convey any rights to the Monroe Township Police Department or other law enforcement officials with regard to such camera(s) or footage.

 

The location of video surveillance camera(s) or camera(s) voluntarily provided by the public for the Registry shall be confidential and not disclosed to the general public.  The Registry shall be used solely as a tool to assist law enforcement in investigating criminal activity that occurred in the vicinity of the video surveillance camera(s) or camera(s). and shall not be considered a public record pursuant toN.J.S.A.47:1A-1 et seq.

 

  • 87.5 Termination from Registry.

Video surveillance camera(s) or camera(s) placed on the Registry will be removed at the request of the Registrant at any time upon written request to the Monroe Township Police Department.

 

            SECTION 2.  All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance shall be and the same are hereby repealed.

 

            SECTION 3. If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

SECTION 1.

ARTICLE VII “Reimbursement for Damages”

  • 105-42. Mail Box Damage Replacement Policy.
  1. In the event that the Township Department of Public Works (DPW) damages or destroys residential mail boxes located in the public right of way on a Township street as a result of snowplowing operations, the Township will reimburse the resident a maximum of $100.00 in       accordance with the following terms and conditions:
  2. Any resident seeking damage reimbursement shall file a claim using the Mail Box Service Request Form available at the DPW, 76 Gravel Hill-Spotswood Road and shall provide a      photograph of the damage.
  3. A DPW representative shall inspect the mail box and, if feasible, the Township shall repair the mail box. If the mail box is damaged beyond repair, the Township will reimburse the resident for       the cost of a replacement with a maximum reimbursement of $100.00, which shall include            the post and cost of installation. The property owner shall be required to provide a receipt for the         purchase and installation of the new mail box.
  4. In all cases, mail boxes must be securely fastened to a sturdy post in the ground, and must meet the legal requirements of the United States Postal Service.
  5. No mail box shall be considered for reimbursement for damages if the mail box shows dry rot, is unstable, or the DPW determines that it is located too close to the travel way.
  6. Damage claims caused by the weight of the snow shall not be considered for reimbursement by the Township.
  7. All mail box replacements shall be the responsibility of the property owner.

 

  • 105-42.§ 105-43.Severability.

 

 

SECTION 2.    All Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance shall be and the same are hereby repealed.

 

SECTION 3.    If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

Hy Grossman, 15 Doral Dr. – Mr. Grossman asked if this Ordinance would apply since he lives in a community that has a homeowner’s association that contracts with a private contractor for snow removal; Council President Dalina answered that it would not apply as this is just for any damage done by the Township when removing snow.

WHEREAS, on September 18, 2018 at 11:00 AM, three (3) sealed bids were received, publicly opened, and read aloud, by the Monroe Township Utility Department Purchasing Agent for Contract 483, “Water & Sewer System Appurtenances”, required by the M.T.U.D.; and

 

WHEREAS, Water Works Supply Co., Inc. has submitted the lowest responsible and responsive bids for Sections A, B, C, D, G, K, L AND M; and

 

WHEREAS, the Purchasing Agent of the M.T.U.D. by copy of a letter dated October 12, 2018, has recommended that, subject to a positive review from the township attorney, a contract be awarded to Water Works Supply Co., Inc. of Pompton Plains, NJ, based in unit pricing and estimated quantities,for the sections listed above, a copy of which is attached as exhibit B; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Finance Officer has certified availability of funds in Certificate No. M-180034acopy of which is attached hereto as Exhibit "A"; and

 

WHEREAS, Water Works Supply Co., Inc. has submitted all the required documents with their bid; and

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey as follows:

 

(1)        The Mayor and Township Clerk are hereby authorized to enter into a contract Water Works Supply Co., Inc. in accordance with their submitted bid; 

 

(2)        The Township Chief Finance Officer is hereby authorized and directed to pay invoices for material delivered by Water Works Supply Co., Inc. in accordance with their bid;

WHEREAS, on August 17, 2015 at 11:00 AM, three (3) sealed bids were received, publicly opened, and read aloud, by the Monroe Township Utility Department Purchasing Agent for Contract 483, “Water & Sewer System Appurtenances”, required by the M.T.U.D.; and

                                                                                

            WHEREAS, Core and Main, LP has submitted the lowest responsible and responsive bids for Sections E, F, H, I and J; and

 

WHEREAS, the Purchasing Agent of the M.T.U.D. by copy of a letter dated August 18, 2017, has recommended that, subject to a positive review from the township attorney, a contract should be awarded to Core and Main, LP of Edison, NJ, based in unit pricing and estimated quantities,for the sections listed above, a copy of which is attached as exhibit B; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-5.4, the Township Chief Finance Officer has certified availability of funds in Certificate No. M-180035acopy of which is attached hereto as Exhibit "A"; and

WHEREAS,in the interest of the citizens of the Township of Monroe, in the County of Middlesex, the Township has a need for the following goods and services:

 

  • HVAC Maintenance and Repair
  • Landscaping
  • Outside Snow and Ice Removal
  • Adult Mini Bus

                       

WHEREAS,pursuant to N.J.S.A.40A:11-4, every contract or agreement for the performance of any work or the furnishing of any materials or supplies, the cost of the contract price wherefore is to be paid with or out of public funds, subject to certain exceptions, shall be made or awarded only by the governing body after public advertising for bids and bidding therefor;

 

NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Monroe Township Engineer is hereby authorized to enter into the bidding process for the aforementioned goods and services and may take any action necessary and consistent therewith.

R-11-2018-279            RESOLUTION AUTHORIZING A CONTRACT WITH TRI-STATE                                              LIGHT AND ENERGY INC. FOR AN AUDIT FOR THE PUBLIC WORKS                          DEPARTMENT, PARKS DEPARTMENT AND CONSTRUCTION                                                             DEPARTMENT BUILDINGS UNDER THE 70/30 DIRECT INSTALL                                            PROGRAM SPONSORED BY THE NEW JERSEY BOARD OF PUBLIC                                               UTILITIES.

 

            WHEREAS,the Township is aware that the Board of Public Utilities in its final energy audit report issued November 19, 2015 has established the Direct Install Program (hereinafter called “the Program”) which provides energy efficiency grants which target small facilities with a peak demand of less than 250kw and provides up to 70% for the cost of eligible upgrades including HVAC, lighting, etc. with a cap of $125,000.00 for each project; and

            WHEREAS, the Program operates through participating contractors designated by the BPU who perform program services including the initial energy assessment to identify equipment to be replaced, arranging for program approval of the chosen improvements, and performing the actual equipment replacement pursuant to established and set pricing for all participating contractors; and

            WHEREAS, the Division of Local Government Services, New Jersey Department of Community Affairs, approved the bidding and contractor selection process used by the BPU to select Program participating contractors met the requirements of the Local Public Contracts Law; and

            WHEREAS,pursuant to BPU guidelines, only contractors certified to perform services under the Program are allowed to perform said work;

            NOW THEREFORE BE IT RESOLVEDby the Township Council of the Township of Monroe that the Mayor and Township Clerk are authorized to execute a contract with the BPU approved vendor for Middlesex County, Tri-State Light & Energy, 855 Sussex Boulevard, Broomall, Pennsylvania 19008 to conduct a study of the Department of Public Works Building energy use and install energy efficient improvements under the 70/30 Direct Install Program subject to the approval of the Township Council by resolution and appropriation of funds for said project.

            SO RESOLVED, as aforesaid.

 

R-11-2018-280            RESOLUTION AUTHORIZING THE TOWNSHIP BUSINESS                                                       ADMINISTRATOR TO PREPARE AND ADVERTISE FOR REQUEST                                            FOR QUALIFICATIONS (“RFQs”) FOR THE AFFORDABLE HOUSING                                           VETERANS HOUSING PROJECT.  

                                    (Cranbury-Half Acre Rd, Block 41, Lot 14)

 

            WHEREAS,    on October 10, 2018 the Monroe Township Affordable Housing Board passed a resolution “Endorsement of Request for Qualifications (RFQ) for Veterans Housing” and has referred this request to the Monroe Township Council for further action; and

 

WHEREAS, the Monroe Township Council has reviewed the request and recommendation by the Monroe Township Affordable Housing Board and agrees with the need to prepare and advertise Requests for Qualifications (“RFQs”) for the Affordable Housing Veterans Housing Project; and

 

            WHEREAS, in accordance with N.J.S.A.19:44A-20.5, the Township of Monroe, in the County of Middlesex, has a need to solicit resumes setting forth qualifications for various services;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Monroe Township Business Administrator is hereby authorized to prepare qualifications and advertise RFQs for various professional services for the Affordable Housing Veterans Housing Project and may take any action necessary and consistent therewith.

R-11-2018-281            RESOLUTION AUTHORIZING AN EXTENSION OF CONTRACT WITH                                    GROUNDS KEEPER INC. FOR MONROE TOWNSHIP SHADE TREE                                                 PLANTING.

 

WHEREAS,on October 5, 2016 per Resolution No. R-10-2016-366, Grounds Keeper, Inc.was awarded the Shade Tree Planting contract; and

 

WHEREAS,the current contract renewal expires on September 30, 2018 and the Township has an option to extend for one additional year; and 

 

WHEREAS, the Township Qualified Purchasing Agent inquired as to the willingness of Grounds Keeper, Inc. to extend their current contract; and

 

            WHEREAS,the attached letter dated September 24, 2018 indicates the willingness of Grounds Keeper, Inc.to extend the current contract from October 1, 2018 thru September 30, 2019, nunc pro tunc,under the same terms, conditions and pricing contained within their original bid specification and contract; and

 

WHEREAS,the Certified Municipal Finance Officer has determined that sufficient funds are available in the Tree Escrow Fund, as set forth in Certificate No C-160066, a copy of which is attached hereto as Exhibit "A"; and

 

            WHEREAS,the contract for Monroe Township Landscaping Services is being extended one year to September 30, 2019 in accordance with N.J.S.A.40A:11-15 of the Local Public Contracts Law;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey that it has rendered its advice and hereby consents to the one-year extension of contract with Grounds Keeper, Inc. under the same terms, conditions and pricing within their original bid specification submitted for Shade Tree Planting; and

 

            BE IT FURTHER RESOLVEDthat the Finance Department is hereby authorized and directed to pay Invoices for the above referenced vendor in accordance with the original terms, conditions and pricing contained within their original 2016 contract entered into between the parties;

R-11-2018-282            RESOLUTION AUTHORIZING THE MAYOR AND TOWNSHIP CLERK                                    TO ENTER INTO A SHARED SERVICE AGREEMENT WITH                                                   MIDDLESEX COUNTY FOR HAZMAT RESPONSE SERVICES COST                                                 RECOVERY.

 

WHEREAS, pursuant to the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., a local governmental unit may enter into an agreement with another local governmental unit to provide or receive within their several jurisdictions any service that each local unit participating in the agreement is empowered to provide or receive within its own jurisdiction; and

 

            WHEREAS, under the Spill Compensation and Control Act, N.J.S.A.58:10-23.11 et seq., persons responsible for the discharge of hazardous substances are liable, jointly and severally, for the costs of emergency response, cleanup and removal; and

 

            WHEREAS, the County of Middlesex adopted an Emergency Response Cost Recovery Ordinance, No. 97-1143, on May 15, 1997 (“Ordinance”), to establish procedures and provisions for the recovery from the responsible party or parties of the costs to local governmental units incurred in responding to hazardous materials (“HAZMAT”) incidents that occur throughout the County of Middlesex; and

 

            WHEREAS,said Ordinance was approved by the Commissioner of the New Jersey Department of Environmental Protection on July 10, 1997; and

 

            WHEREAS, the Township of Monroe incurs costs from time to time in responding to HAZMAT incidents within its jurisdiction; and

 

            WHEREAS, the Township Council of the Township of Monroe has determined that it is in the best interests of the Township to enter into a shared services agreement with the County of Middlesex for the furnishing of HAZMAT response cost recovery services;

 

            NOW THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, that the Mayor and Township Clerk be and are hereby authorized to execute a shared services agreement (“Agreement”) with County of Middlesex for provision by the County of HAZMAT response cost recovery services to the Township; and

 

            BE IT FURTHER RESOLVEDthat said Agreement shall be for a term of three (3) years, effective January 1, 2019; and

 

            BE IT FURTHER RESOLVEDthat, prior to execution of said Agreement, the Township Attorney is authorized to review said Agreement as to form and substance, and to make any changes deemed to be necessary and/or appropriate.

 

SO RESOLVED, as aforesaid.

 

 

R-11-2018-283            RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT                                   BETWEEN THE COUNTY OF MIDDLESEX, DEPARTMENT OF                                                          SENIOR SERVICES AND THE TOWNSHIP OF MONROE, OFFICE ON                                           AGING FOR OUTREACH SERVICES. 

 

            WHEREAS,the County of Middlesex entered into a contract with the State of New Jersey, Department of Health and Senior Services, for the purpose of providing services primarily for older adults under the County Department of Senior Services Area Plan contract; and

 

            WHEREAS, under Rules and Regulations for County Offices on Aging, N.J.A.C. 5:71-1.2(c) and the County Department of Senior Services Area Plan Contract, the County Department of Senior Services has been provided authority and responsibility to administer these Programs; and

 

            WHEREAS, the Area Plan Contract with the New Jersey Department of Health and Senior Services stipulates the County of Middlesex, Office on Senior Services will provide funding for Outreachservices through an Agreement with the Township of Monroe - Office on Aging; and

 

            WHEREAS, the contract between Monroe Townshipand County of Middlesex Department of Senior Services calls for a minimum of 600unduplicated senior clients to be provided with the above stated services at a cost not to exceed $8,000.00of Older Americans Act grant funds with matching funds (as appropriate) per the approved program budget; and

 

            NOW, THEREFORE, BE IT RESOLVEDthat the Mayor, Certified Municipal Finance Officer and Township Clerk be and are hereby authorized and directed to execute the attached Grant Agreement for the project entitled, “Monroe Office on Aging - Outreach”, Grant No. OAA-19507, for the period of January 1, 2019 through December 31, 2019.

 

 

R-11-2018-285            RESOLUTION AUTHORIZING THE SUBMISSION OF THE 2019                                                RECYCLING ENHANCEMENT GRANT APPLICATION TO THE                                               MIDDLESEX COUNTY DIVISION OF SOLID WASTE MANAGEMENT.                               ($4,750)

 

WHEREAS,The County of Middlesex in continuing to recognize the importance of recycling and the role that the individual municipalities play in conjunction with the County towards achieving an exemplary recycling rate has proposed to provide grant monies to municipalities through the Recycling Enhancement Grant (REG) Program; and

 

WHEREAS,the intent of the REG Program is to provide funds to qualifying municipalities to be used for recycling compliance and enforcement to enhance a municipality’s recycling program; and 

 

WHEREAS, it appears to be in the best interest of the Township of Monroe and its citizens to apply for this grant;

 

NOW THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, that the Public Works Director and Recycling Coordinator are hereby authorized to submit the attached application for consideration of a grant to the Middles County Division of Solid Waste Management.

R-11-2018-286            RESOLUTION AUTHORIZING THE EXPENDITURE FROM THE TREE                                    ESCROW FUND. ($5,600)

 

            WHEREAS, in accordance with Chapter 96 of the Monroe Township Code entitled “Shade Trees and Shrubbery; Landscaping”, a Tree Escrow Fund has been created to hold and disburse fees paid in lieu of tree replanting by developers or property owners removing trees; and

 

            WHEREAS, the Fund is to be used to maintain, preserve and protect the municipal tree cover; and

 

            WHEREAS, the overall health and vitality of Monroe Township’s tree cover is at risk due to the Emerald Ash Borer infestation, which has spread to ash trees throughout the Township; and

 

            WHEREAS, the Council believes that purposes of the Tree Escrow Fund are served by funding the removal of dead or diseased ash trees within the Township, which pose a danger to healthy trees and to the public; and

 

           WHEREAS, the Certified Municipal Finance Officer has certified the availability of funds within the Tree Escrow Fund in Certificate No. C-1800061, a copy of which is attached hereto as Exhibit B; and

 

            NOW, THEREFORE, BE IT RESOLVEDthat the Township Council of the Township of Monroe authorizes the expenditure of not more than $5,600.00 for the removal of approximately 19 Ash trees if, as, and when invoices are tendered by RKD, from the Tree Escrow Fund; 

 

            BE IT FURTHER RESOLVED, that the Finance Department is hereby authorized and directed to pay Power Saws of America, Inc. t/a RKD Tree Service from the Tree Escrow Fund, for the services provided.

 

            SO RESOLVED, as aforesaid.

 

 

R-11-2018-287            RESOLUTION AUTHORIZING EXECUTION OF A PROFESSIONAL                                          SERVICES CONTRACT WITH CENTER STATE ENGINEERING FOR                                            PROFESSIONAL ENGINEERING SERVICES IN CONNECTION WITH                                      THE 2018-2019 GIS SERVICES FOR MONROE TOWNSHIP. ($30,000)

 

            WHEREAS, the Township of Monroe seeks professional engineering, surveying and planning services to host, maintain and update the Monroe Township multi-platform GIS Application; and

 

            WHEREAS, Center StateEngineering possesses the technical expertise required to perform professional engineering, surveying and planning services in connection with the 2018-2019 GIS Services for the Township of Monroe; and

 

            WHEREAS, the fees for such services will not exceed thirty thousand dollars ($30,000.00); and

 

            WHEREAS, the Certified Municipal Finance Officer has certified the availability of funds for such an engagement in Certificate No.C-1800062, a copy of which is attached hereto as Exhibit “A”; and

 

            WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1 etseq.) authorizes the award of contracts for “professional services” without competitive bids and further provides that the contract itself must be available for public inspection; and

 

            NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey as follows:

 

            (1)        The Mayor and Township Clerk be and are hereby authorized and directed to execute the attached contract with Center State Engineering, 481Spotswood-Englishtown Road, Monroe Township, NJ 08831, in accordance with the Agreement annexed hereto;

 

            (2)        The Department of Finance is hereby authorized and directed to pay Invoices for services rendered by Center State Engineering for the 2018-2019 GIS Services in an amount not to exceed Thirty thousand dollars ($30,000.00);

 

            (3)        The Contract is awarded with the stipulation that Center State Engineeringshall include within the Contract Mandatory Affirmative Action language and shall submit to the Township of Monroe any appropriate Affirmative Action document within the time period prescribed by law;

 

            (4)        A notice of this action shall be printed once in the Home News Tribune.

R-11-2018-288            RESOLUTION AUTHORIZING RELEASE OF PERFORMANCE                                                  GUARANTEES POSTED BY THE LANDTEK GROUP, INC. IN                                                           CONNECTION WITH THE PROSPECT PLAINS ROAD SOCCER                                                 COMPLEX ARTIFICIAL TURF A ND LIGHTING IMPROVEMENT                                            PROJECT UPON THE POSTING OF A MAINTENANCE GUARANTEE.

 

            WHEREAS, TheLandtek Group, Inc. has posted Performance Guarantees for the Prospect Plains Road Soccer Complex Artificial Turf and Lighting Improvements project; and

 

            WHEREAS,The Landtek Group, Inc. has requested a release of the Performance Guarantees posted for this project; and

 

 

            WHEREAS, pursuant to Section 108-13.1 F and G of the Code of the Township of Monroe, the Township Engineer, by copy of letter dated October 16, 2018, has recommended, release of the Performance Guarantees; and

 

            WHEREAS, the Township Council has reviewed and hereby approves the recommendations of the Township Engineer;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Performance Guarantees posted for the Prospect Plains Road Soccer Complex Artificial Turf and Lighting Improvements project, be released as reflected in the Township Engineer’s letter dated October 16, 2018, attached hereto.  This approval for release of the Performance Guarantees is conditioned upon the posting of a maintenance guarantee in the amount of $186,425.61. Such maintenance guarantee shall run for a period of not less than two years from the date of final acceptance by the Township Engineer.

R-11-2018-289            RESOLUTION AUTHORIZING AWARD OF BID TO EAGLE                                                       CONSTRUCTION SERVICES, INC. FOR THE DANIEL P. RYAN                                                        MEMORIAL FIELD ADA RESTROOM, CONCESSION STAND AND                                        PUMP STATION PROJECT.  ($650,514)

 

            WHEREAS, on October 18, 2018, six (6) sealed bids were received by Monroe Township regarding the Daniel P. Ryan Memorial Field ADA Restroom, Concession Stand and Pump Station Project; and

 

            WHEREAS, the Township Engineer, by copy of letter dated October 22, 2018, has recommended Eagle Construction Services, Inc.be awarded the base and alternate number 1 bid based upon their bid submission in the amount of $650,514.00; and

 

            WHEREAS, the Township Council has reviewed the recommendations made by the Township Engineer regarding said bid; and

 

            WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available, as set forth in Certificate No.C-1800072, a copy of which is attached hereto as Exhibit "A”; and

 

            WHEREAS, no contract that is subject to the requirements of the Affirmative Action Regulations pursuant to N.J.S.A.10:5-31 et seq. and N.J.A.C.17:27 et seq. shall be awarded by the Township of Monroe, nor shall any monies be paid there under, to any contractor, subcontractor of business firm that has not agreed and guaranteed to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the affirmative action plan approved under the terms established in the above cited regulations;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that it has rendered its advice and hereby consents to the award of bid to Eagle Construction Services, Inc., 1624 Jacksonville Rd Burlington, N.J. 08016 for the Daniel P. Ryan Memorial Field ADA Restroom, Concession Stand and Pump Station Projectat a total contract price of $650,514.00; and

 

            BE IT FURTHER RESOLVED that the Mayor and Township Clerk are hereby authorized and directed to execute a contract with Eagle Construction Services, Inc.; and

 

            BE IT FURTHER RESOLVED that the Township’s Certified Municipal Finance Officer is hereby authorized and directed to pay Eagle Construction Services, Inc.in accordance with the contract entered into between the parties; and

 

            BE IT FURTHER RESOLVED that the contract is awarded with the stipulation that

Eagle Construction Services, Inc. shall comply with Affirmative Action Regulations, including revising their contracts as necessary to add mandatory affirmative action language, and submitting a completed AA-201, within seven (7) days of notification of award of the contract or risk being declared non-responsive and forfeiting the award.

 

            BE IT FURTHER RESOLVED, thereafter, a completed AA-202, monthly project workforce report, must be submitted once a month for the duration of the contract to the Department of Labor and to the Monroe Township Public Agency Compliance Officer.

          WHEREAS, Premiums have been paid for various properties for the purchase of Tax Lien Certificates for properties listed on the Tax Map of the Township of Monroe, in the amount of Twenty-nine thousand dollars and no cents ($29,000.00).

WHEREAS,on July 5, 2017 per Resolution No. R-7-2017-196, W.B. Masonwas awarded the Custodial Supplies contract; and

 

WHEREAS,the current contract renewal expired on June 30, 2018 and the Township has an option to extend for two additional one-year periods; and 

 

WHEREAS, the Township Qualified Purchasing Agent inquired as to the willingness of W.B. Mason to extend their current contract; and

 

            WHEREAS,the attached letter dated October 23, 2018 indicates the willingness of W.B. Mason to extend the current contract from July 1, 2018 thru June 30, 2019, nunc pro tunc,under the same terms, conditions and pricing contained within their original bid specification and contract; and

 

WHEREAS,the Certified Municipal Finance Officer has determined that sufficient funds are available in the Tree Escrow Fund, as set forth in Certificate No C-1700032, a copy of which is attached hereto as Exhibit "A"; and

 

            WHEREAS,the contract for Monroe Township Custodial Supplies is being extended one year to June 30, 2019 in accordance with N.J.S.A.40A:11-15 of the Local Public Contracts Law;

            WHEREAS, pursuant to Resolution No. R-9-2017-246, adopted by the Monroe Township Council at its meeting held on September 6, 2017, a contract was awarded to Z Brothers Concrete Contractors, Inc. in connection with the 2017 Township Wide Roadway Improvements Project (Milling and Paving);and

 

            WHEREAS,the original total contract amount was $712,856.05; and

 

            WHEREAS, the Township Engineer, in a letter dated October 22, 2018, requested approval of Change Order No. 1 and final payment for the 2017 Township Wide Roadway Improvements Project, reflecting a decrease in the original contract amount of $17,630.31as reflected in thechange order attached, marked as Exhibit A; and 

 

            WHEREAS, the current contract price including this change order is now $695,225.74; and

 

            WHEREAS, the Township Council has reviewed the request and has found same to be reasonable; and

RYAN                                                 MEMORIAL FIELD ADA RESTROOM IMPROVEMENTS.

            WHEREAS,pursuant to Resolution No. R-12-2016-414, adopted by the Monroe Township Council at its meeting held on December 5, 2016, Center State Engineering was awarded a Professional Service Contract for Professional Engineering Services related to the Daniel P. Ryan Memorial Field ADA Restroom Improvements; and

 

            WHEREAS,said contract for engineering services for the Daniel P. Ryan Memorial Field ADA Restroom Improvements was in the original amount of $50,000.00; and

 

            WHEREAS, due to three failed public bid attempts, Center State Engineering has requested approval of a modification to the original contract in the amount of $20,000.00 in connection with the engineering, architectural services, surveying, permitting and contract administration in connection with the fourth public bid attempt, as indicated in a letter dated September 18, 2018 as attached hereto and made a part of; and

 

            WHEREAS, the Township Council has reviewed the request and has found same to be reasonable; and

 

            WHEREAS, the Certified Municipal Finance Officer has certified the availability of funds in Certificate No. C-160076, a copy of which is attached hereto;

            WHEREAS,Lewis-Graham, Inc. has posted Performance Guarantees for ADA Site Improvements at Dey Farmstead; and

 

            WHEREAS,Lewis-Graham, Inc. has requested a release of the Performance Guarantees posted for this project; and

 

            WHEREAS, pursuant to Section 108-13.1 F and G of the Code of the Township of Monroe, the Township Engineer, by copy of letter dated October 22, 2018, has recommended, release of the Performance Guarantees; and

 

            WHEREAS, the Township Council has reviewed and hereby approves the recommendations of the Township Engineer;

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, in the County of Middlesex, State of New Jersey that the Performance Guarantees posted for the ADA Site Improvements at Dey Farmstead, be released as reflected in the Township Engineer’s letter dated October 22, 2018, attached hereto.  This approval for release of the Performance Guarantees is conditioned upon the posting of a maintenance guarantee in the amount of $24,527.50.  Such maintenance guarantee shall run for a period of not less than two years from the date of final acceptance by the Township Engineer.

R-11-2018-301            RESOLUTION AUTHORIZING THE PURCHASING OF E-TICKETING                                      SOFTWARE LICENSING EQUIPMENT AND MAINTENANCE FOR THE                              POLICE DEPARTMENT.

WHEREAS, the Township of Monroe, County of Middlesex, has the need to purchase E-Ticketing Software, Licensing, Equipment and Maintenance under New Jersey State Contract No. 89980, State Term Contract No. M-0483 16-r-24098 from GTBM Info-Cop, an authorized vendor under the New Jersey State Contract; and

 

WHEREAS,the cost for all of the necessary E-Ticketing Software, Licensing, Equipment and Maintenance, which provides the capability of doing E-Ticketing for twenty two (22) vehicles over a five year contract period, of which cost will not to exceed $34,000.00; and

 

WHEREAS, the purchase of goods and services by local contracting units is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-12; and

            WHEREAS, the Chief Financial Officer has determined that sufficient funds are available, as set forth in Certificate No.C-1800067copies of which are attached hereto as Exhibit "B";

WHEREAS,Section 108-13.9 of the Code of the Township of Monroe requires the Developer to furnish a two (2) year maintenance guarantee in an amount equal to fifteen percent (15%) of the original performance guarantee upon release of the performance guarantees by the Township Council upon the Township Engineer’s written recommendation; and

 

WHEREAS, Mary Heffron.has posted Performance Guarantees in the amount of $5,806.50; and

 

WHEREAS, a request has been made to release the performance guarantees; and

 

WHEREAS,the Township Engineer’s office, by copy of letter dated October 22, 2018, recommends release of the projects Performance Guarantees;

 

NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey that release of the project performance guarantees shall be conditioned upon resolution of all outstanding escrow balances associated with the administration of this project by Township officials, as well as the posting of maintenance guarantees for 15% of the project total ($4,838.75), or $725.81.  Such maintenance guarantee shall run for a period of not less than two years from the date of memorialization of such action by the Council;

 

BE IT FURTHER RESOLVED, in accordance with the Monroe Township Code, the developer shall maintain funds in the engineering inspection escrow account in the amount of fifty percent (50%) of the original deposit” however in lieu of this, the Township Engineer’s office recommends the developer post five hundred dollars ($500.00) at this time, into the existing engineering inspection escrow account, which is more reasonable.

R-11-2018-304            RESOLUTION AUTHORIZING RELEASE OF MAINTENANCE                                                   GUARANTEE POSTED FOR VEGAN THYME INC. (PB-1083-10).

            WHEREAS,    Vegan Thyme has posted Maintenance Guarantees with Monroe Township for Block 58, Lot 30 project PB-1083-10; and

 

            WHEREAS, the maintenance guarantee has expired on February 26, 2017; and

 

            WHEREAS,as defined in N.J.S.A. 40:55D-53 et seq., the Township Engineer has inspected the installed site improvements and has recommended that the Township Council approve the request for release of maintenance guarantees and escrow accounts, as detailed in a letter dated September 18, 2018, a copy of which is attached hereto as Exhibit "A"; and

 

            WHEREAS, the Township Council has reviewed and hereby approves the recommendations of the Township Engineer;

WHEREAS, on October 15, 2018, the Monroe Township Police Department solicited proposals for exercise equipment; and

WHEREAS, the award of contract is subject to the compliance with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C.17:27 et seq.; any contractor, subcontractor of business firm agree and guarantee to comply with Affirmative Action Regulations and to afford equal opportunity in the performance of the contract in accordance with the affirmative action plan approved under the terms established in the above-cited regulations;

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Monroe, County of Middlesex that it has rendered its advice and hereby consents to the award of contract, to Heartline Fitness Systemsfor physical fitness equipment for a total contract price of $27,892.86; and

 

WHEREAS, the Township’s Certified Municipal Finance Officer has determined that sufficient funds are available, as evidenced by Certificate No. C-1800068, a copy of which is attached hereto; and

 

            BE IT FURTHER RESOLVED that the Certified Municipal Finance Officer is hereby authorized and directed to pay Heartline Fitness Systemsin accordance with the contract entered into between the parties; and

 

BE IT FURTHER RESOLVED that the contract is awarded with the stipulation that Heartline Fitness Systems shall comply with Affirmative Action Regulations, including revising their contracts as necessary to add mandatory affirmative action language, and submitting either a letter of federal approval or a certificate of employee information report, or a completed form AA302 at the time the signed contracts are returned to the Township of Monroe, or seven (7) days thereafter, or risk being declared non-responsive and forfeiting the award.

            WHEREAS, there are certain 2018 budget appropriations of the Township of Monroe which may be insufficient to meet the requirements of the Township’s affairs; and

            WHEREAS, the Township of Monroe has negotiated a new contract with Superior Officers’ Associationof the Township of Monroe; and

 

            WHEREAS, it is the opinion of the Monroe Township Council that said new contract is proper and acceptable and will be subject to and incorporated in the “2019 - 2022 Police PBA Salary and Wage Ordinance” and the “2019 - 2022 Superior Officers’ Association Salary and Wage Ordinance” of the Township of Monroe, in the County of Middlesex, State of New Jersey;

 

            NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey, that Alan M. WHEREAS, Stonebridgehas posted Performance Guarantees in the amount of $298,425.53; and

 

WHEREAS, a request has been made to release the performance guarantees for Stonebridge.; and

 

WHEREAS,the Township Engineer’s office, by copy of letter dated October 3, 2018, recommends release of the projects Performance Guarantees;

 

NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of Monroe, County of Middlesex, State of New Jersey that release of the project performance guarantees shall be conditioned upon resolution of all outstanding escrow balances associated with the administration of this project by Township officials, as well as the posting of maintenance guarantees for 15% of the project total ($248,687.94), or $37,303.19.  Such maintenance guarantee shall run for a period of not less than two years from the date of memorialization of such action by the Council;

WHEREAS,the Chabad Jewish Center of Monroehas satisfied to this Council as to the handling of the fireworks and has provided this Council with a satisfactory sketch of the site at which the fireworks are to be displayed and the Contractor, Patrick Cyrana, d/b/a Advanced Pyrotechnics, has provided the following required documentation:

 

  1. Certificate of Insurance in an amount not less than $2,000,000.00;
  2. Indemnity Agreement;

REPORTS:

 

Mayor’s Report– Mayor Tamburro spoke of the horrific events that happened in Pittsburgh, PA; he stated

that a memorial service was put together and held at the Senior Center with over 700 people in attendance.

It was moving to see all religions and ethnicities come together. He added that when the piano player came

and played the first song was the “Hebrew Peace Song” and without anyone saying anything everyone

started to sing. He then played “Somewhere Over the Rainbow” and I don’t think there was a dry eye in the

house. He thanked all the people that came and all of the religious figures that came out. Mayor Tamburro

added that he belongs to an Anti-Semitism Mayor’s Congregation and will not stand for such acts of

violence.

 

The volunteer security registration program was approved tonight which allows property owners who have

cameras on their property can register to help the police in any investigations.

 

Tonight, we awarded a contract for the ADA bathrooms at Daniel Ryan Field and are eager to break ground

and have the new facility ready for the next season.

 

The Police Department will be receiving new equipment including vehicles, gas masks and training

Equipment as we want our department to have the best equipment to better protect us.

 

Octoberfest was fantastic, although it was windy no tents blew away.

 

The Township is always happy to welcome new businesses; Molino’s opened on 522 and the Mayor

attended the ribbon cutting ceremony. Also attended the Ponds Community Center where they have solar

now running their clubhouse. The tennis facility across from Make A Wish had an event where people were

dancing for hours. The celebration of Diwali is today as well.  

 

Each year we honor the senior center volunteers and this week we will be honoring our Veteran’s. Sunday

we are having services at the monuments outside of the municipal building and 9:30am at Veteran’s Park.

There will be transportation to the park for those that need it. Tomorrow there will be a luncheon for the

Veteran’s at the Senior Center at 1:30pm given by the Friends of the Senior Center and Friday the Township

will recognize the Veteran’s and have hot dogs for lunch at the Senior Center at 11:30am.

 

Lastly, Mayor Tamburro added that he wants everyone to know how hard the Clerk’s Office works on

Election Day. The voter turnout was unbelievable as we averaged more than 50% of voters coming out.

Congratulated the three new Board of Education winners and hopefully they will take the necessary steps

to keep our school district top notch.

 

 

Administrator’s Report – On this agenda we authorized a contract with Tri-State Light and Energy Inc.

for an audit for our Public Works Department, Parks Department and Construction Department buildings

under the 70/30 direct install program sponsored by the New Jersey Board of Public Utilities. We

anticipate that our energy program for the Municipal Buildings will save over $90,000.

 

We held a meeting regarding private bus services to the City to improve service and efficiency. It was a

spirited and healthy exchange by the bus companies and our residents. The next meeting will be held on

December 5th at 7:00pm here at the Municipal Building.

 

We have approved a shared services agreement with Middlesex County for Hazmat services.

 

The soccer complex is moving to maintenance bond; thanked the Engineer for a great job with that

project.

 

Veteran’s Park has been repaired by the contractor, with the new sod being installed and the grass

growing in.

 

The Daniel Ryan Field project will be good for all who use the field.

 

Approved a resolution for a GIS program; on our website there is a GIS map which is an effective tool to

find some valuable information. Our engineering firm maintains that website and residents should take

advantage of it.

Engineer’s Report – Reported that the Ellingham-Spotswood Avenue road reconstruction project is

complete.

 

The 2018 Roadway Improvement Project has been moving forward with Federal Road, Texas Road,

Mounts Mills Road, Ave E, Stevens Avenue, Springwood Drive and Fernhead Avenue all completed thus

far. State Street, as well as, Municipal Plaza are planned to be milled and paved next week. Schoolhouse

Road has been milled this afternoon and will be repaved this week weather permitting as well.

The contractor has been taking advantage of moving forward getting as much done while school is closed.

 

New Jersey Natural Gas on Saturday, November 10thwill complete the gas line on Spotswood Englishtown

Road, again weather permitting.

 

Perrineville Road and Prospect Plains Road is a county project and all ADA sidewalks have been installed

per requirements. There has been no talk of a development plan for that corner. The sidewalks are installed

as part of the State and County requirements for the project and should be completed in a month.

 

PSE&G should be complete with the Spotswood Englishtown Road project in 2-3 weeks and in a month

we should see paving upon completion.

 

The timing of the traffic signal at the intersection of 522 and Schoolhouse Road will be completed after the

paving project is finished.

 

The railroad crossings at South Middlesex Avenue and Applegarth Road Avenue has been completed by

NJDOT as well. It is anticipated that the NJDOT will send a detour plan for the railroad crossing on Federal

Road for 2019 within the next month for consideration by Council.

 

Tonight, there was a resolution to award appraisals for Matchaponix/Gravel Hill Road intersection project

which was approved. Once the appraisals are complete, we will move forward with that project.

 

The pavement replacement for Ely Drive was completed last month and the County paving on Applegarth

Road between Prospect Plains Road and Cranbury Half Acre Road has been completed as well.

 

The Perrineville Road bridge replacement project is still on target to be completed with that road reopening

in December.

 

 

COUNCIL REPORTS:

 

Council Vice-President Schneider

  • Baker’s American Bar & Grill will be holding a fundraiser on November 20thfor the Police Unity Tour. 15% of the proceeds made that day will be donated to our officers.
  • The Police Department’s 5thAnnual Toy Drive is happening now through December 3rd. Donations of unwrapped toys are greatly appreciated. Please no stuffed animals.
  • Attended the Indian Culture Association’s Diwali ceremony. There were amazing costumes and dancing that told the story of good over evil, it was a pleasure to see.
  • As liaison for the Commission on Aging there were 52 people who received their flu shots.
  • Thanksgiving celebration will be a luncheon at the Senior Center held on Tuesday, November 20that 12:00pm. The cost is $5.00. Next year we hope to hold it again on Thanksgiving Day. Transportation will be provided if needed.
  • Very proud of our Open Space accomplishments and would really like to see more signs.

 

 

Councilman Dipierro

  • Echo the Mayor - Attended the Memorial Service last Monday; it was very nice seeing our community come together. It was a class act service and very nicely done.
  • Thanks to the Clerk’s Office for all of their hard work on the election.
  • In regards to the trees that were removed from Concordia Shopping Center along Perrineville Road, Councilman Dipierro asked if they were removed because of the sidewalk project being done, as they were beautiful trees put in by the developer. He asked if there were plans to replace them; Engineer Rasimowicz answered that he will look into this.
  • Asked when the paving on Spring Street will take place; Engineer Rasimowicz answered that the paving will take place this year. He is not aware of any encroachments on Township property.
  • Was at Veteran’s Park this past weekend and thanked Mark and his staff for working hard on that project and making sure it was completed. He added that he would like to see some benches.
  • Glad to see the Daniel Ryan ADA restroom project finally take off. Hope that we can do the soccer field or Veteran’s Park next year.
  • Had a request from residents asking if we could stream line our town meetings; Planning, Zoning, Council, etc.
  • Thanks to Mark for the great job on the paving projects he spoke of.
  • Attended Octoberfest which was very nice and great to see the community come together. It is a well-run event by our Recreation Department who did a great job.
  • Leaf pickup has begun with leaf bags being picked up Monday through Friday from 7:30-3:30 or Saturday from 7:30-11:30. Leaves will be picked up until December 3rd.

 

 

Councilman Baskin

  • Thanked resident Roger Meaney for alerting the police of a suspicious vehicle which was later found by the police.
  • Sunday, November 18that the Marasco Center will be a performance entitled the “Bright Side of Life”.
  • Reminder that the municipal offices will be closed on Monday, November 12thfor Veteran’s Day.

 

 

Councilwoman Cohen

  • Very moving vigil held at the Senior Center. Heard an interesting comment to share, “It was nice that everyone stood together and we did not feel alone”.
  • As the Mayor’s Representative for the Youth Advisory Council there is nothing they cannot do. They are talking about three to four projects they would like to do. They are such bright children and cannot wait to see what they come up with.
  • “Artrageous” is sponsored by the Cultural Arts Commission which is a one of a kind experience featuring art, dance and poetry.
  • We’ve had a very successful food collection with over 13,000 pounds of nonperishable food items being donated to our food pantry.
  • There are electric charging stations for cars at the library and we are one of not many municipalities that have these.

 

 

Council President Dalina

  • Usually the Council President thanks the Clerk’s Office for the elections but the Mayor and fellow councilmembers have beat him to it. Council President Dalina stated that many Monroe citizens thank the Clerk’s Office and he would like to thank the Clerk’s Office, as well as, give a round of applause; Township Clerk Patricia Reid commented that is truly a team effort.
  • Burbio app - Burbio puts everything going on in your community in one place and makes it quick and easy to keep track of all local events.
  • The spams and scams event will be held at the library on November 16that 10:00am. For those interested you can register to attend at the library.
  • Grandparent’s Day Out will be held on December 27thbeginning at the Recreation Center. A movie and lunch are provided. If interested please reach out to the Recreation Center to sign up.
  • In regards to O-11-2018-040, worked with Councilman Dipierro and Administration and we are very happy to provide this to our citizens. We are in a time where there are a lot of foreclosures and this helps with the time, effort and money needed to keep these properties in good condition.
  • Due to the Annual League of Municipalities seminar being held the week of November 12thour next meeting will be a combined meeting on December 3rd.

 

 

PUBLIC:

 

Hy Grossman, 15 Doral Dr.– Kudos to the library, as his wife had knee surgery a few weeks ago and a

neighbor told the library who then delivered four books to her. Salute to the library.

 

In regards to the energy aggregation program, there was $0 charge from South Energy and in contacting

them they said the charges will appear on the next bill. Administrator Weinberg stated that we have spoken

to them about this issue with JCP&L and will follow up.

 

Mr. Grossman brought up a few safety issues, one regarding the speed limit on Mounts Mills Road and

527; the sign regarding the speed limit reduction is in the wrong place. Next, the need to reinforce the State

Law that requires you to put your lights on when it is raining. Lastly, people still wear dark colored clothing

when walking on the roads. When it gets dark out especially now that is does earlier, reflective clothing

needs to be worn. Mayor Tamburro commented

 

 

Maurice Mimms, Safety Manager at Geodis, Costco Dr.– Thanked the Mayor and Council for everything they do for our Veterans. Mentioned that the Mayor stated he is happy to welcome new businesses in the Township, but 1 Costco Drive is not happy with Monroe Township or the Police. Coming before the Mayor and Council regarding parking issues as on both sides of the road trucks are lined up and leaving garbage and feces on both sides of the road. Police are afraid to stop the truck drivers for fear of their own life. We have spent thousands of dollars for cones and cleaning the outside of our buildings. We are upset that the Township Engineer never completed the striping project and hoping to have another meeting with the Costco Manager, Police and Administration. We continue to call, monitor and hope that the Mayor and Council can help with this endeavor. Council President Dalina commented that he is hoping to see that we come up with a remedy for this problem. Administrator Weinberg stated that the Police do enforce the laws but they cannot be everywhere. We are looking into having the striping done. Engineer Rasimowicz stated that we are looking at striping within the next month. Councilman Baskin asked if we had an ordinance against littering; Administrator Weinberg commented that the Police have been writing tickets but Costco is a 24/7 operation and they cannot be there all day and night, the truckers are transient and it makes it hard for them to be caught. Councilman Baskin asked if there are security cameras at the facility; Mr. Mimms answered yes, by the buildings but not on the entrance road.

 

 

Elizabeth Fagen, 21 Woodcrest Cir.– Ms. Fagen stated that she noticed in O-10-2018-035 it excludes

truck traffic. She stated that she lives on 522 leading to the Jamesburg overpass and asked if that section

has the same restrictions; Engineer Rasimowicz answered that there is no truck restriction on 522. Ms.

Fagen added that trucks are constantly getting stuck under the overpass in Jamesburg and currently there is

an application for a warehouse to be built that is going before the Zoning Board. It was explained to her

that just because a company goes before the Board does not mean they get approved. Ms. Fagen stated that

they want to put a warehouse 300’ from our development and a few of her neighbors are here because they

do not want that. She is hoping that we can get some help. Council President Dalina stated that Ms. Fagen

needs to be heard at the Zoning Board meetings and the professionals of the Board need to hear the concerns.

Ms. Fagen commented that if the Zoning Board is going to continue to bend the rules then what is the point

of having rules.

 

 

Chris Parker, 175 Disbrow Hill Rd.– Mr. Parker stated that he is happy to see the new paving done on

Disbrow Hill Road but after the paving was done it has made the flooding worse. He stated that because

of it only being partially paved it is better but still not what it should be for a road with all of that traffic.

He added that the storm drains were not placed properly and in recent news, the Rocky Brook Park will be

opening and he wanted to point out there are some challenges with that park such as mulch and

illegal dumping happening. He suggested that there needs to be signs posted regarding illegal dumping. Mr.

Parker asked if Monroe Manor residents will have direct access into the park and stated that he wishes the

Township would put information about the dumping services the Township provides on the website.

Council President Dalina asked Administrator Weinberg if better information can be posted regarding the

DPW recycling center services.  Engineer Rasimowicz stated that he was out to Disbrow Hill Road today

and did note the paving issues that Mr. Parker brings up. He said that the paving was done by Rocky Brook

and the items are on a punch list of which the developer will have to repair. He added that there is also a

cost sharing agreement with Millstone which will be on the agenda soon. The builder is still on performance

bond and punch list items still need to be completed. He further explained that these items will be completed

before the Township agrees to release their performance bond. He added that there are no plans to get

sidewalks into the park as the park does not connect to Monroe Manor. Administrator Weinberg commented

that this is going to be a passive park with walking trails. Engineer Rasimowicz added that there are

significant wetlands on the Township’s piece of property and does not see any areas to add fields at this

point.

 

 

Alice Sikorski, 251 Rhode Hall Rd.- Ms. Sikorski spoke in regards to the proposed warehouse and stated

that she has lived in the same house for 57 years and the 24/7 warehouse will be 300’ from her house. She

asked if anyone would want to live there with all of the diesel fumes coming into the backyard. She noted

that this will decrease her property value and she takes great pride in upkeeping her property. She added

that she does not understand why this is even being considered. She asked if the economic gain is worth it

as the warehouse is not a good fit. The invitation for more tractor trailers on 522 going into Jamesburg to

get stuck under the bridge is not a good idea. She invited the Mayor and Council to come over and have

coffee with her to see how many tractor trailers there are now. She stated that she is begging and pleading

for someone to help. Council President Dalina commented that he strongly urges her to speak with the

Zoning Board. Ms. Sikorski stated that the last meeting ran until 11:30pm and not everyone had a chance

to speak. What Mr. Mimms stated earlier regarding the issues on Costco Drive with garbage and feces is

what we have to look forward to if this goes through.
